From June 1951 the British representative has continued to vote in favour of postponement of discussion of the question, even when, on conclusion of the Korean war, the argument that China was participating in aggression against United Nations forces no longer held good. Mr. Luard well brings out, though unfortunately he does not try to explain, the expediency which guided western policies; how one argument was produced after another when the old ones went out of date; how the British government allowed itself to be swayed in this matter by the wishes of the Americans. He does not go into the intricacies of American internal politics, which are at the root of this matter—obviously he could not in a book about Britain and China—but without some understanding of them, Britain's behaviour, somewhat unfairly, seems feeble and misguided. Britain could have done more than she has to influence American public opinion, but to have brought China into the UN against the wishes of numerous Americans would only have devalued the institution in their eyes, and might even have resulted in earlier days in an American withdrawal of funds (upon which the U.N. is very dependent) or even, disastrously, of membership. Such a criticism does not affect the discussion of Hong Kong, which is a matter purely for the British and the Chinese. As in the rest of the book, the historical background is only sketched in; the interest is all concentrated on wartime and post-war developments. Hong Kong is unique among British colonies in that since the war it has made no progress towards independence; having narrowly escaped being "liberated" by Kuomintang armies at the end of the war, the prospect of a more democratic constitution was shelved when the Communists overran neighbouring Kwangtung. As Mr. Luard points out, the constitution of the Colony remains, in all essentials, exactly what it was in 1843. And this is where the British government's devotion to commercial interests in its relations with China again becomes apparent. Now that Hong Kong has found a new lease of economic life in manufacturing, neither the British nor the Hong Kong government are prepared to do anything which may upset the present favourable climate for investors. MR. KRONE The true market-places, called "Hue", however, are built separately from the villages. They are generally built in a rectangular square, and two or four strong gates are thrown open during the Hu-ke, to admit visitors. These market-places are visited every third or fifth day by hundreds and sometimes thousands of people, who assemble from the whole neighbourhood, and frequently from great distances, for the purposes of barter or of general trade in the products and manufactures of their respective villages. Those who frequent these markets are usually joined in league for mutual protection against robbers. These places are sometimes quite uninhabited; some are occupied by shops whose owners seldom have their families living with them; a few have permanent sheds erected over the ground where the goods are exposed for sale. From the foregoing, it may be understood how troubled and insecure the normal condition of this district is, and for a very long period has been. Not only are robbers and pirates to be feared, but internecine wars are almost always raging between some or other of the villages; and these wars, though often arising from trivial causes, are not mere temporary quarrels, but are often long-continued and sanguinary. In consequence of this state of affairs, fortified places called “Wai”, have sprung up throughout the district. These are of different forms, but are generally built in the form of a square; their walls are strong and lofty, sometimes turreted, and are often surrounded by broad and deep moats. Frequently a single strong iron gate is the only means of access to them; when danger is anticipated, the women, children, and treasures of the neighbouring village or villages, are concealed in the Wai, which is garrisoned also by some of the older and younger men, so that the able-bodied are enabled to take the field in defence of their property, having the Wai to retreat to in case of danger. I have met with about forty of these Wai throughout the district, and they are calculated to afford excellent protection against the large bands of robbers, which frequently pass to and fro through the country, pillaging the villages and parties of travellers. These forts were generally erected in those times of disturbance and insurrection, which have usually preceded the change of a dynasty. The most important of the charitable establishments are those ancient institutions, the "Kuk-tsong"-Imperial granaries; but these, like the rest, are much abused. In these, rice is stored up against times of famine, when they are opened, and their stock distributed to the needy. According to the “Sanon-che,” there should be two of these Imperial granaries in the provinces, - one at Sanon, containing 20,660 piculs of rice, and the other at Tai-pung, containing 1,700 piculs; but even this benevolent institution is made, by the avarice of the mandarins, more a burden to the people than a means of relieving their necessities. The small quantity which is stored up is generally consumed by vermin, and nothing is left for the indigent in times of scarcity. A small public Library exists at the residence of the district mandarin; the