Ar the Magistracy this morning Mr. H. E. Wodehouse dlamlased the charge brought by Constable Pepper against the Oplam Farmer in which it was stated that the latter had moved four chests of opium in the waters of the Colony after prohibited hours on the 31st nitimo. Mr. Francis, Q.C., lastracted by Mr. H. L. Dennys, appeared for the defence and contended that the section of Ordinance 22 of 1891 under which the charge was framed did not apply. It referred to the delivery of oplum from one person to another. Itwas absurd to suppose that the Oplum Farmer would be required to sign or apply for a removal permit for his own ding when transferred from one part of the colony to another. His Worship agreed with the learned counsel and dismissed the case, but stated he was of opinion that the police could bring a fresh charge against be Farmer under section 15 of Ordinance #8 of 1891. Of course the police took the bint, and the case will therefore be heard before two magistrates at an early date, when the Crown Solicitor will pro- bably prosecute.
