September rath, 1890,
A TRADE-MARK DISPUTE. Mr. Francis, QC., (instructed by Mr. Johnson) applied ex parte for an interim injunction restraining Megers. Naudin and Co. from Importing or dealing in cotton yarn bearing labels that were a colorable imitation of those used by the firm of Brooks, whose behalf he appeared.
CA
His lordship was reluctant to grant an order unless the matter was urgent, and suggested a notice of motion instead, in order that the other side might appear.
Mr. Francis pressed his application, although his lordship doubted if it would be of much use as worded, Messrs. Naudin & Co. having denied that the imitation was colorable.
His lordship asked who would be responsible if that were sustained?
Mr. Francis replied that Messrs. Stolterfoht and Hirst were the petitioners agents here.
His lordship granted the Injunction until Thursday, Wednesday being fixed for hearing notice of motion.

THE FIRE AT, BLACKHEAD'S GODOWNS.
Mr. Robinson held an inquiry at the Magistracy on the 13th inst. into the circumstances connected with the extensive fire which occurred at Messra. Blackhead's gotowns, Praya Central, on the night of the gth Instant.
I simply said, with reference to the argument of the prosecution, that an outsider had gone in and gambled there, that a respectable stranger right possibly find his way even into the whist room of the Hongkong Club and play there for a short time without its being discovered at once that he was not introduced by a member,

The General Managers have now to submit to the shareholders their report on the seventh year's working of this Company, ended 30th June, 1890 After paying all running expenses, Committee and Auditors' fees, there remains a net profit of $314 547.64, and in accordance with the Articles of Association, it is proposed, with the consent of the shareholders, to approp:late this amount as follows:-
To place the amount of $66,838.08 to Reserve Fund, being the equivalent of 8 per cent on the values of the steamers, wharf, moorings &c. on the 30th June Is, and to pay a dividend of 41 per cent, on the capital of the Company, absorb ing a further sum of $11,000.00, and leaving a balance of $1,779 $6 to he carried forward.
It will be observed that the profit resulting from the working of the Company's steamers amounts to $73 858 95 only,, which is certainly som-what disappointing, and which must be entirely attributed to the general diminution in the volume of the const trade during a full half of the working year, the only satisfactory feature being that, in the opinion of the General Managers, the Company's stramers have steadily continued as offered, Morenver, for the first few months to secure their full share of such carrying business
of the year, the high price of coal was a some- what serious tax, and a more or less fitful opposition on the Tamsui line has to some extent reduced the steamers' evrnings in that quarter.
As stated in previous reports, it was the intention to transfer direct to the Reserve Fund the amounis ceruing from sale of, the 1,144 shares originally unallotted, ead from the closing of the Oriental Bank Corporation Sus- pense Account. It appears, however, that this course, can hardly be followed under the strict letter of the Anticles of Association, and these sums have accordingly been included in Profit and Los account as shewn,
Herman Boner, clerk in the employ of Messrs. Binckhend & Co., said he first had notice of the fire at a quarter past eight on the night of the gth instant. He went in there to make a hole in the floor for the purpose of throwing water oz the casks of burning oil below. By the time he got that done the fire-brigade arrived. As soon as the door was opened flames burst forth accompanied by dense volumes of smoke. The fire rapidly spread throughout the basement, first, and, second foors. It was checked and finally extinguished by the efforts of the firemen. The store and contents were insured up to about $100,000. The oil casks which he saw burning when he first looked into the godown through the basement window were about 20 feet from the window.
Wang Fuk, a night watchman at Messze. Melchers & Co.'s, said that at 7.50 pm. number of men were carrying a lot of cargo into Messrs. Russell's godowns next door. SUNDAY LABOUR AT THE DOCKS. TO THE EDITOX or the "Hongkong TetroraTE.”
SIR-In your report of the meeting of the British Mercantile Marine Officers' Association, given in your issue of the 8th lust, there appears the following statement, made by the President, Capt. Ashton, in his speech on Sunday labour in the harbour. After expressing his opinions
that Sunday labour should be paid for, he says
"It is my firm opinion that you have a right to do this, because you'll only be asking for that which men somewhat similarly situated as your- selves already have conceded to them. I refer to Europeans in this port who are engaged in directing Chinese workmen, and in this connec- tion I specially refer to foremen in the Hongkong and Whampoa Dock Company. These men, sch as engineers, shipwrights, moulders, and boller makers, are indeed well educated. They are "picked men from home, experts at their profession, who came out here on fixed liberal salaries and are granted double pay for Sunday, and all overtime work in asking for extra pay for unnecessary labour on Sunday. I know a good many of these Dock employées, and have asked them for their opinion on this very question, and they all assured me that they would rather forego the extra pay than work on Sunday,"

Now, Sir, as I am personally acquainted with the majority of the said foremen, I am in a post- above statement. None of the Dock Company's European foremen are paid either for their over time or for Sunday labour, both of which are carried on to a great extent at all of the Dock Co.'s establishments. I cannot understand Captain Ashton's statement as to the expression of opinion he received from the foremen he Interviewed, (although I know they are anxious to have the Sunday rest) that they would rather forego extra pay than extra work on Sundays, seeing that they do not receive extra pay. It would be satisfactory to know who so grossly misrepresented the true state of affairs to Captain Ashton.
Judging by the amount of overtime and Sun- day work done at the Dock Co.'s establishments, I think that the majority of the European fore men would have been able to go home with the proverbial pile that one is supposed to accumn- late while in the Far East, if they had had over time and Sunday pay.

The railway embankment between Hanku and Lu-tai had been sufficiently repaired to admit of traffic being resumed on the 5th instant, after an interruption of over five weeks. Great credit is due to all concerned for the expedition with which this work has been done. The repairs on the Lutal section were effected thy materials brought along the line from the bill-side af Tongshan, while the Hanks end of the breach was filled in from mud brought from Tongku where a small patch of dry ground was at the disposal of the railway. The latter portion of the embankment is, of cause, much the less solid of the two, and it will require time and probably a good deal of additional earth to make that part of the line as good as it was before its destruction. It is a great matter to have got the traffic reopened; as, railway communication is doubly important at a time when the ordinary roads are inundated... ma olen qui