books it contains have been presented to the province by different emperors, and consist chiefly of Commentaries on the Classics, or Treatises on Ethics. They are intended for the instruction of the people; but as it would be inconvenient to allow the people in general free access to them, it is ordered that the mandarin should assemble the people on certain days, and read and explain the contents of these books to them. For the last twenty years, at any rate, no mandarin has, to my knowledge, attempted the performance of these duties; and as the collection is but poorly cared for, the worms alone derive any advantage from it. At Sanon there is a school for pupils intending to take a degree at Canton; one teacher of this school receives his salary from government. Essays are sent in and examined by the teachers, and those whose essays are the best, are admitted members of the college, and receive a small allowance of money for the purchase of oil and firewood as a stimulant to more zealous studies. These, being the most distinguished scholars, have more hope of obtaining a degree at the public examinations than the rest have. It is reckoned a distinction to receive this allowance, and many of its recipients are well off. Many persons are only connected with this institution by having sent in essays, and have never studied there. This, like all the other government establishments, is subject to many abuses, and the successful essays are often not written by their pretended authors, but by some literary character who thus... ================================================================================ RASHKB Journal 皇家亞洲學會香港分會學刊 | RAS-1972 https://digitalrepository.lib.hku.hk/catalog/gm80qf99h TRADITIONAL CHINESE REGIONAL ARCHITECTURE 143 One of these villages is Kat Hing Wai of the Tang family, "whose ancestors were among the earliest settlers... the largest tsu in the New Territories."23 The plan of the village is a square with the main gate facing west, which is probably because of the natural formations of the location which make this siting most auspicious. The village is surrounded by a moat and is further protected by four large watchtowers. Inside the walls, there are several rows of houses, all of which face west. There are no two doorways which face each other, and thus, even in this tightly knit and crowded space, privacy is given to each family. The houses themselves are built on the basic three-bay plan. Upon entering, there is a living room/dining room. In the middle, there is a small courtyard, completely private from those of other families, to the side of which is the kitchen. Finally, in the back, there is the bedroom. Hence, even within this tiny living space, the individual has afforded for himself a small courtyard from which to enjoy the open sky. The houses are made of brick cavity walls with tiled roofs.24 There is a small temple or assembly hall at the center of the eastern side directly opposite the front gate. The roof of the hall is elaborately topped by a curved gable, which is very different from the square towers on the corners. The ancestral hall is not within the confines of the village but is about five minutes away. The market, which is also usually part of a Chinese village, is a few minutes' walk away. These villages are now being affected by modern society. The younger people are moving outside the community to find jobs and a better standard of living. Although some walled villages have been renovated and now provide a healthier atmosphere in which to grow, the world abroad still remains more appealing. This village of Kat Hing Wai once had a population of six hundred people. Now it has fewer than two hundred.25 Hence, in the modern world, these well-protected and isolated villages are forced to open and expand in order to survive. Some villages are placed on the tourist circuit, and souvenir stands are set up outside the entrance. The watchful widows of the village make sure you pay HK$1 before snapping their picture. As one looks at the houses of China described in this brief survey, there emerges a general pattern. The Chinese man, rich or poor, strives for the same ideals. Whether hampered or helped by his economic conditions, or by the local topography and climate, he ================================================================================ RASHKB Journal 皇家亞洲學會香港分會學刊 | RAS-1974 https://digitalrepository.lib.hku.hk/catalog/x633mp077 2 day, five short papers were read on fish, fauna and flora of the sea-shore; insects; land vertebrates, and birds, and the talks were illustrated by an exhibition of both stuffed and live specimens. The field trips, held on the Sunday, were to Tai Tam Bay which supports fauna communities, some of them unique to Hong Kong Island, on its extensive sand and mud flats; and to the Mai Po Marshes, a wetland habitat dominated by deep ponds producing ducks, mullet and carp, and having a marginal zone of dwarf mangrove. This provides a unique eco-system of considerable scientific interest. Professor Lofts is currently engaged in editing the materials presented by his team for one of our symposia publications. The materials from our previous symposium, held the preceding year, should be ready for publication shortly. Our first local visit of the year was to the Sikh and Hindu temples in Happy Valley. This took place in April. Of the 10,000 Indians in Hong Kong, some 