Gentlemen, We, the undersigned members of the Hongkong Jocker Club, being of opinion (a member of the Club) has been, and is (so long that the conduct of Mr. Robert Fraser-Smith as he remal a member) jurious to the character, taterests, welfare, good order or credit ofthe Club by reason of his having been convict:d of conspiracy, desire that you do forthwith request him to resign his membership of the Hongkong Jockey Club, and should he sot resign within one month after such request, that you do convene or call extraordinary general meetings of the Club for the purpose of expelling blm therefrom.

3. That the alleged Rule 40 is void, or if not wold that it has no retrospective effect. 4. That the Resolution purporting to have been passed on the 11th day of September, 1891, and confirmed on the 26th day of September, 1891, expelling the plaintiff from the ockey Club, be declared 'null' and vold.

ANSWER.
7-The Defendants admit the treth of the allegations contained in paragraph 13 of the Petlilen but they further say as follows: A copy of the sald Requisition was first sent in to the Pislatiff on the 26th day of May, 189, without any certificate of concurrence by the Stewards attached to it, and the Plaintiff was called upon to show cause before the Stewards why he should not be called upon to resign la terms of the said requisition. The Plaintiff appeared before the Stewards on the 6th day of June, 1891, and was fully beard by them in his own defence, and it was not until after they had beard the Plaintiff in his own defence that the Stewards signed the said certificate of concurrence,
8.-The Defendants admit that an extraord inary meeting of members of the Jockey Club was held at the City Hall on the 11th day of September, 1891, to consider a special resolution to the effect that the Plaintiff should be expelled from the Cleb and they also admit that the Plaintiff was present at such meeting, Save as aforesaid the Defend nia deny each and every of the allegations contained in paragraph. 14 of the Petition, and they further say as follows:- -The Defendants admit the truth of the Prior to the holding of the said meeting all the allegations contained in paragraphs 1, 3, 4, 5, 6, correspondence which had taken place between" # 8, 9 and II of the Petition.
