        "content_text": "BOOK REVIEWS\n\n147\n\nThomas Braddell, James Guthrie, A. L. Johnston, W. H. Read and 'Mr. Whampoa' (Hoo Ah Kay) are traced. The setting is that of a British colonial society in its heyday; the viewpoint is rather parochial.\n\nThe author was himself a prominent resident of Singapore for nearly fifty years. He arrived there in 1864, having been told by W. H. Read that it was ‘a fine healthy place for a young man'. He dryly noted that at the time of writing (1902) the English idea that Singapore was somewhere in the centre of India was becoming less generally held.\n\nThe author writes over-modestly that his book 'will interest those only who have some association with Singapore'. It should in fact interest many today for its detailed picture of the years of growth of a great South-east Asian city-state. To take one year — 1848 — at random; we read of Chinese gang robberies, the P. & O. mail, restrictions on firecrackers at Chinese New Year, the price of gambier, the inability of the Government of India to understand the special conditions and needs of the Straits Settlements, the sending of Chinese convicts from Hong Kong to Singapore, the trade depression, interference by the Malay ruler of Johore with the movement of guttapercha to Singapore, the failure of the Balestier sugar plantation, Captain Keppel and the new harbour, the arrival of Mr. James Brooke on his way to Labuan, and Singapore as a naval station. The author remarks, in passing, that the year 1848 had also been a very exciting time all over Europe'.\n\nThe Anecdotal History was well worth re-publishing for its lively if limited treatment of an era in Singapore's history. Hong Kong University Press, 1965. pp. HK$30.\n\nThe author, Alexander William George Herder Grantham, is better known to the people of Hong Kong as Sir Alexander, Governor from 1947 to 1957. His book traces his own official career from 1922 when he arrived from England as a Government Cadet, to 1957 when he retired as the Governor.",

        "content_text": "KING MONGKUT AND THE KINGDOM OF SIAM\n\n99\n\nsources the bestness and most curiosity of the new breach-loading cannon invented by Sir William Armstrong I was eagerly desirous of obtaining one small gun for my own enjoyment or play to see the power and curiosity and usefulness etc. thereof.....\"6\n\nHe was too fond of women but he is said to have treated his wives well and to have loved all his enormous nursery of children. If his harem may be regarded as a mark of eastern backwardness in a changing world his social and economic reforms vastly outweighed this defect. Mongkut was the pioneer in the modernisation of Siam. He had vision for the future of his country. Harry Parkes writing on the negotiations records this impression of the man:\n\n\"I was fortunate in securing and maintaining the friendship of the First King who listened to several of my propositions even against the will of his Ministers. He is really an enlightened man.... It is scarcely a matter of surprise that he should be capricious and at times not easily guided but he entered into the treaty well aware of its force and meaning and is determined, I believe, as far as in him lies, to execute faithfully all his engagements which are certainly of the most liberal nature.\"\n\nThe \"force and meaning\" of the Treaty was the opening of Siam to western commerce and ideas, social and economic reform and her continued independence. Balanced between competing empires, Siam accepted reform and western influence and by yielding, averted domination.\n\nThe circumstances of Mongkut's death were typical of the King. He predicted an eclipse of the sun in 1868 and made elaborate arrangements to observe the event. He chose a place far to the south, near the Malay States, and invited Sir Harry Ord, Governor of the Straits Settlements, his officials and their ladies to attend. Invitations had gone to Paris to send French scientists. A palace and residences for the distinguished visitors were built, and quantities of European food and wine were brought to this remote spot. The King with his suite of nobles and their wives sailed south for the occasion. Mongkut's prediction was right, and at the last moment the clouds cleared to reveal the eclipse.         "content_text": "HONG KONG CADETS, 1862-1941\n\nH. J. LETHBRIDGE*\n\nThe British Civil Service contains administrative, executive and clerical classes. The administrative class in Britain and the colonies was an elite generally recruited directly from the universities. The term 'cadet officer' denotes the administrative grade of officer in the Hong Kong Government Service in the period under review. It remained in official use for almost a century, until 1960.