The cross summons of the Bank is also dismissed. Admiting that the shares are to be deemed fully paid up, there is no reason why the Bank should not be on the list of contributores. As to costs I bear la mind that Mr. Bate was one of the signatories of the memorandam of Association and that all the applications for shares by the public were in fact made to the Bank. For these reasons I think there should be no order except that the liquidators can take their own costs out of the assets, if any. In this respect I follow the precedent in the case of A, W. Hall & Co. where the facts in my opinion bear a very strong analogy to those under present consideration.

FATAL ROW IN THE HONGKONG HOTEL,

At the Police Court this morning, Mr. Hastings on the bench, Choo Slag-chỉ alías Chan Ki-ing, #ged 17, bar-bay of the Hongkong Hotel, wis

charged with " unlawfully, wilfully and maliciously assaulting one Arthur William Jloks," of H.M.S Tamar.

Inspector Baker, who appeared for the Police, asked his Worship's permission to amend the charge to out of manslaughter, the inføred man having expired at the Civil Hospital' at 7.30 | o'clock this morning.

The charge was amended accordingly, and defendant pleaded not gulty."

D. McDonald, P.S. 95, said that while on daly on Pedder's Wharf at 8.30 last night an Indian watchman employed by the Hongkong Hotel came to him and reported that something serious had happened in the lower bar of the catablish- ment. He at once went to the bar and there saw a member of the Medical Staff Corps, la bla uniform, lying unconscious on the floor near the fire-place. There was a bruise on his forehead above the right eye. A European, who gave the name of T. Gilchrist and said he was third engineer on board the Canton river steamer Fatihan, pointed to the defendant, who was behind the har, and said he is the man who did I." Witness then took defendant into custody And telephoned for an ambulance to remove the wounded man to the Government Civil Hospital.

At this juncture defendant, who declined to cross-examine the witness, was removed to the remand cel and the further bearing of the case was, by request of the Police, adjourned until 11.30 am. on the gh inst

"WHERE AR: THE POLICE?" To The Intros or the "Honaxana TuzsoRAPH," SIR,-Ysterday between the hours of 1045 4.m. and 12.30 p.m., passer-by, of an observant turn of mind, could not fail to notice the unusual-number-of-Chinese-urchine-assembled on Queen's Road between the Cricket and Parade Grounds. These urchins were basy dispoiling two trees (one on the borders of each ground) of their budding flowers or leaves-I'm Brt enough of a forester to know which-by climbing up the trees, and breaking off small branches and twigs. From the Officers' Mess at Murray Barracks to the Club not a policeman was visible. To show how smart these youngsters were, I may mention that they had scouts posted at the corners of the Cricket Ground and City Hall, and the word of the "coast all clear acemed to be frequently passed around.

Later on, in the afternoon, in the vicinity of Caine Road West, I noticed other Chinese lartiklus in force, playing and taking full charge of this Road, and it might have fated badly with any European cl fldren had they been passing that way and been bustled by the dirty infantile scum of Tal-plog-shan. The bullet entered at the top of the left cheek, and took an upward course. Another shot was then fired at the man's stomach as he turned over, the marks of which can be seen in the bed- clothing. Kim-ok-Kian then got off the bed and rashed au of the door along a corridor, He was pursued by his assailant, who fired one more shot at him, which entered below the left shoulder blade, and then Kim-ok-Klan fell, at the top of a small flight of atalie, where his dead body was found by the persons who were attracted to the spot by the firing.
