The Attorney-General (Sir Richard Webster) as head of the English Bar bas just approved of cert in rules proposed by the Council of the Incorporated Law Society governing the practice These of giving retaining fees to counsel. provide that a general retainer shall apply, unters' otherwise expressed, all tribunals, including the House of Lords and the Privy Council, but not Parliamentary Committees of either House, and shall entitle the party giving it to notice from the counsel to whom it is given in the event of the latter being effered a special retainer, or a brief by the opposite party, Subject to this, a general retainer lasts for the joint lives of client and counsel. A counsel who holds a general retainer, after a reasonable notice, may accept a special retainer or brief from the other party, unless a special retainer or brief be given by the party who gave the general retainer. A general retainer is farfeited when the counsel holding it does not get a brief in any proceeding in which the client is not concerned, and to which it applies; but it does not entitle: a Queen's Counsel to a brief in a case in which it is usual to instruct junior rounsel only. "When a general retainer is given for one person, and be sues or is sued with others, and appears separately, the retainer in that particular action; but if he appears jointly with others, the retainer does not apply, and remains unaffected. A special retainer cannot be given until after the commencement of an action it gives the client, a right to the services of the counsel during the whole progress of the action. retained counsel is entitled to a brief on every occasion in which the case is brought be fore the Court. except where it is usual to Instruct one Junior counsel only. A special retainer on circuit must be given for a particular assize, and holds good if the venue is changed to another place on the same circuit. If the action is not tried at the assize for which the retainer is given, the retainer must be renewed for every subsequent assize until, the action is disposed of, unless a brief has been delivered. A retainer may be given for a future assite, without a retainer for an intervening one, unless notice of trial shall have been given for such intervening assize. Counsel in the original action cannot accept a retainer or brief on appeal from the opposite party without affording the client In such original action the opportunity of giving such retainer. Where counsel has advised or drawn pleadings, in contemplation. or during the progress of action or suit,

a retaiber cannot be accepted from, or pleadings drawn for, or advice given to the opponent, without notice to the first client. The retainer does not cease upon conntel being promoted to a higher rank at the Bar. The fees for general retainers are:-In Parliament ten guineas; in all other cases, five gulpean. The fees given for special retainers are:-In Parlia ment, five guineas; in the House of Lords and the Privy Council, two guineas; in all other cases, one guinea. Hitherto, it should be added, the rule has been to give retainers for each Court, and it will now be impossible for a counsel who has argued a case below to accept a retainer for the opposite side on appeal, without giving the former client an, opportunity of securing his services.
