DE GRACA 7. PITMAN. This case was brought before the Court yesterday on the petition of de- fondant, to allow plaintiff to show cause why a verdict should not, on the weight of evidence adduced at the recent trial, be recorded in favor of defendant, or a new trial be granted. Mr. T. C. Hayllar, Q.C., and Mr. E. McKean, instructed by Messrs. Sharp. Toller, and Johnson, re- presented the plaintiff; and Mr. Francis, instructed by Messrs. Stephens and Holines, appeared for the defendant.
Mr. Huyllar said he was there to show cause why the verdict obtained by the plaintiff should not be set aside, ni instead thereof a verdict eutered for the defendant, or, why there should not be a new trial. The petition which had been presented set forth that the choque was improperly stamped and- had never become a negotiable instra- ment, and that any authority ever given had been expressly revoked, und that by the revocation of that authority the cheque bad never become payablo; and that the verdict of the jury was given against the weight of evidence and was perverse and contrary to the recommendation of the Judge. The learned counsel, explained that Mr. Pitman in this transaction was the agent of a band of Chinese adventarers, as his stopping the cheque proved that he thought them pecuniarily worthless. He contended Mr. Pitman and Wong Wo, occupied the position of loader. and borrower, and, after the cheqno had been given Mr. Pitman had no control over it. The petition presented by Wong Wo to the Macao Govern- mont destroyed any foundation to the story that the defence had got up, that the Macao Government had

Assuming that the cheque had been a perfect instrument and had not been presented till after the sale had booo rescinded, as it had occurred in this case, then Mr. Pitman would not have been liablo to pay this money. Mr. Pitman, although cognizant of Wong Wo's petition being presented, did not imagine that the deposit re- ferred to was his $10,000, bat_that it reforrad, to Wong Wo's promissory note. The Government of Macao bad no other reason for withholding the presentation than that they knew that Wong Wo had not provided the money to Mr. Pitman and this explained Mr. Pitman's action in not mentioning that the cheque was stopped. Mr. Pitman had sigued the cheque under one set of conditions and the Governor the next day bad altered and violated these conditions; and any further connection that he might have had in the business was only at the solicitation of the Go. vernor, of Macao. Mr. Pitman was not responsible for Wong Wo's want of money, and the only question was really, how far was Mr. Pitman liable by giving this cheque, It was only given to Wong Wo on con- dition that the money would be paid ap, and this not having been complied with relieved Mr. Pitman of all respon. sibility. There was a complete failure of consideration between Wong Wo and the Governor of Macao, avon if the cheque had been a good one. An exceptionally complex case, which has been engaging the atton- tion of the Birmingham Bankruptoy Court for several months past, has just been farther complicated by the inar- riage of the bankrupt, a widow, under somewhat romantio circumstances While giving that constant attendance at the Court, which her entangled affairs necessitated, the lady, who is just over thirty years of age, and who had carried on the business of her husband as a butcher, made the ac- quaintance of a painter and decorator in Court. The friendship ripened fast, and day after day the wilow war es, oorted to the Court and to her legs! adviser's by her devoted attendant, much to the amusement of the Court days since having bestowed her had officials. The fair bankrapt a few upon him, an application will be made to the Judge to make him a party to no means improbable that the husband will be rewarded for his daring by re ceiving a considerable surplus from the bankrupt's estate, which at one time showed at least 40a in the pound.
