AIJMER\n\n16 The still wider surname groups, hsing (M), in Chinese society, based on entirely fictitious agnatic relationships, expressed in at least preferred exogamy, have often indiscriminately been designated 'clans'. See e.g. Lee 1960, p. 134f. and Willmott 1964, p. 33. This purely conventional consanguinal kin group comes close to the sociological concept of 'phratry', and kin group constellations of this kind may be described better as units of this higher order. The Hakka nomenclature may vary but the units discussed are always conceived of,\n\n17 Freedman 1958, pp. 47, 129.\n\n18 Census 1911, p. 103f.\n\n19 Nine villages with Cantonese-speaking Punti population in the same district at the same time display numbers ranging between 346 and 9, with an average of 108.\n\n20 However, Jean Pratt, in her account of a Hakka village to the north of Tolo Harbour in the New Territories, gives an example of a non-symmetrical segmentation, reflected in the establishment of a new ancestral hall; Pratt 1960, p. 148.\n\n21 This also applies to the Hakka village studied by Miss Pratt: 'The three lineage halls are merely buildings in a row like an ordinary dwelling house'; Pratt 1960, p. 148.\n\n22 Freedman 1958, p. 50.\n\n23 Skinner, in discussing the importance of marketing communities, points out that in Szechuan there existed organizations of Hakka 'composite lineages', with headquarters in teahouses in the market towns (Skinner 1964/65, p. 37). I have no knowledge of similar organizations in the New Territories. One would have expected something of this kind in a portion of China where the Hakka groups suffered political strain from the Punti population. Local groupings on a non-kin basis may sometimes have fulfilled a protective function. Such local organizations, with headquarters in small temples, are for instance to be found in the Sha Tin Valley, and in the Three Fathom Cove area. All three villages studied belonged in pre-British times to an administrative organization called Luk Yeuk, focussed on the old government centre of Kowloon City. Freedman (1966, p. 86) sees yeuk organizations as means for weak communities to seek 'protection against being molested by local powers'. For a discussion of yeuk see op. cit., pp. 82-89 and for the Luk Yeuk especially pp. 85f.\n\n24 A map of Hakka migrations is, for instance, provided by Kuo 1964, facing p. 6. But there are also other views as to the origin of the Hakka, see e.g. Barnett 1958, p. 2.\n\n25 Izikowitz 1963, p. 171.\n\n26 One man from Grass Field Village has settled for good in Borneo. He has taken his wife and children there. This map appears to be an individual production additional to the map of San On noticed in the Journal several years ago: see Journal Vols 9(1969) and 10(1970) pp 141-148 and 193-196 respectively.\n\nThe right hand bottom corner of the map bears the legend 'Milano Stab. Flli Tensi'. The legend and placenames are given in French, mostly with Chinese characters in addition, making it a bi-lingual map, like the main production on which it is probably based.\n\nThe Note itself is of some interest, giving a brief contemporary account of Hong Kong, as seen through foreign eyes. It is not accurate in all particulars. I have drawn attention to some misprints and strange renderings of names and placenames; but have otherwise reproduced it as in the original. The tour will include a visit to the Tin Hau Temple at Miu Kong, Tsuen Wan, where there is a memorial to the war and a tablet to the Tsuen Wan villagers who were killed. Also to the Kwan Tei Temple at Kam Tin, where part of the Shing Mun villagers were resettled in 1928, which contains a tablet to the Shing Mun villagers killed in the struggle. \n\nFrom the Tsuen Wan ferry pier, the party went first by coach to the Shing Mun reservoir, sometimes called the Jubilee Reservoir because of its completion at the time of King George V's jubilee year (1935). A picnic lunch on one of the vantage points with barbecue and sitting out facilities was followed by a talk by Dr. James Hayes, Tour Leader, on the history and livelihood of the former villagers who lived in the valley for nearly 300 years before their removal in 1928 for the reservoir project. \n\nAfter lunch, the party moved to Kam Tin where the main body of the Shing Mun people moved in 1928. Here our intrepid and helpful bus driver got into difficulties in a confined space between a USD refuse trailer and the gate to the school compound. He was rescued by the action of a group of Members who dismantled a tied up, projecting hawker cart whilst, with characteristic energy and flair, Professor Tony Reynolds directed the driver, conjuring up visions of problems expertly handled many years ago in far Yenan!