\n\nAltogether 85 cadets were appointed in the period 1862-1941. 9 died in office, 12 transferred or were seconded, and four resigned or retired on medical grounds. Three became governors of Hong Kong - Sir Francis Henry May (1912-18), Sir Cecil Clementi (1925-30), and Sir Alexander Grantham (1947-1957); and five became Governors or High Commissioners of other territories - Sir Cecil Clementi Smith (Straits Settlements), Sir James Haldane Stewart Lockhart (Weihaiwei), Sir Reginald Fleming Johnston (Weihaiwei), Sir George Murchison Fletcher (Fiji, Western Pacific, Trinidad) and Sir Alexander Grantham (Fiji, Western Pacific). Two became Chief Justices of Hong Kong - Sir James Russell (1888-92) and Sir Joseph Horsford Kemp (1930-33). Four others attained the rank of Colonial Secretary, Hong Kong before retirement - Norman Lockhart Smith (1936-41), David Mercer MacDougall (1946-49), Claude Bramall Burgess (1958-63) and Edmund Brinsley Teesdale (1963-66).\n\nThe number of cadets on the establishment in any one year was never large: only 7 in 1880, 13 in 1900, 31 in 1920, and 37 in 1941. Even these figures are deceptive: they report the strength on the books but not the strength in the field. We must deduct from such totals the number of 'unpassed' cadets2 (cadets engaged in the full-time study of the Chinese language)\n\n* Mr. Lethbridge is Senior Lecturer in the Department of Sociology, University of Hong Kong.         "content_text": "HONG KONG CADETS, 1862 - 1941\n\n41\n\nsioners was introduced for the Straits Settlements, Hong Kong and Ceylon Civil Services; and in 1882, a combined examination was instituted, successful candidates being given a choice of colonies, so that the members of these three civil services were now to some extent regarded as interchangeable. In 1896 the examination was joined to that for the Home and Indian Civil Services; and the Federated Malay States, which had retained the nomination system, was also included. This arrangement lasted until 1932, when Sir Ralph Furse, who believed in the policy of selection by interview, finally succeeded in obtaining for his office control over the selection of candidates for Ceylon, Hong Kong and Malaya. However, university men continued to supply the vast majority of the eastern cadetships even after that date; and the Dominions Office and Colonial Office List for 1939 informs us that 'whilst a university degree is not an absolutely indispensable qualification the candidates selected for Administrative appointments in the last few years have nearly all been in possession of a University Degree, usually with honours. The few exceptions have been in cases where a candidate has had some special qualification'.23\n\nThe Hong Kong cadet scheme underwent several internal changes over time, although the principle of recruitment from England by competitive examination remained unchanged until 1932. The first three recruits, who pioneered the scheme, were given quarters in the Central School House during their probationary period and learned their Chinese, which was Cantonese, from teachers recruited locally by Government. In 1872, Sir Arthur Kennedy established a Board of Examiners, charged with the duty of examining Government officers drawing a Chinese teacher's allowance, and with issuing certificates of proficiency in colloquial Chinese to European and Indian police constables; but before that date cadets had been examined by an ad hoc committee. To save expense, Sir Arthur Kennedy, Governor 1872 - 1877, stopped the recruitment of cadets from England, and in 1875 even suggested dropping the scheme altogether; but this was not accepted by the Colonial Office. The Secretary of State arranged in 1875 for Eastern cadets to remain in England usually for a year and study Chinese at Oxford under Dr. James Legge though, as we have seen above, there were no candidates for Hong Kong at this particular time. LETHBRIDGE \n\nelsewhere and in the discharge of different duties he will gain the confidence of the Government under which he serves, and thus possibly build up a claim to promotion hereafter'.47 Wodehouse and May were also criticised but less severely, and Ripon acknowledge that May, who had already been spotted as a 'coming man', 'showed zeal and capacity in other respects during his short tenure of the office of Treasurer'. \n\nPoor Mitchell-Innes, who was a popular figure in Hong Kong society, did not leave Hong Kong at once. The fine was paid by local subscription and the Chinese petitioned the Secretary of State that he should not be removed from the Colony. The