Mr. Cook, superintendent of the Docks, detailed the repairs done to the ship. Captain Phillips gave instructions for their execution Whilst discovered that the framework of the ship was they were going on, under the first tender, it was ratten, and a second tender was made, the total estimale being $7249. The captain accepted this estimate, and ordered the repairs.
His lordship granted a decree to the Company on that evidence, and referred the cases for investigation by the Registrar, to decide the question of priority between the two plaintiffs—. the Company and the captain.