2,000 are Sikhs and the majority of the remainder, Hindus. The Hong Kong Khalsa Diwan, “Sacred Assembly”, as both the Sikh temple and its congregation are called, was founded in 1935 and the Hindu temple some time later. Led by Mr. Ian Watson of the Department of Philosophy, University of Hong Kong, a group of members first attended a Sikh service (Sikhism is a revisionist movement within Hinduism, founded at the close of the seventeenth century) and then visited the Hindu temple and its library. Our second excursion was to Cape D'Aguilar, named after Major General G. C. D'Aguilar, first general officer commanding the Hong Kong Garrison in the 1840s. A group of members visited Hok Tsui village, founded in the eighteenth century, and providing the older name for the Cape D'Aguilar area. They looked at old houses and the village's granite watch-tower, together with its temple to the god Pak T'ai, probably of the nineteenth century. In January, members visited the Lo Pan temple—Lo Pan is the god of carpenters and building constructors. The temple is situated in Kennedy Town, in an interesting old corner of Western District, still largely in its pre-war condition, and first built about 1884. The fourth and last local visit was to Tai Miu, Joss House Bay, one of the most historical sites of Hong Kong and well-known in Chinese historical and geographical works. We had four gardens. The quarter-master and the padre slept in the former's office, three doctors slept in the small room we used as the staff officers' mess, while I was again fortunate and had a tiny room, enough to take my bed directly behind the main hospital office, an arrangement which was very convenient for all concerned. We re-started our meteorological observations on 14 April in lovely weather and I see that we had a small putting course and a croquet lawn in action both laid out over pretty rough country. The generator was successfully repaired and we tried to get cement to make a secure base for the engine. We were employing ten workers temporarily on various jobs while another ten were regarded as on permanent duty so long as they remained suitable. It was encouraging to receive two patients suffering from malaria and peptic ulcer respectively from Sham Shui Po since it looked as though we were going to be used as the local hospital for the camps. By 24 April the kitchen even began to accept private dishes for cooking from patients and staff. This sounds very grand, but in fact the dishes consisted of saved-up rice flavoured in various ways according to the resources of the owners. We now had a total of 176 people in the hospital and there were many spontaneous expressions of pleasure at our vastly improved conditions. The general spirit in the hospital was excellent, though we still had one patient on the dangerously ill list. The building was suitable for our use, our numbers were reduced, we were eating better and though we had some pretty ill patients they were being cared for in airy wards into which poured plenty of sunshine. I think this in itself, contrasting so markedly with the dull and rather gloomy wards with their sad associations in Bowen Road had a stimulating effect upon us. The stairs leading from our part of the hospital to the Japanese quarters were blocked by wooden frames made by our carpenters on Japanese orders. The Hongkong News arriving very irregularly and we had to replace the white beds in the ward for the blind because they took up too much space. By 26 April we had one garden ready for planting and we had decided that bully chow fan was a waste of good corned beef and that this was better made into rissoles. We washed out and thoroughly oiled all our drains but we could not obtain putty to repair broken glass in our metal frame windows. We were allowed to use the church piano up to 7 p.m. daily but the Assembly Hall remain- ================================================================================ RASHKB Journal 皇家亞洲學會香港分會學刊 | RAS-1976 https://digitalrepository.lib.hku.hk/catalog/hq382988q NOTES AND QUERIES 279 either recognizing the Kaifong (assembly of neighbours) as that native municipal body, or even perhaps following the plan in Singapore of having one or two Chinese Gentlemen of standing as members of Council. The chief fault of the present system seems to be that no inconsiderable power is thrown into the hands of a few men without any corresponding responsibility to act as a check upon it." (Daily Press, May 14, 1873). Along with all the sharp criticism of the Editor of the China Mail in 1875, there was also a positive suggestion. An official Chinese advisory body of some seven or eight members should be nominated by Government and thus be more directly under its control. This advisory group would "act as go-between in the discussion of all measures affecting the native population". The editor envisioned its operation as consisting of attendance once or twice a week with the Registrar General to discuss matters affecting the Chinese community. If the advisory body felt that it was not satisfied with the decisions of the Registrar General it could then appeal directly to the Governor. The suggestion did not meet with popular support and it was not put into effect. When the District Watch Committee was reconstituted in 1891 under Stewart Lockhart, the Registrar General, a body came into existence which was very similar to the