The magistrate stated that it was found that the respondent was chief preventive officer of the Hongkong, Canton, and Macao Steamboat Company that on the 5th June he went on board the steamer Fatshan, then about to leave the wharf for Canton, He searched the baggage of the passengers, and found two ting of prepared oplum (125 taels excb) in the baggage of the appellants. This was not on the sleamer's manifest, but Lam Yik produced certificate from the Hau Fook hong (the Oplum Farm) covering the amount named. It was contended by the respondent that the omission to enter to forfeiture, under the Oplum Ordinance. the oplum on the manifest rendered is ilable The magistrate, Capt. Hastings, upheld tbls contention, and ordered the forfeiture of the opium. Mr. Francis submitted that the Magistrate had misunderstood section 38. la which the manifest was mentioned, and that its meaning was only that, where oplum was seized for breach of the Ordinance, and was not on the manifest, it could be forfeited; not that it could be forfeited simply by reason of not being entered offence, but was only a condlifon under which 10me offences involved forfeiture.

The Chief Justice thought it was quite clear that the Magistrats had been misted by the wording of the Ordinance, and had given sec. a wrong interpretation. The appeat must therefore be allowed.

All necessary arrangements were made in time and every precaution had been taken to avoid any hitch in the carrying out of the execution. Guards were drawn up at the various entrances to the gaol grounds, notwithstanding the fact that the gallows had been erected just in front of the office of the Governor of the Gaol, and was quite hidden from catside view.
