SHAKEEN HOTEL. HANCOCK. Judgment was delivered in the matter of the casts of these two cross suits this morning. Hi Lordship said that the costs were quite at the discretion of the Court, and it was in the discre tion of the Court to refuse cis even to the successful party. In this case a compromise was offered by the plaintiff Hancock. He offered that both sults should be withdrawn, such party its own costs. The Hotel Company paring refused that, the case went to trial, and Hancock succeeded in recovering the small sum of $36.16. His Lordship thought at the time that the Hotel Company were entitled to costs on one issue. Since then the letter offering the compromiss had been produced, and he found that If that offer had been accepted there would have been no suit, and the Hotel Company. Instead of having to pay $36.15, would not have paid anything at all. As they refused that offer and had not succeeded they could not have costs on any one lasue. In Williams v. Thomas, Drury and Smale, a compromise was offered and refused, and the Case was decided according-to-the-compromise. offered; in that case also a letter written with. out prejudice was considered, and the Vice- Chancellor gave judgment which made the polat clear. In Barker v. Birch, reported in Downing and Lamb; Amot v. Wisc, in White (Baron the large portion of Asia comprised between Men sad Women of the Times 1891. Huddleston) were Judgments applying to this Penang, in the Straits Settlements, and the very case. The company refused an offer that Northern Chinese Ports, including Wladiwostock, both actions should be withdrawn. They there- fora aught to pay all the costs of both. Lord Formoss, the Treaty Ports of China and Japan, Justice James also decided similarly. Judgment Cochin-China, the Philippine Islands, Corca, therefore must be entered for Hancock in the British North Borneo, the British Colmy of sum named, with costs.

DEATH BY CONTRACT.
The preliminary hearing of the charge against Wu Chun, foreman of a gang of coolles, that on the 20th May be caused the death of Chu Han, was concluded before Mr. Wise on the 13th inst., and prisoner was committed for trial on ball of $250, The evidence given from the commencement of the case and at the inquest la, briefly, to the effect that the Sanitary Board ordered dratos to be I down on property off Third Street under the control of the Land and lavestment Company, The Company entrusted the work to Messrs. Palmer and Turner, who ab-let it to a contractor named Fu Sik who was to do the work for a lump sum. Ha engaged coolies to dig out the trench. He also engaged the prisoner a foreman. In cutting away the soll they came to solid rock, and Fu Sik engaged another man to blast the rock. All there were paid by the day, but as the blasting was conducted very slowly, he agreed to pay him $3 for the job. Belog now oa plece work, Mr. Guy Fawkei at once hustled things, and was in fact too busy to take any precautions whatever, A charge was put into the rock, only about eight feet from house door Somebody pulled the string, and a few hundredweight of solid tunisie on the
mountain rose and
house door from its bolts and struck a man in the abdomen. Then he smiled a kind of sickly smile and sank upon the floor, and the subsequent proceedings interested him no more. The evidence of several Chinamen differed lightly in distances and other details, One man said he warned the man not to fre the that. Another sald infoser had nothing to do with the blasting, only with the coolies who were diggings and the man who fired the shot has now himself gone off, and cannot be found. It