one proposed by the editor of the China Mail. (see Lethbridge, JHKBRAS, 1971). A Chinese appointment to the Legislative Council, although suggested as we have seen in 1873, was not made until 1880. In the meantime Tung Wah Hospital continued as an object of criticism by those who were fearful of its unofficial but real power within the Chinese community. The English press in Hong Kong had a fixation regarding the powers of the Tung Wah Committee. They seem to have projected their insecurity in a foreign environment upon that body which best provided self-identity for the Chinese community. The colonials were a handful in the midst of a surging, vital and ever growing Chinese population. For all their efforts to recreate the social and political structures of the homeland, Hong Kong was really Chinese. They had yet to discover and employ adequate ways of relating to this fact. There was a basic fear and mistrust of "the natives" who were of a different language, culture and race. The F.M.O. schools are not, however, mentioned in the report, nor have I seen any F.M.O. comments on these findings. 38 The report of the survey concludes that the plight of the poor boat-people is an indication of a more general social malaise, the devil-take-the-hindmost atmosphere of Hong Kong. They suggest that the Government should accept responsibility for re-settling the casualties of the mechanisation of the fishing industry from which the rest of the community has benefitted. In the long term, a better understanding of the Shui-sheung-yans' needs was required by the housing authority, who should plan in accordance with forecasts about the manpower needs of the fishing industry. The Department of Agriculture and Fisheries should extend the availability of its loans so that less initial capital is required of the borrower. New fishermen's villages could be built by the Housing Department, and the Labour Department and the Education Department should co-operate to increase the general levels of education and training in industrial skills. In the short term, the report urges immediate improvements in safety, rubbish collection, sanitation, and disinfection. Regular checks on boat safety should be made by the Marine Department. The Urban Council should provide study rooms for children, and the Education Department evening literacy classes and industrial training. 39 The report spurred a campaign which gained wider sympathy. In January 1979 a coach-load of boat-people were arrested on their way to take a petition to Government House. Children as young as seven years of age were finger-printed and charged with illegal assembly, although magistrates refused to proceed with the case against those under the age of 12. The adults, social workers, students, a Catholic missionary and Shui-sheung-yan, were found guilty, but discharged. After this incident, however, the groundswell of liberal support for the boat-people diversified into a general civil rights attack on the Public Order Ordinance itself. This has left the boat-people to fight their housing struggle by themselves, with the help of a few community workers linked to SoCO, such as Fr. Cunbo Franco, an Italian Roman Catholic priest actually living on a boat in the Yaumatei typhoon shelter. 40 ================================================================================ RASHKB Journal 皇家亞洲學會香港分會學刊 | RAS-1982 https://digitalrepository.lib.hku.hk/catalog/mk61z420p 102 W. ALLYN RICKETT Judicial Conference was held for the primary purpose of regulating local courts and local court-affiliated organizations such as neighbourhood mediation and factory-based comrade adjudication committees. By the end of 1953, the Chinese Communists announced that the period of reconstruction was coming to an end, the "New Democratic" phase of the revolution was complete, and it was time to start the building of socialism. In September 1954, a new constitution was promulgated which established a new government under a National People's Congress (NPC) and provided the basis for a judicial system, which in administering justice, was supposed to be independent, subject only to law. There was a standard list of rights for citizens including freedom of speech, freedom of assembly, and freedom of the press. Although this did not prevent a repressive campaign against intellectuals and the arrest of the writer Hu Feng in 1955, in general the 1954 Constitution set the stage for what was to be the most constructive period for legal development in China during the first 30 years of the People's Republic. Provision was made for a Ministry of Justice responsible for the general administration of justice and the training of judicial cadres, and for a procuratorate which was to review recommendations from public security offices concerning the arrest of suspected criminals, and which would also prosecute cases before the court. The procuratorate was also charged with ensuring that the activities of government complied with the law, and investigating and prosecuting serious crimes committed by state officials. Malfeasance involving officials was also investigated by a Ministry of Supervision, an organ which was later eliminated. However, the investigation of Party members was the prerogative of Party control commissions. "The Organic Law of the People's Courts," adopted by the NPC at the same time as the Constitution, spelled out in more