petition was successful and he remained temporarily in the Treasury; but on it becoming known in the Straits Settlements that it was the intention of the Home Government to appoint him to the position of assistant Protector of Chinese in Penang which had become vacant, vigorous opposition on the part of the Straits Settlements authorities was brought to bear, and the intention afterwards abandoned'.48 In 1895 Mitchell-Innes proceeded to England on leave of absence and in 1897 news reached the Colony that he had received appointment as Deputy Governor of a large gaol in the North of England.49 \n\nThe Mitchell-Innes case is instructive. It throws light on administrative practices in Hong Kong at that date and on the scarcity of trained administrative officers. There were only 8 cadets in office in 1893 and these were often shuffled from department to department for short periods of time and expected to master the details of their jobs in a matter of weeks. The tradition of 'omnicompetent generalism' was already believed in by Government and cadets were expected to do all things equally well. Mitchell-Innes was a victim of the system and the tradition. He had been, as the Marquis of Ripon noted, ‘a gentleman who after a comparatively short service had been promoted to a new important position'. The case also throws light on the influence the Chinese notables could exercise on certain occasions: their plea was listened to and as a consequence Mitchell-Innes continued to act as Treasurer for a further two years. Mitchell-Innes is also unique in that he is the only cadet out of the eighty-five appointed to be sacked, for all intents and purposes, from Government.",

        "content_text": "HONG KONG CADETS, 1862 - 1941\n\n49\n\nThe staffing situation improved between 1897 and 1901 and 12 more cadets were recruited from England, the Straits Settlements and the Federated Malay States including Reginald Fleming Johnston, Cecil Clementi, A. G. M. Fletcher,50 and Geoffrey Norman Orme. The incorporation of the New Territories into the Colony meant that more recruits would be needed for district administration and as members of the Land Court set up to determine thorny problems of land ownership and tenancy.52 However, 17 cadets were recruited between 1901 and the end of 1914. There were losses of course: notably the gifted Stewart Lockhart who was transferred in 1902 to Wei-hai-wei as H.M.'s Commissioner, and the equally gifted R. F. Johnston who was also transferred to Wei-hai-wei as District Officer in 1904.\n\nA posting in the New Territories provided for some younger cadets an escape-hatch that removed them from office life in the Colonial Secretariat and other departments in the Central District. Service in the New Territories, a mainly agricultural area dotted with small village communities and small market towns, had more in common with colonial service in Africa and South-East Asia, and the cadet was left comparatively free to go his own way, lead an open-air life and exercise judicious authority. The job demanded initiative, stamina, and magisterial skills; and, if one is to believe Mr. Austin Coates,54 a cadet at a much later date, it was a deeply rewarding life which allowed a cadet to become involved in the lives of simple people, farmers and fishermen, small shopkeepers and craftsmen. Certainly, the report of the District Officers for the New Territories, such as those written by Stewart Carne Ross, have a little more colour than the stilted administrative reports presented annually by heads of departments.\n\nBy the 1920s cadets had become entrenched in most government departments and they filled all the senior posts in the Colonial Secretariat, the directing and co-ordinating agency of government. The exceptions were some departments, such as the Medical and Sanitary Services, Public Works, the Royal Observatory, and Marine Department, which necessitated at the top someone with specialist knowledge. Obituaries of Tonnochy are to be found in the Hong Kong Telegraph, December 14 and 15, 1882, and China Mail, December 15, 1882. The Telegraph tells us \"that yesterday the deceased was in good spirits and played tennis in the afternoon, dined out with a friend, and was in the Club until shortly after midnight\", A Chinese barber found Tonnochy dead in bed when he came to shave him in the morning. He was a bachelor. \n\n13 Walter Meredith Deane (1840-1906). Educated St. Paul's School and Trinity College, Cambridge. Hong Kong Civil Service 1862; Captain Superintendent of the Police, 1866-1891. Deane was severely wounded on duty in 1878 and resigned in 1891 on account of ill-health. \n\n14 Sir Cecil Clementi