Mr. Whitehead-In connection with the Observatory there is an excess of $733 for new fastruments. I trust these instruments will give some useful results, because lately, in this last storm we had, I very much fear the instruments were very defective, or something was defective, because the warnings given by the Director were far from satisfactory.

The Acting Colonial Secretary-As regards the item mentioned by the hon. member it has not been the desire of the Council to give too free a hand in the way of instruments. It would be easy at the beginning of the year to put down

The Acting Colonial Secretary-The motion before the Council is that this Bill be read a third time. It was read the first time a very long while ago, and considerable time has elapsed since its second reading. Every atten- tion was given to the mitter, and those who objected to its passing employed learned counsel to speakand to address the House. Ha WAL listened to with every respect and attention, and his arguments were carefully thought out and weighed. Letters then appeared in the Press expressing public opinion on the matter. SHIL there was no burry, no undue haste. The Bill came on in due course for the second reading, which is the time when onslaughts are usually made on Bills by those who oppose them. It went through, with the rather unusual result of complete ananimity, and one would have thought that as is ordinary cases the third reading would be a mere matter of form. But would appear that the powder and shot was saved up and a rather sudden attack made-for I believe no notice of this was given. The hon. member has put before us some Intricate cases that would be most interesting to lawyers If put forward by suitable people, but I cannot see anything extraordinary in them as arguments against the Bill. I don't see anything to prevent the numbers of shares being given; It is the usual procedure at present in most transactions, I understand, so that the scrip can be identified. I do not think the ingenious cases put forward by Mr. Whitehead are any serious argument against the Bill, and even If I have failed to grasp the full danger that may be Icaused I see no reason why the Bill should not she passed, because all Billı cause some incon- venience in a few cases, although of great use !to others.

Mr. Whitehead-I don't think this will be. The Acting Colonial Secretary-The Council, has paid great attention to this Bill, and it is most embarrassing to find hon members at one meeting approving of the Bill and at the next opposing it. I think the time has come when this Couneli Jebould cease playing with the Bli; it seems to me, that the second reading is the time when the opposition should be made. The second reading was unanimous, and, nothing fresh having arisen since then, I don't think we should be asked to stultify ourselves by throwing out a Bill which, after full consideration, it has "accepted.

THE OPIUM ORDINANCE,

The Acting Attorney-General moved the first "reading of a Bill entitled an Ordinance to con- solidate and amend the laws relating to the movement of raw opium within the Colony, and to the boiling and preparation of ich oplum within the Colony.

The Colonial Treasurer seconded. Mr. Whitehead,—I have been consulted on

this proposed measure, and the opium merchants and others are exceedingly alarmed by the nature of the Bill. I think your Excellency might do well to postpone the first reading of this Bill until the opening of the Council after the summer recess. I think we have had enough, if not a little too much, of fresh legislation of late, and this matter is one of such Importance that I think it would be desirable to postpone it until after the summer recess.

The Colonial Treasurer-I might just explain that a fresh Bill is absolutely necessary on account of the decision of the Supreme Court,

which took every one by sarprise and entirely apset the former Ordinance; and that this Bill, If passed at all, should pass at once. Tenders for the new Opium Farm have to be called for within a month and the persons who intend to tender are approaching me already with reference to the position the Government intend to take up with regard to the next letting of the Farm..

His Excellency--In any case there could be no barm in reading this Bill a deal time to-day, It will then be pubilaked in the Gossite, and time for consideration, will be allowed, as kas been dope with all leglilation of recent date.
