EXTRAORDINÀRY CHARGE AGAINST FIREMEN,
AN INTERESTING CASE,
At the Magltracy to-day before Cint Haslings three members of the Gov't Fire Brigade, Asilotant Foreman McAuley, Fireman McHardy, and Fireman McKenzie, were charged with a breach of daty in absenting themselves fram fire in New Street on the night of gib December. Mr. Dennys prosecated and Mr. J. J. Francis conducted the defence.
Chief Inspector Cocoran said that he received mesange of a fire at 840 p.m. on the 8th, He attended the fire; the three man In Court were absent. He did not know that they had leave to be absent. He spoke to them about their absence; McAuley said he was suffering from a cold and that the doctor bad told him he was not to go out at night. He saw the second and third defendants when before the Superintendent; they said they had heen, to a banquet. Did not remember McAuley said he had been at the banquet.

To the Magistrate-Had never had leave of abrence from fires, but had known men to get special leave under Mr. Wodehouse, when the passes were countersigned by the Superintendent of the Fire Brigade.
Francis Henry May, Captalu Superintendent of Police and Superlätendent of the Flee Brigade, said the defendants were members of the brigade. They did not obtain permission from him to absent themselves from Fire Brigade daty on the night of the Bib and were reported absent on the gib,,when he saw them." Mr. Anley seld he was with some friends-und when asked if he had been at the banquet he said bo had. Witness did not know there had been a banquet until that day. The others also sald they had been at the barquet. No man had any right to be absent without his permission. He had given gene:al_permission for them to be absent since he had been la office.
Mr. Francis-He has only been three months at the head of the brigade.
Witness, continuing, sald others had applied for permission and there were the first who had not done so as far it be knew. If the Deputy Superintendent was at a fire he (witness) did not attend. That was x rule 'he had Introduced.
Mr. Francia-That you have introduced (Laughter).
Witness-I did not do this without the know ledge of the Government, having been in car respondence with theus on the subject.
