IN SUMMARY JURISDICTION,
(Before Mr. E. 7. Ackroyd, Pulene Judge.)

"NO CRITS." The Hongkong Hotel Co., Limited, sued W. Benvin for $14.55 for drinks supplied. Mri E. C Ellis appeared for the plaintiff, and the defendant appeared in perenn, There was a similar salt *gainst G. J. W. Klog for $5
His lordship:-Can you sue for dricka? Mr. Ellis said that the defendants had signed chits for the amounts, and could be saed for them, unless they chose to plead the Statute la defence. The statute made debts for drinks not recoverable; but the wording of the clause was ex ctly the same as in the Statute of imitations, which was not a bar to action unless distinctly pleaded. If the defendants de ided to plead the Statue, there was no caso far the plaintiffs but if they did not, the case could come into Court, as the Statute did not apply.
His lordship thought he law was clear enough, and the plaintiff could unt sue at all.
Mr. Ellis These men have been in the hotel, and have had the benefit of refreshments 10pplled to them, and have signed rhits for the amounts; I think it is a great disgrace for them to plead such a defence,
His lordshipWell, I can only go on the law-there must have been some good reason for the law belog enacted in these terms. You may goon with your proof, butassoon as it appears on the evidence that the action is for liquors supplied, whether the defendants plead that or not, I
cannot maintain your action,
Mr. Ellis submitted that notice ought to have been given under the Code by the defendants if they wished to plead the Statute, failing which they could not, he thought, have the benefit of

His lordship could not get over the words of the Statute no publican shall maintain an adifon for drinks. He could not do anything but dismiss both cases at once, and the plaintif could appeal if dissatisfied.
Mr. Ellis, a short time, afterwarda, sald :-- Your lordship. I am authorised by Mr. Beavis to state that he has no wish to plead this defence, and that he will pay as soon as he is able. He wishes me to state this because he has no wish to take advantage of that defence.
His lordship Very well.

In reply to Captain Burnie the Chairman maid that the Company had not yet got a lease of any land, but only a "concession," giving exclusive rights of prospecting and mining over 100square miles till 28th March, 1898; lease would be obtained as soon as the exact "ile" of the lode, N-9 or NF-SW or NW-SE, had been ascentafeed by the deeper mining zow started Then strip of 30 square miles, eliber a miles by 15 miles, or as might seem best, would be leased: but a losse would not be a good thing yet, as it would at once bring the Company under the mining laws and bamper it, while à concession did not."
