THE CHINESE CONSPIRACY
CASE.
At the Magistracy this aflemon the four China men charged with exploiting a ward of court and defrauding him of $5,000 in money and $20,000 In securities were brought up again before Mr. Wise on remand. As before, Mr. Francis prose. cuted, Mr. Robinson defended the first two * prisoners, and Mr. Wolton the other
Mr. Robinzon urged that in the continued
absence of the plaintiff from the witness box there was absolutely no evidence before the court to suggest a conspiracy, or even to justify the remand granted at the last bearing.
The Magistrate could not agree with him. Luk Man-taun, interparter to Mr. Phillippo said on May 29th Yung Yak Ya, the missing fifth defendant, came to Mr. Phillippo's office, saying he wanted a lawyer to witness a money payment. He was told the charge would be Sas, and he went away. Later the plaintiff, the third defendant, Mr. Ewens' clerk, and two other men came to the office, and a mortgage for $5,000 was drawn up and duly signed by all concerned, the money being handed over to plaintiff.
Sing Aslug, clerk to Mr. Ewens, said he was asked by Yo Kim Heng in May to find out the plaintiff's financial position, as he was wanting to borrow $5 000. The inquiry was accordingly marie. Witness knew plaintiff had an eleventh share in the estate of Tso Wing Yung. Witness had been concerned with plain- tiff's affairs for nine years. On May 37 plaintiff and third defendant and Yok Yu came to the office. Witness naked plaintif whether he really was borrowing $5.000 at 24 per cent, on the security of his coming estate. He said "yes." Witness asked about his age, as he appeared young, and plaintiff said he was 13. Witness then and afterwards repeatedly urged that another solicitor thould be employed, but the defendants: seemed very wiling Witness suggested Mr. Wotton, he being plaintiff's solicitor. Afterwards witness was present at the interview mentioned by last witness, when the money was paid. Witness there heard no mention of plaintiff's age. The payment was $1750 in notes and $2250 by means of a document. No word was sild at. all about a loss of $15,000. Witness bad the impression that the only previous encumbrance on the estate was the $7 000 mortgage, and that Yu Keng-chong (lender of this $5,000) came as second claimant. Witness heard afterwards of the further charge of $15,000, and at once wrote to Yu Keng-chong to get his money back. Then Yang Yuk-yu came and asked witness to get nlaintiff another loan of $5,000, and offered $200 commission, saying he was himself to get $500. Witness advised him not to lead, and refused to help. Complainant's share In the estate was worth about $30,000. On May 30 witness saw Hong Mak Hol, who. asked II it was true that plaintiff was borrowing $5000 and $15.000. and said it looked odd. When witness advised plaintiff to take Mr. Wetton's advice in the matter of the mortgage, he had no other reason except that Mr. Wotton was plaintiff's solicitor.
By the Court: Witness had dealt in the affairs of the Two family nine years, but there were so many of the Tso sons that he did not know their age; he had thought only one son was now under age.
The case was adjourned to Friday,

It may be asked, seeing that no books were sold, or much work done of any kind, would it not have been better to have kept away alto- gether, or to have put on the native dress to avoid attention and thus have prevented the uproar. As to the former, the preachers of the gospel, since the days of St. Paul, have never felt just- fied in giving any place the go-by because there was a possibility of their presence creating a disturbance. Had they, especially in the earlier days, adopted any such rule, the number of cities which would have heard the message would have been few indeed. As to the alternative of visiting haslite places in native dress-this is just shade better than not visiting them at all.
