THE "TETARTOS" CASE. The hearing of the owners' application for the release of the steamship Tetarios, arrested by order of the Governor under the Chinese Emigration Ordinance of 1889, was continued to-day. As before, the Hos, W. M. Goodman, Attorney-General, fastracted by Mr. G. C. C. Master, Acting Crown Solicitor, appeared for the Crown, and Mr. J. J. Franels, Q.C, instructed by Mr. E. C. Ellis (Mr. V. H. Deacon's office) appeared for the owners.
The special Jory consisted of:-Jacob Silas Moses, Robert Kennaway Leigh, Thomas Isaac Rose, James Billington Coughirie, Masena Solo- moa Silar Sassoon, Nathaniel Joseph Ede, and Edward William Mitchell
Before re-cammencing with the Tafarios came, Mr. Francis asked leave to mention two cases in the Crimtoal Sessions, which he understood the Chief Justice would take. In one of them Mr. Francis was to appear for the prosecution, and in the other for the defence. He would like to ask what arrangement could be made.
His lordship did not know whether be or the Acting Fulene Judge would take them.
Mr. Francis understood it was intended that Mr. Justice Wise would take one of the Sessions crues today, and leave over the rest to some other day, subject to any arrangement which the Chief Janice would make.
His lordship sald be understood from Mr. Justice Wise this morning that only one Sesaloos case was ready for trial; in another, counsel had not yet been instructed, and in the third case the Information had not yet been filed against the prisoner.

Mr. Francis submitted that it was one of those things which were constantly refused by the jadges, to allow material amendments to be made in indictments or to smead a case or make it up as it goes on. Fartles supposed to come into Court fully prepared with a complete case, and not to start on a "fishing commission." New and then new matter might be allowed to be introduced in the Cours of a case, under exceptional circumstances; bat to make a practice of doing so, as the Attorney-General was in the habit of doing with every witness who had been called yet, was quite Irregular and contrary to the whole theory on which the procedure of the Courts was based.

belleved to be carpenters, but he did not know how many. He did not know whether they were to go with the vessel to Stag- apore. He saw the tw> largest rice-bollers brought on board one day, by whom he did not know. No communication whatever

made to him with regard to their being brought on board. He did not know whether they were cargo or sct. Witness stayed on board the ship when in part; so did the Imhers captain. Witness bad never seen some and frames brought out on deck from below, and fitted together by the police. They might have been intended for use is so fitted, but he did not know. He saw the large ladders brought on board. He did not speak to the captain about the rice-boilers. He did not know whether the ladders were cargo or not.
By Mr. Francis :—As to the Chinese who were "supposed to be carpenters," witness now believed them to be such, and had that idea from the first-before the ship was seized. The timber which the police fired up as "booby-hatches" might equally well have been used for anything clse; there was nothing to show one purpose
more than another.
By the Court -The supposed carpenters leit before the arrest of the ship.
By the Attorney-General-The frames were found to be shorter on the starboard side of the abip, where there was a steam pipe to be allowed toom for; witness thought it clear that they must have been meant for that alone.
By the Court:-Witness had not seen asy- body takig measurements on the Tuartos, about the batches, for instance.
The Attorsty General said the case for the Crown was now complete.
Mr. Francis said the defence would not call evidence.
His lordship asked whether the parties had. agreed as to the need of viewing the ship.
Mr. Francis did not see any use in it. The Attorney-General sald’ke would ask for a view, unless idr. Francis would admit that all the things were put on board, and for the par pose suggested by the police.
