The Consul-Were you on board the Inunch at Wai Hat -No, I was on board the Kwan Tin.
The Commissioner-Where did you make out this list -Where the boat was anchored off Shamien.
Cross-examined by Mr. Pitman-You saw the passengers on board. Did you see them pay their passage money to any one ?-No.
Do you know whether they paid any passage money or not?-When I took their names 1 asked them how much passage money they were going to pay and they said they didn't know, that the steam Inunch was detained by the
Chinese Government.
Were these passengers detained on board until the Customs had taken the list ?
The Commissioner-1 think that is an unke- cessary question.
Mr. Pitman-I want to know to whom they paid their passage money. Perhaps · Captain Reid received it.
The Commissioner-Captain Reid can be recalled if you wish.
The Consul-The witness says they did not pay the passage money. They said they were going to pay but did not know how much. To witness) Were they allowed to go on shore after the list was made 7-Yes,

The Commissioner said the letter was quite irrelevant to the matter before them.
The Consul thought it was hardly admissible as evidence.
Mr. Pitman--My vessels have been chartered continually and the Stephen Thompson was so chartered for the present trip. She was paid $40 for the round trip for conveying soure students to pass their examination. This, was within treaty limits, and never nilow the launches to go outside the radius except for relief purposes.
The Commissioner-Can you produce evidence of your vessel having been chartered?
M.Spinney That is all the evidence we wish to bring for the prosecution. We simply wish to show that the vessel went into inland waters, to places not open by treaty. We have proved that she took passengers to the number of one hundred, and that at least zo left the ship to go to Kong Moon and other places. With regard Mr. Pitman-1. am prepared to state it on to the evidence as to the 24 passengers who oath, and I have my hay's book showing the came on board on the 16th November, it is sim-receipt of the money. With regard to the carry. ply to show that she was a recognized trading ing of passengers, these men were allowed to go vessel, going between these places. At lx on board by the Customs huthorities while they o'clock these boats came alongside with the had charge of her and they now charge me with passengers and their baggage. Of course the an offence of which they are guilty, if anyone is fact that the launch had been seized by the guilty. They were in possession of my vessel Customs was not known to them. Probably if and took these inen on board. I can swear no It had been known they would not have come passage money was received by me. Launches alongside. Generals Vannovski and Tehergvin, who were in the saloon carriage with the imperial family, received contusions.
The Czar and Czarina remained at the scene some time, giving attention, to the injured, Towards evening they returned to Zosowoje, the last station they left.
Religious services have been held throughout the empire, giving thanks for the escape of the imperial family.
The Grashdanin contradicts the official report of the accident in regard to the casualties. It affirms that twenty persons were killed, including Captain Bresch, a staff courier, three couriers and eight soldiers of the railway battalion. It also says eighteen others were injured.
The imperial family passed over the Chackoff arul Nicolaiff Railway last evening on the way to Gatchina. All were well.
The official report says the mishap is beyond question due to designs upon the Emperor's lite.

Mr. Pitaan said- I am charged, your Honour, with violating Article 47 of the British Treaty of 1858, inasmuch as the Stephen Thompson was found anchored at Wai Hai on the 16th inst, and was seized by the Customs for unlaw- fally resariing to that port, which is not open by the Trenty. I claim in the first instance that this port of Wai Hai is altogether beyond the jurisdiction of the Imperial Maritime Customs, and that the launch was not seized by order of H.E. the Vroy or even by the high Tantai, but merely by order of Commissioner Clayson of the Kowloon Customs. I claim, secondly, that my launch was within the too radius of this Treaty port as laid down in Article 9 of the Treaty of Tientsin, and in support of that I pro- duce an Admiralty.chatt on which I have drawn a radius from the Canton. Customs to the 100 limit, and I will prove that Wai Hai is within that radius. I claim, thirdly, that I was not trading within the meaning of Article 47, of which the proper translation, according to the Chinese text, is "British merchant ships only have the right to trade at ports open under this treaty. If they clandestinely trade at other places on the const they will be confiscated with their cargoes." Fourthly, I claim that for some years past my lunches have been engaged in similar work and that during that time they have carried and have been chartered by various high provincial officers, and have been allowed to go without let or hindrance by the Imperial Maritime Customs. I produce the card of who chartered the Namboi Magistrate, the launch only a few months ago. He had her for over a week, and on her return sent his card and specially thanked me. He chartered the launch to accompany the Viceroy up the West River and to various inland waters of this province. Fifthly, I claim that native and foreign owned launches have been allowed to run in inland waters without let or hindrance, and with the full cognizance of the Customs. Not only this, but the Imperial Maritime Custom
and now without any warning, without any com- plaint, my launch is pounced down upon--not by the Commissioner here but by the Commis- stoner in Hongkong, who sends a launch into inland waters. By virtue of my agreement with the Chinese Government I am quite as much entitled to be where I was as the revenue cruiser. I have commissions to show in support of my position, and the Customs have, not attempted to show that I was engaged in any illegitimate trade. Moreover, the Customs authorities license laurches now to run from Hongkong to Wei Yuen and other ports on the Cantón sier without let or hindrance, and I cannot see, Sir, why my launch should he singled out and myself put to all this worry and expense.
The Consul-Does that conclude your defence? Mr. Pitman-Yes, Sir.