* \n\nAfter this episode, we were welcomed by the village representative Mr. Cheng Siu-fong (*) and the Headmaster of the Shing Mun New Village School, Mr. Cheung Sze-man (X). We were entertained to tea in the school which has an interesting history. It bears the same name as the old school at Shing Mun Tai Wai built for the villagers by their leaders very many years before their removal in 1928. After the move to Kam Tin it was reprovisioned in the ancestral halls and in 1958, under a subsidized village school building programme supported by the Education Department and New Territories Administration, it transferred to the present six classroomed school building. \n\nOver tea our hosts told us something of the village history after the move to Kam Tin. The main difference was in livelihood, because their agricultural holdings by purchase and rent were only a fraction of those held at Shing Mun, inevitably since Kam Tin had been long densely settled by the Tang clan and later inhabitants. \n\n* See his article at pp 43-54 of this Journal.",

Perhaps it is just as well to emphasize this. Instead, we should be thankful that the informative and often picturesque descriptive writing in the gazetteer comes over so well in translation, and for the liveliness of Dr. Baker's notes and his other writings (particularly the Ancestral Images series mentioned above).         "content_text": "7\n\n(f) their relationship with the departments of Government and with each other; and,\n\n(g) the degree of control which ought to be exercised by the central Government, having regard to the Letters Patent and Royal Instructions\n\nThe wording reflects close secretariat scrutiny of what some thought to be, if not dangerous, then courageous thinking; there should be care not to conflict with established institutions, there should be no derogation from the existing constitution, and the word 'selection' reassured those who feared politically partisan votes. Public criticism of this was immediately heard, upon reading the related press release, from some of the members of the Urban Council who were jealous for their own prerogatives. The Urban Council, little changed from the Sanitary Board created in Queen Victoria's reign, was mainly responsible for environmental public health, recreation & amenities, and provision of cultural services in Hong Kong Island, Kowloon & New Kowloon; it had 12 members appointed by the Governor, and 12 elected on a single limited but anomalously colony-wide franchise (embracing ratepayers and members of 23 qualifying categories of sane, non-bankrupt adults of 21 or over with three years' residence), with a small number of senior official members. It provided excellent services through the Urban Services Department (USD), but its freedom of speech on matters outside its purview gave it a mixed reputation in some powerful circles.\n\nThe membership of the working party consisted of administrative officers from the middle ranks, considered \"promising\" but not yet authoritative. They were a contract officer with much local government experience in eastern Nigeria and Uganda, an officer with happy experience in the USD and of the Urban Council; the most senior Chinese officer, who had served with the British Army Aid Group against the Japanese and now worked in the SCA; and two other expatriates with various past postings including the NTA. Like Dickinson, all continued to perform their current duties, and remained surprised that with his determination they covered so much ground of consultation and discussion and (under pressure from leave entitlements) reported as relatively promptly as they did; that was on 23 November 1966, by which time the Cultural Revolution was spilling",

Rating might have to be extended to the NT: a simplified form had once existed for this, but had been repealed before implementation because of the various oppositions to treating the leased territories as an integral part of Hong Kong — it could be tried again. Division of the rating spoils between Government and local authorities would raise arguments, especially if, as at present appeared, rating revenue exceeded the initial likely expenditure by the new councils. The pros and cons of varied grant-in-aid codes were discussed, including equalisation grants to benefit poorer authorities, general purpose grants, and special grants to stimulate particular activities. The broad suggestion was that since revenues must be assured, easy to levy and collect, flexible and readily understood, rating should be introduced where not already levied (modified in rural areas) and be both fixed and collected by the local authorities; the accruing revenue should be shared between Central Government and Councils, the government share being the first charge; licensing fees, services income, agency fees, investment interest and perhaps gifts & bequests would be additional, and Central Government loans should facilitate capital developments.