ORIGINAL JURISDICTION.

The following judgment was delivered this morning by His Lordship, Chief Justice Sir George Phillippo, Zar-Sands and another, W. H.

Forbes.

This cause cante on before me for hearing on further consideration on the Registrar's Certificate as to the present state of the suit.

It appears from, the certificate that all the questions in the suit, as far as the defendant is concerned, are settled with the exception of the realization of certain property in Macao and which is in process of realization. When that matter is settled, and the accounts passed, Mr. Forbes will, so far as this Court is concerned, have no further interest in the suit.

The question of costs, as far as Mr. Forbes is concerned, seems to have been hiready disposed of, and the only costs outstanding are the costs incurred by

him since March last. There has been no reasonaligeed why Mr. Forbes should not be paid these costs out of the fund in Court. be twg Trust funds outstanding, of which the By the Registrar's certificate there appears to Testator in this suit was Trusice. Mr. Francie, as counell for the defendant, called my attention to the fact of furniture valued at 3,670 which was directed by the will of the Testator to be sold being still unsold and in the passession of Mrs. Sands. He also called my attention to the great desirability in the interests of those entitled in remainder to an account being taken as to what portion of the money- paid into court consisted of capital, and as to the amounts paid to Mes. Sands from time to time as interest. He also desired an enquiry as to what amount (if any) of the costs incurred in this suit thould be charged to income and what to capital..

The owners of the Douglas and the Hailong are certainly entitled to be refunded these amounts, and the question for my decision is as to how much more ought to be awarded to cac of these vessels for their exertions.

The Douglas was, as compared with the Hailong, a powerful steamer. She was inter- rupted on her voyage to Foochow, and remained for nine days assisting the Yorkshire.

Her Master took some responsibility on him- self in so doing. He gave valuable advice and assistance to the Yorkshire and in so doing ex- posed his vessel, in my opinion, to risks that I do not think would have been incurred by any prudent man without some adequate object in view such as saving valuable property:
