There are just one or two points more in the 'Chief Justice's written judgment to which I might briefly direct attention without prejudice or desiring to give offence. His lordship made special, and in my opinion gratuitous, reference to the fact that the crime with which the prosecutor Minhinnalt was charged at the Magistincy (meaning tape), if proved, was punishable in England with penal servitude for life, and in the Colonies (presumably meaning the Australasian colonics) with capital punieb ment; and he added-the very circumspect wording again struck me forcibly-"the finding of the jury is that you agreed to bring, and did bring this charge,, knowing it to be false, or not bellering It to be true, and from malice" That was technically the finding of four out of the seven Jurars, and I charitably incline to the bellef that these four gentlemen could not have been positively clear as to the exact issue; but I am morally certain as to the conclusion arrived at by the Chief Justice, quite distinct from what he considered to be his duty after the verdict had once been given. They are fold they cannot propose any increases, but they can express their opinion as to a decrease, and I think this is a legitimate case for a decrease. The colony is not satisfied with having an auditor to audit merely oneside of the accounts, the other side having to go home for audit. This is disap. proved of by nearly every one in the colony. It curious arrangement altogether. We had Auditors in former years who did their work here, and latterly we have bad the Colonial Secretary who did the Auditor's work. Now we are asked for $13,000 of which the resident Auditor only gets other $6,000. We are entirely in the dark in the T. Whitehead-I beg to move that the vote be réduced by $10,000.".

SIR-After performing the painfal daty of passing sentence the other day in this now throughout a carefully written judgment was of the most guarded description and especially with regard to the verdict of the jury, referred in the following terms to a medical certificate from Dr. Jas. Castlie (which stated in effect that one of the victimis (Mr. Fraser-Smith) was far gone in consumption, had suffered from levere cough for the past nine months which all his (the Doctor's) care and attention had failed to remove, and that any close confinement would be dangerous to health and life):-"The paper written by Dr. Cantlie, which is not on oath, is not for me to take any notice of. If there is anything effecting the health of a person in prison it is the duty of the Executive to see that no injury results, and it is quite open to the Governor either to remit the hard labour which consider it my duty to order, or to shorten the punishment if the interests of the case requirs t It is my duty to pass the sentence that I have done, etell

It is absolutely true that at home rape may be punished with penal servitude for fe, and it is also the fact that in at least some of the Australasian colonies-not in all I think -the crime is a capital offence; but surely the Chief Justice does not believe, and does not wish anybody else to believe that there ever existed the remotest chance of Minhinnett, or any other man similiarly accused, being convicted of rape a most difficult charge to bring home at all times, on evidence alleged to be false, a concoc- tion of shallow, inventions, unsupported by any actual proof! The idea is too absurd to be seriously entertained. But in this case, if any not appeal from the proceedings in court. What did come out was strong evidence of a very serious charge, if it did not amount to rape, and it was only contradicted by the denial of the accused, which has to be taken for what it was worth. It would have been much more to the purpose in hand (I mean the question of sentence) bad the Chief Justice pointed out that the prosecution of Minhinnett for rape was undertaken by the Capt. Superintendent of the Hongkong Police, acting for the Government, on his own personal responsibility, who had publicly avowed his responsibility in Court, and that there was nothing to show that the second defendant (Fraser-Smith) had anything to do with that prosecution, efther in laying the information or in connection with the trial before the magistrate.

As a Peruvian subject I have appealed to the Consul of my country, both personally and by letter, but without having received any definite response to my petition.

I am for the first time in my life essen- tally a "destitute mariner", and as such am fully entitled to the assistance I have hitherto vainly aiked for.