detail some of the basic provisions of the Constitution, providing, for example, that in "adjudicating cases the people's courts shall apply the law equally to all citizens irrespective of their nationality, race, sex, occupation, social origin, religious belief, educational standard, property status, and length of residence." SMITH see what should be done toward erecting a permanent theatre". The year following, 1862, plans for a Theatre and Assembly Room were on view at the Hong Kong Club. They were estimated to cost $34,000, but a newspaper reporter was more realistic. In his opinion "a glance shows it would cost $60,000 at least". Something as ambitious as this had to wait some years. It was finally realized with the opening of the City Hall in 1869. In the meantime, mat sheds, a large room in St. Andrew's School and the Club Lusitano were used. A public meeting in 1864 resolved that the Amateur Theatrical Matshed should be kept and a committee appointed to see to its preservation. One happy feature was the debt-free state of the theatre following a successful season. During the 60s there were notices of the Queen's Theatre on Queen's Road East. It was probably the adapted godown mentioned in the columns of Jarrett in his series "Old Hongkong" in the South China Morning Post. A Theatre Royal was on military ground, used not only for performances by the Garrison but also by visiting professional dramatic companies. In 1865 it was announced it was to be pulled down "for much needed barrack improvements". After its demolition, the Garrison amateurs used the Murray Barracks Canteen. The general public expressed its appreciation to the military for permitting the theatre to occupy their ground. It had, however, been a hot, stuffy place, poorly ventilated. TYPES OF DRAMA All the early productions of the amateurs were described variously as farce, burlesque, comic drama, facetious tragedy, vaudeville comedy or burlesque extravaganza. Perhaps the first play of a mere serious tone was given in 1875, when "Plot and Passion" by Thomas Taylor and J. Lang was presented. It was noted, however, that a drawback to such a play was its love scenes, as these were difficult when played by males only companies. Here they attended the parish school. While Dr. Legge was going about England and Scotland telling about his work in China, the Rev. Mr. Hill, minister of the chapel at Huntley, superintended the general and religious education of the boys. As sometimes happens to young people who find themselves in an alien culture, they responded to the expectations and subtle pressures of their hosts and were baptised in October 1847. Their baptism created great interest in England and Scotland and was widely reported. The fact that the boys were baptised in the same church from which William Milne, the first Principal of the Anglo Chinese College, had gone forth to China, made their baptism seem particularly significant. A report of the event notes: “A deep hush pervaded the whole of the vast assembly, which the occasion had brought together. Hundreds of eyes glistened. Hundreds of hearts thrilled with emotions of love and praise." Not only did it raise the expectations and vision of England, but it also acted in a similar manner on the boys themselves. Dr. Legge states that "they were full of schemes for the benefit of their countrymen — thinking and talking of the various ways in which they can render the knowledge they have acquired available to others." Not long after their baptism, Dr. Legge took them on a trip through England preparatory to their return to Hongkong. The trip was intended to increase interest and support for the work in Hongkong. The boys made a triumphal tour down from Scotland, thronged Manchester, to London. Everywhere public meetings were held. Crowds thronged to see and hear the young men. With these living examples of the success of his school, Dr. Legge found it easy to raise funds to support a theological class to be opened in connection with his Hongkong school. Meeting followed meeting, excitement followed excitement, and climax followed climax. Given time the Chinese would realise its value. In seconding Mr. Chater's resolution, the Honourable A. J. Ackroyd looked into the future. In spite of the objections that the park would not be used much by the Chinese, he said: “I think it would be of great advantage to them, if not at the present, in the future, because there can be no doubt that in the future — at least I hope it will be so — the Chinese youth from the public schools will freely mix in our games and amusements.’ Mr. Ackroyd spoke about another objection that had been raised. A properly landscaped park would interfere with the viewing of the races. Indeed, he too “would disapprove of the valley being turned into a garden and shrubbery.” He envisaged a sports field, because "where there is so little level land in the Colony, we should utilise it to the best advantage. It could also be used advantageously by the military, for “the troops can occasionally assemble to go through their exercises and the crews of Her Majesty's vessels can be brought on shore and put through their drill.” Editorial comment on the park proposal was not entirely favourable. One editor made the point that the name Happy Valley was firmly linked to the oval where the horses ran, and it was doubtful whether the public would be weaned away from