that the old practice had not prevailed here. He from Chitty in reference to the distinction feen felony and misteiseanor.) The Chief stice remarked that the defendant had plearied justification.—Mr. MacKean referred to ordinance 3 of 1865, according to the schedule attached to which notice of trial was served before the plea was put in, and contended that that did away with the old practice, in which defendant pleaded and took his trial afterwards, the Court, no doubt, leaning to the site of mercy as to whether de- fendant had good grounds for delaying or putting off the trial-'The Chief Justice remarked that nothing Mr. MacKean had said had removed his doubts at all. The Act of Parliament did not do away with the defendant's right to traverse to next Sessions, and until 14 'and 15 Victoria was introduced here his right to traverse still r mained.--Mr. MacKean said that if his Lordship was against him on the paint-when the Chief Justice remarked that he did not think it was the intention of the legislature to introduce any alteration.--Mr. Mackcan said that if defendant wished to waive his right to traverse, things could be dealt with more easily. Mr. Fraser Sunith said he was very anxions for the business to be over, but he only wished to go to trial when it was perfectly safe for him to do so. He claimed his right to traverse, anîl declined to make any con- cession. Mr. Mackean remarked sarcastically that defendant's claiming his right proved his ans xiety to get tried as rapidly as possible. The learned Counsel then reverted to the practice here, an said there had been only one exception-The Chief Justice remarked that the right to plead aver had not been claimed before, and that when the Colony was founded, the defendant had the right to traverse in misdemeanour, a privilege which had not been taken away, Mr. MacKean said he would argue that defew dant had intimation of the charge against him on the 17th, and had hat sufficient time.---M Fraser-Smith said he did not receive the informa; tion until the 225), --Mr. MacKean observed that even so there was plenty of time. tine of defead ant's witnesses was in Shanghai, and he thought. Mr. Fraser-Smiths would have assisted in hasten ing the trial. Mr. Bandhana, as long as the trial was postponed, was labouring under a vile, slanderous libel. He would say on his behalf that he did not desire prejudice to the defendant, but he insisted that no delay took place as he had been attacked under peculiar circumstances while passing through here.-The Chief Justice reminded Mr. MacKean that be had given Mr. Bandmann every facility in holding a Special Sessions, and asked him if he had any other motion to make.-Mr. MacKean said he had a summons, which perhaps it would be better to hear privately in Chambers.-The Chief Justice said yes, if Mr. Fraser-Smith thought so.-Mr. Fraser-Smith said he did not want anything
· heard privately.Ma. Mackean said he had taken out a summoas, now turned into motion, with a view of paving the way, if ssible, to the action he should take in this case,--demarring to defendant's ples and justification. The original sunnions was to the following effect:--

The Chief Justice remarked that the plea was prejudicial in his own defence. Mr. Fraser Smith said then he should amend his pleas.-The Chief Justice said it would be better, and advised him to put them into a general form instead of tying himself down to particular circumstances and laying himself open to conviction on points
