That action was therefore brought to recover the $475 improperly received. It would be for his lordship to say whether or not Brandt knew at the time that he was being paid twice. Plain tiff's case was that he did know it. With regard to the other $100 claimed, that was quite a dis- tinct matter. It arose out of a contract made the plaintiff's agency between through shares. The contract was admitted, but defen- Brandt and Ho Tim, in respect to 100 Sugar dant said that it was not carried out, because Ho Tim had not taken delivery of the shares. But it would be shewn that an arrangement had been come to by the parties, by which Ho Tim was to pay a certain sum, and brokerage was therefore due.
His lordship-In the way you are stating it. I have already settled that point two or three limes.

Achmet Ramjam. the plaintiff, was then called. He said-On the 20th July I bought 75 Sugar shares from the defendant, for Decem ber, at $288. Fakeera was the broker. On the 18th July. I bought 35 more shares, for December, through Samuel and Reuben. Next day I bought as more, through Fukeers, at $298, for October, the contract being for so shares, half only being for me. On the 9th September, when I was liable for 125 shares, I told Brand: could not take them up, and arranged to pay him $1,900, in suttlement of my account, $200 was to be paid on the 20th of that month, $1200 on the 30th, $400 on the 31st October, and $100, on the 30th November. I sold three houses to him, on Inland Lot 760, for $6400. They were mortgaged for $450, and the balance was $190s, I had given him four promissory notes for the debt, and get them back when I executed the transfers Fleld me nothing when made the arrangement in pay him this $1900. I told Fukcera afterwards that I had settled for the 25 shares which he had bought for October, and he said "Oh; I've done so." We then went to look for Brandt, and found him near the Hong kong Hotel. Cross-examined-1 did not buy any other will swear that I did not buy twenty-five other shares, I signed the contract notes for the first two lots, but not the third, because Fukeers was buying so shares, and I only wanted 25. He did not ask me to sign.. I do not remember whether I asked him to sign or not. He did not tell me he was going to buy fifty. The shares were going down considerably in September, and Brandt was playing the game of "heads I win, tails you lose." I do not play that game. I might not have stood to lose a lot of mancy if I had taken up the shares. The rates nt due date were certainly very much lower than when I bought. I had spoken to Fukeera after he made his arrangement with Brandt, and before I made mine. He might or might not have told me of the arrangement.

Cross-examined-i am a merchant, but also speculate in shares. I do not call myself a share speculator though. I make share con- tracts, but not very frequently, The number the market; I might make a hundred, if the market suited me. I keep books in depends my business as a merchant, but in my share business I only have a memo book. I have got it here. I only use it irregularly, for my own satisfaction; it is not much use, as many of the shares are never delivered. I do not owe the plaintiff any money, nor have I ever done so. I never received A leiter from him on the 19th November, pressing me for the $475 and $50 brokerage, and asking me not to put him off again. I swear it, most dis- tinctly. I was not hard up at the time; as matter of fact I had a good deal of money in the Bank.
Mr. Hastings-Then why did you neglect to take up a hundred Punfoms which you had bought?
Brandt-That has been a matter of judicial proceedings. You ought to know something: about it, for you acted in the matter.. I disputed it on perfectly good reasons, and got leave to defend,
Mr. Hastings-Did you win the case ? " Brandt-1 settled it privately afterwards, Mr. Hastings-You paid the difference, think?
Brandt-I settled it.
At this point the case was adjourned until to-morrow.

His appearance put a stop to the trouble, and like a good Samaritan he led away, in a fainting condition, one of the lady spectators. Training for the forthcoming races is going on space. There are several very promising ponies amongst the subscription griffins this year, so it is hoped and expected that we shall have some exciting races. I can't say much for the form exhibited by some of the new "jacka,” especially "the Baby," who causes a lot of amusement occasionally, by not being able to control his mount. Poor little fellow; his hands get cut very badly by the reins, but no doubt they will get harder as he grows older.
There is a rumour current that the old está blished Hauensteins Hotel is about to change hands, and will in future be managed by a British Captain and his wife under the name of the Family Hotel" It is to hoped they will succeed in their new ventare.
I believe that two fashionable weddings will shortly take place in Koolangsu, but as the cards are not yet out, I am unable to publish names.