it. In the Feng Shen Yen I, mythical tales known to most Chinese, Yang Chien is described as the nephew of the Jade Emperor. Yang, also known as Erh Lang in some stories and in some temples, was a mythical general fighting for the legendary Shang (Yin) dynasty during the wars of the 12th century BC. Another popular romance of the Ming, the Journey to the West, better known as the story of Monkey, tells of the incident when a heavenly being was exiled to Earth for re-incarnation as a punishment for assaulting one of the Jade Emperor's daughters. By mistake he entered the womb of a sow and was born half-man and half-pig and is now best known as Piggy, one of Monkey's assistants. The Jade Emperor's festivals are celebrated on his birthday, the 8th and 9th of the first lunar month, and on the 6th of the eleventh lunar month, the anniversary of his ascension. In parts of Taiwan he is also feasted on the 24th of the sixth lunar month, and in South-East Asia on the 6th of the fourth, and fifth of the eighth lunar months. Though it is not a date on which humans especially revere the Jade Emperor, all the gods of Heaven assemble on the 19th of the first lunar month to pay their respects to him. He is offered a feast on his birthday which includes duck and chicken, but must include pork. These offerings are placed on a table in the open, before the front entrance to the courtyard, together with candles and the large-size sticks of incense. Two whole sugar canes with leaves intact are especially popular offerings in Fukien communities to celebrate the escape of Fukienese who hid amongst the fields of cane to avoid being killed by an enemy. The survivors offered such canes to the Jade Emperor in thanks and the custom has persisted. In general, routine offerings before the altar of the Jade Emperor consist of the standard three sticks of smouldering incense. However, offerings of a vegetarian feast are made to him in Hong Kong on the first day of the lunar new year, accompanied by the burning of spirit money. Not all families perform this ritual, many Hoklo and Hakka families prefer only to offer the basic vegetarian meal. The washermen are a regular set of scamps; one has to look very sharp after them. I had no end of clothes to wash on my arrival. I make my servant bring in his bill every morning. You would stare to see the amount I was supposed to eat the first day: Really it was enormous, and so for the first few days. If I send them to get anything I do not see all of it I am sure, or else pounds and ounces are very much smaller here than at home. But I find it is the general rule here; it seems to be regarded as a lawful perquisite. But when I can talk to them I will see all about it. I generally rise soon after six. At seven I go to the library and give a lesson in French to Hahn-shan, after which I make him work me up in Chinese. Breakfast at a quarter past eight, [and] prayers at a quarter to nine. School at nine, where I stop a short time and then leave the students to themselves, as I have no notion of working in holiday time. Study, etc., till one, then to dinner, after which I write, or study or get the masters or students and talk with them, till five, when I go to tea. At a quarter to six I go out for a walk, etc., till half past seven, then come in and read, etc., in library or parlour, prayers at eight, then walk in the grounds till bed time. When the pupils assemble I need only superintend the school from nine till one o'clock. Mr Beach has gone to Macao for a few days so I am all alone. He is really a capital fellow, and we agree famously. I treat him just like an old college friend and he ditto. He is very rough and blunt in his manner however, and I fancy he might be far more explicit in his explanations. But I think he is ashamed of the present state of the College, and knowing I am one of the trade, he fancies I have private opinions of my own as to the way it has been managed; and he is quite right if he does fancy so. He wishes to leave me to myself entirely, and to let me begin on Sept 1st by myself, if he is not gone up north before then. However I do not care. It also carried a full page group of six illustrations (based on photographs) of "Domestic Life in China."22 There are some paragraphs of narrative on most of these topics. 23 In articles early in their coverage, The Illustrated London News had already shown a degree of willingness to accept what it took to be the Chinese frame of reference, by humorously following the Chinese practice of referring to themselves as "Celestials" and everyone else as "Barbarians," as in the caption to the illustration, “A Crowd of Celestials Contemplating the Barbarians," mentioned above. The publication now began to indicate a desire to come closer to the Chinese people, making the point that an increased understanding of the Chinese people had been a by-product of the war itself: "Thanks to the enterprise of 'special artists' and 'our own correspondents'," present in China because of the hostilities, "much that was before obscure in Chinese manners and customs has been made plain." 