\n\nThe report sketched possible committee structures, emphasising the desirability of co-option of appropriate experts from outside and the need for proceedings to be conducted in the Chinese language. Initially staff would be seconded from the civil service, with prior consultation on selection for 'key' posts, high calibre would be demanded, and the potential for urban DOs with co-ordinating rôles was glanced at. The psychological and organisational implications for the NTA as the only existing link between Government and the landowners and people of the leased territories, and for the USD which provided services for the Urban Council and in the NT and was the obvious holding unit for staff seconded to new councils, would admittedly be considerable. “Guides, philosophers & friends” would always be desirable, however, and NTA & USD would survive in some form.         "content_text": "The effective block was however contained in the Dickinson Report itself which, although signed unanimously, contained two Notes of Reservation by four of the six signatories. An undogmatic report in which only the chairman and one other seemed wholeheartedly to believe was easily left on one side.\n\nThe officer who admired the Urban Council subscribed to the spirit of the report but was unhappy with the possible division of the colony into as many as nine council areas within a single command span, without an intervening tier, in that tier he saw a future for a widened Urban Council, in the oversight of the fledglings. He preferred a gentle step by step evolution, taking into account Hong Kong's present lack of talent and expertise in administration, the need not to offend traditional institutions and loyalties, Chinese unfamiliarity with elections, and public suspicion of all uncharted changes. He did not co-ordinate his note with the other semi-dissenters.\n\nThe Chinese officer and the two with a general Hong Kong administrative background thought that the report provided a sound basis for citizen participation; but because of its reliance on the ballot box they doubted widespread public acceptance and goodwill, and whether it would attract the best candidates instead of unscrupulous or corrupt power-seekers. If the Urban Council could not attract heavy registration or electoral turn-outs, nor substantial numerical following among ordinary citizens (a picture which most of those who had never served with the USD recognised), how much less would the new authorities? They pointed to a recent UK National Association of Local Government Officers (NALGO, in modern times absorbed into the public services trades union UNISON) submission recommending abolition of small local authorities and restriction of British local government to regional councils with policy powers only, thus giving wider executive powers to their officials, the union's members. This was bolstered by the Note of Reservation's confidence in a Chinese pattern of strong bureaucratic control disciplined by strict moral principles. They too therefore sought a step by step approach, through a preliminary more determined tapping and usage of the known valuable reserves of respected, able and public-spirited true community leaders who were, they said, at present rarely found among the government's nominated or appointed councils.         "content_text": "and fails to satisfy the demands of distributive justice.\n\n97\n\nNevertheless, the Agreement limits the jurisdiction of the Extraordinary Chamber to senior leaders of Democratic Kampuchea, and to the period 17 April 1975 to 6 January 1979.\n\n6.3 Distributive Justice and the Justice System:\n\nIn an ideal world, adequate financial and other resources should be made available for the justice system, so that every case would receive quality justice. But in reality, no society has unlimited resources. Distributive justice then requires that the resources should be allocated in such a way as to maximise or equalise each person's access to justice.\n\nA common response to this has been to propose that international tribunals, which are very expensive, should concentrate on the leadership, and not undertake every case involving an atrocity. The proposed tribunal for Cambodia will be costly - budgets of up to USD $60 million have been suggested. The number of trials is likely to be less than ten, and may not lead to a conviction.14 While such costs may compare favourably with the costs in other international tribunals, nevertheless it is a major allocation of resources for a few cases.\n\n13\n\nNevertheless, it could be argued that distributive justice would be better achieved by using these funds to improve the capacity of the Cambodian legal system to handle these cases, and the many other cases which come before the courts.\n\n16\n\nFor international donors, the tribunal is important for its symbolic role, as a special part of the legal system. Other states,15 international organisations,1 and non-government organisations have contributed considerable funding and effort to the improvement of the Cambodian legal system (capacity building), and these states and organisations are often most supportive of the proposed tribunal.\n\nIn Rwanda, an alternative approach has been taken in order to handle the large number of outstanding cases awaiting trial.
