that, there was very close connection between them when Webber was managing clerk in the office of Mr. Ewens--that Minhinnett had extensive legal business, conducted through Mt. Mr. Webber farther stated that in conseqence of this he left Mr. Ewens and set up on his own account, and during the first twelve months, from September 1887 to September 1888, the business that Minhinnett got for him, of his own or from his friends, was worth $500 a month; that Minhinnett himself had very numerous transactions, possibly three or four cases or two three cases every month in coast during that first twelve months

There was no fatention whatever to use it for anything else but a first-clase establishment. There had long been a desire among the Chinese for a house on the lines of the Hongkong Hotel, where the Chinese could go and find good accommodation, and be treated as they could hardly be expected in a strictly European ablishment. Of course, much opposition was raised. The strongest objection usually would be from the palica-Thea there was the teetotal faction, which he submitted abould receive no consideration at all. It was unreasonable to deny the use of alcobol simply becausa some people infared themselves through it. If would be just as reasonable to probibit the use of gunpowder for fear of a man blowing his gainst the granting of this licence would be brains out, The only reason that could be urged that it was not required, and he maintained that that was a matter for the publie to decide for

The mere opinions of a few surrounding residents were of no weight, for where a hundred might be found who thought it was not desirable, another, hundred could also -be found who thought it was deafrable. ' That was no legal objection. A large number of Justices had come to this meeting and he con cluded they had already made up their minds to oppose the application without thyme or reason--

The Chairman :-You have no right to say that I imagine they have come to do their duty en Justices....”

Mr. Wotton -No doubt, and they bellore it' their duty, to refuse the licence,

The Chairman-They may have come to support your application for all you know.

Mr. Francia continued that as a matter of fact Minhinnest never had done any business through Mr. Ewens nor in bis office, nor had him in any way, and that during the first cases in court in which Mr. Ewens represented twelve months that Mr. Webber was in business August, 1888) on which he had a case for Min-themselves. for himself there was only one occasion (13th hinnett, good, bad, or indifferent, and that case had been commenced by another solicitor and was only taken up by Mr. Webber at a late stage. So that, to recaplenlatea suit was pending in the Supreme Court; Mr. Webber was called to support the plea of fastification raised by the defendant in that suit ; he gave evidence which if true would very materially support that pica; and with a view to show probability and support the truth of his statements he asserted vary great and close intimacy with Minhinnett | during that time; such a statement coming from a stranger would have been hopelessly im probable. Therefore the prosecution now main- tained that this portion of the evidence was material part, as bearing on the credibility of the rest of his ovidence, and material to the issuin under trial, and the prosecution alleged that the prisoner committed distinct, clear, and unmistak the cusions in England when criminal charges able perjury in respect of these matters. It was. arose out of civil proceedings, and the civil cases were still pending, it was the custom not to try the criminal cases until after the civil proceed presumed his Worship would not wish to lags had closed. Therefore he (Mr. Francis) go into the care in detail now, as such investigation might possibly prejudice, the fair trial of the civil action. Therefore he proposed, with his Worship's sanction, only to call formal evidence that the snit was pending and that Mr. Webber gave evidence under oath and before judicial officer; then he would ask for an adjournment until after the trial of the civil case. Mr. Wise-I think you said yesterday, Mr. bad another objection to the warrant, said that prosecution for perjury, could not Mr. Webber:-Not quite an objection. I be brought on

de bens were examination merely. A person cannot be indicted epod Mr. Stokes and there were two objections--- a statement made in chambers, but only after | (1) a first class hotel was unnecessary, as already his statement has been read out in the court, there was more first class accommodation than and has so become evidence, through_being | wasrequired, and it was the policy of the Justices declared before a court, before a judge and jury, His Worthip said he had looked up the point and as far back as the time of Charles II, there was a case which dealt with it.

Mr. Watton thought not. (Passibly he saw it brewing in the air.) The question resolved itself into one of the respective strength of the parties. they had a duty to perform for the public tod He only wished to urge upon the Justices that

must not come to any rash or arbitrary decision, but judge the question solely and wholly on its merits. There could be no reasonable objection to legitimate enterprise, and the only test was its success of non-success. When the licence came to be applied for next year, if anything was not satisfactory It could be withheld. The petl·lon contained no facts or reasons'at all, there was absolutely nothing in it. The theory that the hotel was to be a ten cent house was quite wrong. It was to be's high class hotel at moderate prices.