124 The periodical compares Chinese and British habits in such a way as to stimulate bonding, and indicates interesting contrasts with no intention to repulse or ridicule. A typical comparison is that made between the preparation of Chinese New Year cakes and the making of Christmas pudding: "The Chinese, who have many points in common with the English, have the same attachment to a kind of round cake as we have to a round plum pudding. A few days before New Year, friends (women, of course) will assemble and help each other in preparing the ingredients to form this article of diet, as they do in England to prepare the plum pudding." Bryan Charles Fairfax, a Yorkshireman, was born on 12th September 1873, the second son of Col. T.F. (or L?) Fairfax of the Grenadier Guards and passed through the Royal Military College, Sandhurst, being commissioned on 8th March 1893 into the Durham Light Infantry (DLI). The governor appointed a committee which doubted if the project was feasible. The Colonial Office received a number of similar proposals in the 1930s. Often the entrepreneur was eager to set up a factory provided that he was granted a high protective tariff, an exclusive license, part of the capital costs, subsidised freight rates and other financial privileges. In effect the businessman was asking the colonial government to bear all the risks while he would enjoy the profits if the project was successful. An official commented that this was a last desperate attempt by a bankrupt farmer to keep his own sisal estates going. The Khmer Rouge withdrew from participation in the political process, and continued armed conflict until 1997. As the military strength of the Khmer Rouge declined, this conflict became more and more sporadic. 2. The proposed Tribunal The atrocities of the Khmer Rouge began to be documented in the period of the People's Republic of Kampuchea. For example, the S-21 "Tuol Sleng" was established from 1975 to 1978 as a security office for interrogation and extermination of prisoners. The site, in a suburban Phnom Penh high school, has been a museum to the victims since 1980. Assessment and documentation of the many cases has continued through the subsequent two decades, and a substantial record is maintained by the Documentation Centre of Cambodia (DC-Cam). In 1979, the PRK government had held a trial, in which Pol Pot and Ieng Sary were convicted and sentenced to death in absentia for their crimes. However, the trial was not accepted internationally because of concerns about the processes, and because of the diplomatic isolation of the PRK government. Responses to the atrocities in the former Yugoslavia, and in Rwanda, included the establishment by the United Nations of international tribunals at The Hague and at Arusha, respectively. International pressure for some kind of legal resolution of the atrocities in the period of Democratic Khmer also increased, as did pressure within Cambodia itself. In 1997, the Cambodian government asked the United Nations for assistance in organising a process for the Khmer Rouge trials. This led to the adoption of a resolution in the UN General Assembly in December 1997, enabling the Secretary-General to negotiate. Negotiations dragged on, with Cambodia producing a draft law in 1999, and that law passed the National Assembly in 2001.2 The United Nations negotiator, Hans Correll, objected that the law did not give effect to the agreement between the United Nations and the Royal Government. Early in 2002, ================================================================================ RASHKB Journal 皇家亞洲學會香港分會學刊 | RAS-2003 https://digitalrepository.lib.hku.hk/catalog/2v242g390 92 the United Nations withdrew from the negotiating process, citing concerns that trials under the proposed law would not be effective within Cambodia's judicial system. Negotiations resumed late in 2002, and in early 2003 a further memorandum of understanding was initialled between the UN Representative, and the Royal Government.3 That agreement was approved by the Third Committee of the General Assembly, and then by the General Assembly. The agreement, and the necessary implementing legislation, was put before the Cambodian parliament in mid-2003. However, the Cambodian parliament went into recess for an election held in July 2003. The election did not produce a clear result, and negotiations between the political parties have continued for almost a year. At the time of writing (July 2004) the negotiations appear to have been resolved, and a new cabinet has been formed." There is quite a backlog of legislative work, including the legislation for the proposed tribunal. The Prime Minister, Hun Sen, had earlier stated that the legislation will be a high priority for the new legislature. In anticipation of the establishment of the tribunal, both the United Nations and the Cambodian Government have formed Task Forces to work towards implementation. At the same time, a number of governments have made financial commitments to the project. The next stage will be the distribution to Cambodians of booklets explaining the tribunal. 3. The Structure and Processes of the Tribunal The most recent proposals for the tribunal are contained in the March 2003 agreement initialled by UN representative Hans Correll and Royal Government representative Sok Ann on 17 March 2003. The tribunal will be constituted as Extraordinary Chambers, a Trial Chamber and a Supreme Court Chamber. This is not an international tribunal: these Chambers are established within the existing Cambodian legal system. But the chambers will include a minority of international judges, and at least one international judge must concur with the decision of the Chamber.
