He admitted it on oath in the Supreme Court.

Mr. Dennys asked that each specific act be the subject of a separate charge, as there be diferent defences. Mr. Ellis had no objection; each specific act would have to be proved by the prosecution lo any case.

Mr. Dennys next submitted that the charge of perjury was insufficient as it stood.

His Warship thought it would be better to dispose of the larceny charges first:

Mr. Ellis said the presenation was willing to specify the perjuries If the defence wished.

Mr. Dennys pointed out that in the one case the magistrate had summary jurisdiction and in the other not; but of course if the summary powers of the Court were not to be exercised, it would alter the case.

His Worship thought the charges of appro- priation and of perjury could not be taken together ; the former would be better taken at once.

Mr. Ellis asked if the defence would admit the bill of sale.

Besides planos, Mr. Haka had lots of tore, aliks, fancy goods, and so on, which thing in Mr. Pealban's bouts was sold by did not come under the bill of sale. Every auction, including Mr. Hahn's piano. I once saw a plano removed from Mr. Hahn's shop, m a new one jast brought out for sale. I also saw another, which I understood was going on hire to Hanel. I did not look at the plane ́covered by the bill of sala before lending the money I could not identify them. When I say I would have allowed him to sell planoa if he accounted to me, I do not mean that I ever did. give him permission. I have always thought him trustworthy until now,

By the Court:-What I'mean is that if I had seen him selling a piano. I would have expected him to hand over the money to me, and that he would be at liberty to sell If he did so; but I do not mean that he actually bad liberty to well. As a matter of fact, he was not at liberty

to sell them at all.

Formal evidence as to the algostura on the bill! afsala, "C. A. Bowles," now deceased, was given by M. Azevedo, clerk in the office of Wotton and Deacon..

His Worship suggested an adjournment at this stage.

Mr. Dennys agreed, but asked that ball be reduced from the excessive sum of $3,000. The cua had already been threshed out, thoroughly in the Supreme Court

Mr. Ellis objected and sald that this had nothing to do with the present case.

Mr. Dennys went on to say that the Acting Chief Justice had expressed bimself as quita wailsfied with Mr. Hahn's conduct. Of course, bis Worship would have to taim the evidence in this case notwithstanding, but mera nominal ball was enough.

Mr. Ellis pointed out that Captain Wright's evidence was not before the Acting Chief Justices there was only Mr. Hahn's statement, in respect of which he was now charged with perjury.

Mr. Dennys urged that it was impossible for the defendant to get $1,000 ball; he would have to go to prison, leaving his wife and family destitute,