Smith (1840-1916). Educated at St. Paul's School and Corpus Christi College, Cambridge, Hong Kong Civil Service 1862; promoted from Colonial Treasurer, Hong Kong, to Colonial Secretary, Straits Settlements, 1878. Administered Government 1884-85; appointed Lieutenant-Governor and Colonial Secretary, Ceylon, 1886; Governor and Commander-in-Chief of the Straits Settlements, 1887; H. M. High Commissioner and Consul-General for Borneo and Sarawak, 1889. \n\n15 Alfred Lister (1843-1890). Educated at University of London. Hong Kong Civil Service 1865; prepared detailed index to the Ordinances of Hong Kong in 1870; Colonial Treasurer 1883-90. Died on board ship near Yokohama while on sick leave, Lister held the office of Treasurer as an adjunct appointment only, and with an almost nominal salary, in conjunction with his substantive appointment of Postmaster-General, Lister left a wife and four children in England. See Hong Kong Telegraph, 15 June, 1890. Governor Des Voeux referred to Lister as an \"excellent officer\". \n\n**\n\n16 Sir James Russell (1843-1893). Educated at Queen's University, Belfast. Hong Kong Civil Service 1865; private secretary to Governor Sir Richard MacDonnell 1868; Police Magistrate 1870; Chief Justice of Hong Kong 1888. The Hong Kong Telegraph, 4 September, 1893, in an editorial entitled \"Sir Judas' Russell: His History\" declares \"You could not have been much of an expert in the Chinese language two short years after your appointment to a cadet-ship, yet in 1867, you were Government ‘Interpreter'\". The editorial referred to Russell as \"the Gargantua of Hong Kong social life\" and \"the Jeffries of the Hong Kong Bench\". The writer of the editorial was the atrabilious Robert Fraser-Smith, who founded the Hong Kong Telegraph in 1881. Since Fraser-Smith had been jailed several times for libel, he had reason to dislike the Chief Justice. (See Frank H. H. King and Prescott Clarke A Research Guide to China-Coast Newspapers, 1822-1911, Cambridge, Mass., 1965). Russell, a bachelor like Lister, died at Strathpeffer, Scotland, shortly after resigning from Government. \n\n17 Henry Ernest Wodehouse (1845-1929). Educated at Repton School. Hong Kong Civil Service 1867; retired on pension as Police Magistrate in 1898. One son, Peveril, was the first baby born on the Peak and brother of P. G. Wodehouse, the novelist. Wodehouse was the last of the batch of officials originally appointed to the Colony in the capacity of student interpreter. \n\n18 Sir James Haldane Stewart Lockhart (1858-1937). Land Officer and Police Magistrate in the New Territories, 1903-6, Clementi had the task of recognizing the land titles of over 300,000 claims. Appointed Colonial Secretary of British Guiana 1913-1921; Colonial Secretary, Ceylon, 1922-1925; Governor of Hong Kong, 1925-30; Governor of the Straits Settlements and High Commissioner for the Malay States 1930. In 1934 Clementi retired on account of ill-health.\n\n22 James Legge \"The Colony of Hong Kong\", China Review, Vol. I, 1872-3, p. 173.\n\n23 Dominions Office and Colonial Office List 1939, p. 624, states: \"The average number of cadets appointed to Malaya and Hongkong during the period of 1919-31 inclusive was between 9 and 10. Since 1931 the average has been 5-8, 6 generally. In 1937, 7 cadets were appointed, and 9 in 1938. There were none appointed to Hong Kong 1937, and only 2 in 1938. The demand for cadets in Hong Kong was always small”.\n\n24 For example, Thomas Sercombe Smith (1854-1937) was appointed a Hong Kong Cadet in 1882. In 1883 he was attached to the Colonial Office for a year; and in 1884, after a brief spell attached to the Colonial Secretary's Office, Hong Kong, proceeded to Peking where he studied Chinese, 1884-6. On the other hand, Arthur Winbolt Brewin (1867-1946), proceeded to Canton in 1888. Brewin, who was educated at Winchester, succeeded Eitel as Inspector of Schools in 1897; became Registrar General in 1901 and retired in 1912.\n\n25 Victor Purcell The Memoirs of a Malayan Official, London, 1965, pp. 108-109. The Index to Correspondence (of the Colonial Secretariat), compiled in 1902 by R. H. Indeed, in general terms, the 1893 Ordinance marks the transition from a private army to a public body subject to full military discipline and supervision and official financial scrutiny. In the 1930s the Year Books speak rather wistfully of the fact that the Hong Kong Volunteer Defence Corps was not treated so generously by its Government as were the Volunteers of the Colonial Governments of the Straits Settlements and the Federated Malay States, and did not have 'a fairy godmother' such as the Shanghai Volunteer Corps possessed in their Municipal Council57 (though in fairness it should be stated that their economies were more prosperous than Hong Kong's at this time). For instance, the need for a new Headquarters was pressing at this period and negotiations with Government were slow but had by February 1936 reached the stage when, as R. S. M. Parkinson observed sardonically at the Sergeants' Mess Annual Dinner 'they could confidently expect the building up within the next decade'.58 Like other departments of the public service, the Volunteers had to present their case for funds and take their turn in the queue.