this case for trial to the Supreme Court. What evidence have we got? We have a cock-and-bull story which Mr. Francia had the unparallelled Impudence to ask you to believe, that I caused this man to be arrested because I had been involved in some paltry civil legal proceedings- that of that account. I "conspired" with "my servant a member of my staff to get this man sent to gaol for an offence that he never committed! Have you got one word of evidence to justify that accusation? publle servant-my servant, becaOSE, I help to pay him just as every tax-payer would does-of an offence that blush even to read of This is handed to me honestly, legitimately, and fairly. What do do? I take legal advice before I take a single step-l consult my solicitor. He says "Shocking! But I have heard of this before." On his advice I send for one of the detectives-Inspector Quincey, but he is at Macan for a week. When he returns I put the statement before him. HoLARGE SAWS, etc., etc., BUNTING, FLAGS, says "Oh I heard all about this before." Then, by legal advice, as the only fair thing to do, I see Mr. Mitchell-Innes, the Protector of Chinese, (supposed to be) as something which is too gross and disgraceful to be dealt with in the pages a newspaper. I, also on legal advice, write to Minhinnett telling him the allegations made against him, and of my intention to place the matter in the hands of the authorities. Then I go to Mr. Mitchell-Innes, hand bim the statement. I have received, and ask him to read it for what t worth. He says "It is abominable shocking disgusting; there is nothing for it but a criminal prosecution, I suppose ? I tell him that that is for him to decide, and advise him to consult the law officers of the Crown. At his request I send Mr. Ward to see him, and there my part ends-from that time to this I have nothing to do with the matter in any way. They don't call me as a witness in the proceed. ings-why, therefore, am I implicated? Have I committed any crime? If so, where is it? I fail to ace it. It is so easy to swear an information-to get a man, whose time is valu. able and whose name is good, haled up here and accused of a most heinous crime, even though he be innocent. On the information before you you consider it a case for a jury. It is not your place to argue with me on the point, but 1 certainly cannot see any grounds for that opinion; the evidence of every witness in that box has been my vindication, and, I think, the vindication of Mr. Ward alsa. What he did be had a perfect right to do legitimate right as a member of this comma nity. And I venture to say that in nothing did be over-step his duty he did nothing he was not fairly entitled to do-nothing that I would not do myself if the same thing occurred 'again.
His Worship-I have already expressed my opinion on the case, apart from any doubts of my own, and besides I think it is only fair that you should be vindicated by twelve men instead of one. But I would warm you that anything. you say

They must prove, I respectfully subunit, before you can commit this case, that the charge was false. But the evidence that it was true overpowering-absolutely true. I presume your Worship has not had time to read the depositions-
His Worship replied that he had.
Mr. Fraser-Smith-I. am glad that may pre- sumption is wrong, because in that case you must know the facts. On the evidence of the woman Ah Ngan alone I cannot understand why the case was not sent for trial-nor can any man who knows the slightest thing about law. It was a prima facte case in every line, but it was not sent for, trial, and yet you take it as evidence that I and Mr. Ward conspired. I don't wish to continue speaking if your Worship has made up your mind-
His Worship-I have told you so.
Mr. Fraser-Smith-But I am trying in a quiet way to argue against a committal. I don't want to have my time wasted in the Supreme Court if I can help it; but if your mind is made up I prefer to keep my witnesses for that opportunity. I don't want to cross-examine the complainant here I prefer to fight this out hereafter, and perhaps it is better, In a serious case like this, that we should have our fates decided by twelve men rather than one, who may perhaps be unconsciously blassed. So under the circum.. stances we had better acquiesce in a committal. I have plenty of witnesses.
His Worship-It is for you to call them.
