That action was tried, and the question between the parties was apparently confined to whether the transaction, terminated on the 31st August, or whether it should be carried over to three or four days afterwards, when the shares had fallen several points. It was a ques. tion of some $1 or $4 per share, and, the issue was as to what extent. Brandt was liable. He alleged that there was an ander standing that the shares should be held over, which was denied, and the decision was, as you know, that Brandt recovered the balance of the money, calculated from the settling day. We have no business with that decision beyond what bearing it has on the article which immediately follows.
THE LEADER.
Now follows the article. Though it is perhaps dangerous to foretell the verdict of a jury, I may express my own opinion. It is that the article does contain a direct personal attack on the character of Mr. Brandt, and that this case (the Brandi-Grimble case) considered by itself, does not appear any excuse or justification for the attack. As far as his information is concerned itmust bave been a "gan.b'ing" case, as he called it-there is plenty of gambling on the Stock Exchange; and if the writer's object had been to run down this transaction he might have been entitled to a great deal of sympathy. As far as he was concerned it might have been a gambling transaction-a "time""contract is always a gambling transaction, and although there had Been a re-sale to a man named Benjamin, It does not appear that the prosecutor was aware of it. Then comes what appears to me to be the sting of this article. It is that it was quite evident that when Brandt brought these shares he had not the remotest chance in the world of taking delivery unless the quota. tions went up. It may be that speculation of this kind is rife, and if so it would be a very good thing that it should be run down, but I put it to you if you can say that he could not by any possibility pay if the prices fell. I need not trouble you further with the remarks about the social effect of the attack which would make the article provoking; Beandt is accused of betting when he could not passibly pay, taking his chance of winning "Heads I win, tails you lose," as the article says. The man who does that may be fairly called a welsher, not fit to consort with honest inen

He wrote it on the spur of the moment, and set off at once to show it to his friends. The evidence as to publication, however, chiefly points to the fact that what he did was exactly in accordance with what he says was his intention. Mrs. Fraser. Smith was the mere recipient of the letter, and as far as the question of malice goes you have to consider the rest of the evidence. If you think his object was not a malicious one of course it will assist his case. If you think it was not a malicious publication, but done in self- protection, and that the mode was not mail. cious, you must find a verdict of Not Guilty, Now as to the plea of justification.
