In summing up his honor said that the action was not by any means one of cammen occurrence, for it was very seldom in breach of promise actions for the man to be the plaintiff. But although it was an unusual thing the law recog- nired it, and the man had a perfect right to come in and claim for damages be considered he was entitled to by the woman breaking ber promise. In the particular case they were called upon to decide they were relieved of one very responsible task in the assessing of damages, as the plaintiff had said through his counsel that he did not desire heavy damages if a verdict were brought la for him. They would therefore be relieved from the difficulty of assessing the damage Ris Honor, having reviewed the evidenco given said that one of the most extra ordinary things about the case was that while the plaintiff swore he was very fond of the defendant, and would marry her now, the defendant said that the detested him and would hot have had anything to do with him if he had not forced himself upon her. In the event of a verdict being retained for the plaintiff and daranges awarded the defendant, if she could not pay-and she had stated she had no property she could be sent to geol, for the damages awarded for breach of promise could not be liquidated by the Insolvency of the person res- ponsible for them. The costs of the action could be dealt with in the same way.
After an hour's consultation the jury notified that there was a three-fourths majority in favor of a verdict, and the parties having agreed to accept it, the foreman announced that the' verdict was for the plaintiff in 4os daciages.
His Honor granted costs against the defendant.
