The Oscar Vidal Gase.. FINDING OF THE COURT.

At a Naval Court assembled at Her Britannic Majesty's Consulate at Shanghai on the 14th and 15th July, 1881, W. R. Carles, Esq., II. B. M.'s Acting Vice-Consul, President; Lien- tenant J. C. Roughton, R.N., H.B.M.S. Lapwing, and Mr. J. T. Bragg, Master of the British steamship Antenor, . Members.

The Court, pursuant to an order. from Commander W. G. Scott, R.N. of H.B.M.S. Lapsing, Senior Naval officer at Shanghai, has enquired into the conduct of the Master of the British barque Oscar Vidal, in taking that vessel to sea on the 7th instant in at unsen: worthy condition, and without obtain- ing the ship's papers, a. Consular Clearance, or shipping his crew at the Consulate.

The Court finds that Johan Ro- bort Theodore Richter has committed an offence against Section CLX, of the Shipping Act, of 1854, in carrying John Barry and other seamon to sea in the British barque Oscar Vidal ou the 8th July, without having conform- ed to the rules laid down in the sec- tion above-mentioned for the engage- ment of seainen.

2.That the defence raised, viz.: that the barque Oscar Vidal is no longer a British ship, is not justified by the evidence.

3.-That the Oscar Vidal requiros very extensive repairs before proceed- ing to soa.

The judgment of the Court therefore, is that Johann Robert Theodore Richt- or be fined twenty pounds (£20), and pay all costs and expenses of the pro- ceedings, viz., Tacls 307.00, together with the costs of this Court, within three days, and that in default of such payment being made within the term perscribed, paymont be enforced under the Merchant Shipping Act of 1854, Section 523.
