He also took exception as to the form of action. It would have been more correct if they had claimed for money paid on behalf of the deposit. He submitted the plaintiff could not claim on the lease, and he farther contended that no evidence had been shown that the defendant had benefited supposing there was a deposit of $1.000. They should give some evi- dence that there was such a sum, yet none and been called. The court might have surmises and suppositions, but he submitted the court could not act upon such as those.

A splendid race and most exciting finish between Atkinson, Jast year's winner of the cup, and Dundas, who eventually won by a few fuches.