\n\nThis account is no more than an introduction to the subject, which is large and important enough to deserve a full-length study similar to those of regular regiments of the British Army by professional military historians such as C. T. Atkinson, S. H. F. Johnston, and Marcus Cunliffe. However, even a short article demonstrates that Hong Kong Volunteers have a long and interesting history which in its military, community and social aspects is so much interwoven with the development of the Colony at large.\n\nFinally, Volunteering is required to generate its own momentum.         "content_text": "THE COLONY OF HONG KONG\n\n183\n\nthe Governor, and many members of the community, in what was long afterwards called, in commemoration of the affair, K'e-ying house. His visit, no doubt, had reference to the evacuation of Choosan by our troops, and the opening of Canton city, for at that time the Governor of Hongkong was also superintendent of trade in all China;—an unfortunate arrangement, which continued till provision was made for the residence of an ambassador in Peking by the treaty of Teen-tsin in June, 1858. The wily Manchoo was more than a match for Sir John Davis. Choosan was evacuated, but Canton was not opened. K'e-ying had promised that it should be opened on the 31st March, 1847, and that not being done, as well as to avenge other injuries, Sir John made his famous raid upon the city, and on the 5th April dictated a convention, stipulating among other things, that Canton should be opened: --not immediately, but in two years, on the 1st April, 1849. It was an unhappy concession; but Sir John Davis somehow wanted \"the stalk of carl-hemp.\" Speaking after the manner of men, the refusal to open Canton was a sufficient casus belli, and I could wish that our second war with China had been fought upon it, rather than on the affair of the lorcha Arrow, nearly ten years later. The Cantonese, from the Viceroy of the Kwang provinces downwards, were encouraged in their insolent contempt for foreigners, and various outrages were perpetrated in consequence.\n\nI may mention that in 1846 a little steamer called the Corsair began to run between Hongkong and Canton, people being doubtful whether the enterprise would pay. The foundation of the Cathedral, then a church merely, was laid in January, 1847. The old Union Church had been opened in 1845.\n\nI returned to Hongkong in the summer of 1848, and found that Sir John Davis had resigned the government of the Colony, and that his successor was Sir George Bonham, whom I had known as governor of the Straits' settlements, when I was in Malacca. I remember, as he was about to proceed in the spring of 1849 to an interview with the governor of Canton at the Bogue, asking him whether he was going to insist on the opening of the city on the 1st April.         "content_text": "RAJA JAMES BROOKE AND SARAWAK\n\n37\n\nFrance, and in 1859 he \"broke off\" relations with Britain, upon which the Foreign Secretary, Lord Russell commented,12\n\nTell Brooke that the people of Sarawak are welcome to any independence they can achieve and maintain but that a British subject cannot throw off his allegiance at pleasure.\n\nAnd Spencer St. John noted13 that \"the Raja's correspondence during this year with Her Majesty's Government was not pleasant, and ended, apparently, in complete estrangement”.\n\nOver the years Brooke had acquired a respectable following of supporters in Britain and Singapore, among whom were some influential figures such as Lord Grey, Bishop Wilberforce of Oxford, and the late Victorian philanthropist, Miss Angela Burdett-Coutts, later Baroness Burdett-Coutts. His friends now took up his cause and lobbied Whitehall from the Prime Minister's office down.