CLAIM AGAINST A CONTRACTOR. The Lords of the Admiralty qued Tam Kit, contractor, for $zoo, due under a contract.-Mr. H. Gedge represented the plaintiffs, and Mr. Wilkinson defended.
Mr. Gedge said that the claim was made under an agreement dated the 20th June, 1889, between the defendant and the Lords of the Admiralty, for the rebuilding of a retaining wall near the Naval Hospital. Negotiations had been made with him, among other lot holders, for the pay- ment of a portion of the cast, and he afterwards failed to carry out what he then agreed to. The defence, he believed, was that the wall was not continued along the southern boundary, as agreed, but the plaintiffs denied that that was promised.
Mr. Master, solicitor, said that in June, 1889, he was instructed by the Admiralty to negotiate with the holders of Inland Lots 658, 659, and 660, and settle with them about contributing towards the re-erection of a wail that had fallen down. Lot 66o was the defendant's. It wa
greed that they should pay a proportionate amount, the total cost being £300. Defendant's proportion was $200. The wall was rebuilt, but be refused to pay, as the new wall was not extended along the whole of the southern boundary of the lot:
Major Barker, RE, said, that the wall had been bullt in accordance with the plan in respect to which the agreement was made. There was no danger of a fall on the delendant's lot, because the wall did not run along its whole length. There was only a gap of five feet, where a wall was unnecessary. The total cost of the wall was 818, the expenditure on defendant's portion being £176.
Mr. Wilkinson said the defence was that the agreement was for the money to be paid "when the wall was completed."

Daily 1.50 News of the 23rd instant, when it is known that there are at the present time some 1,800 unburied corpses, many of them those of victims of cholers, stacked at the Ningpo joss-house, between the French Concession and the City wall. Whatever précautions may be taken, there must always be some drainage from these coffins which, sooner or later, finds its way into the river. We do not know if the French Municipal Council la making any efforts to abate this continuing danger to the native as well as the foreign community. JOURNALISM In Japan is not all joy. Mr. Arthur Turner, architect and surveyor, stated that he had examined the retaining wall in question, and be considered the wall suffi- ciently strong to withstand a landslip, but if a slide occurred above the six feet, earth would fall on to the property, and he, considered that the wall should have been extended to the end.

His lordship said he considered that the work had not been fully carried out, as it was clear that the whole of defendant's property was not protected by the retaining wall, and that until the remaining six feet was filled in they could not expect to recover the $205.