\n\nBritain refused to extend a colonial or protectorate status to Sarawak on practical political grounds. Henry Layard, an under-secretary in the Foreign Office, wrote that a protectorate was declined because of the \"inconvenience of such relations between this country and a foreign territory\", because Sarawak “would not be of sufficient value politically and commercially\", and because Brooke's title was not \"sufficiently clear\"14\n\nBrooke's friends persuaded the Government to have another look at Sarawak, and in 1861 Lord Elgin, who was about to depart as the new viceroy of India, was instructed to investigate the prospects and potential of Sarawak. He delegated the task to Colonel Cavenagh, Governor of the Straits Settlements.         "content_text": "170\n\nBOOK REVIEWS\n\nto have visited twenty Asian countries; and while critics of later generations found some of his facts mixed with folk-lore and fable, his descriptions of community existence, family relationships, flora and fauna provided—and still provide exciting reading based on observations which the editor regards as both acute and just.\n\nThese expeditions (in part commercial in part diplomatic) comprising fleets of the largest vessels then afloat, are chiefly significant, however, as unprecedented feats of naval organisation and navigation. In this, 'the Elizabethan age' of Chinese expansion, the Chinese excelled as fighters, traders, diplomats and navigators. Appendix 3 provides informative notes on Chinese ships and seamanship. The European of the time might have had more accurate charts, and such instruments as the quadrant, but the Chinese had long used the lead-and-line, the cross-staff and the compass, and they even made rough calculations of longitude ‘by noting the number of watches which elapsed during the run at a speed estimated from the time taken by the ship to pass a floating object'. But Cheng Ho's last voyage (1431-3) marked the end of the heroic age of maritime expansion. The Ming court lost interest in sea power and its imperial implications, and with this curious and sudden withdrawal from the dawning international order, the doors closed on a unique period of Chinese history.\n\nMr. Mills has not been daunted by the complicated question of texts, and he compares and evaluates the various versions. His own translation is based on the definitive text established by the distinguished Chinese scholar Feng Ch'eng-chun, first published in Shanghai in 1935. Appendices contain a gazetteer of southern Asian place-names known to the Chinese in 1433, as well as an expert and fascinating commentary on 'the Mao K'un Map' which indicates the presumed courses of Cheng Ho's various itineraries. Here, an attempt has been made to identify all the names and legends, five hundred and seventy-seven in number.\n\nFormerly Puisne Judge of the Straits Settlements, the editor belongs to that select band of British administrators and proconsuls who were not simply colonial servants, but who in addition might be explorers or archaeologists or scholars of distinction.         "content_text": "(b) that nearly all of them hold British passports and may be assumed to have been born in the Colony, and (c) that they are practically all men of working age, then we may conclude that they represent very roughly, perhaps a third of all the men in the New Territories who were born there and who fall within the economically active years of manhood. Since, furthermore, there are certain areas of the New Territories from which emigration has been especially heavy, despite the fact that men from all areas have participated in the movement, there are grounds for assuming that the effect of migration must in places have been extremely important.\n\n73. The scale and direction of the emigration of the last few years are novel, but they rest on a tradition which reminds us that in this, as in many other respects, the New Territories are geographically and culturally part of southeastern China. For, especially since the middle of the last century, the coastal regions of the provinces of Kwangtung and Fukien have served as a reservoir from which many countries, above all in South-East Asia, have drawn population. Emigration to California and Australia,—the 'gold mountains'—was noted by the first British administrators of the New Territories (for they spoke of loan associations got up to finance men wanting to go to these two countries), but there are hints in the early census reports that New Territories people were scattered more widely. The 1911 census shows a handful of Chinese in the New Territories to have been born in Annam, Hawaii, the Philippines, the Straits Settlements, Siam, and Australia. In 1921 the countries which appear in this context, again with reference to very small numbers, are Annam, India, Japan, British Borneo, France, Italy, the U.S.A., and Mexico. The list for 1931 reads: Indo-China, British North Borneo, Malaya, Netherlands East Indies, Siam, Canada, the U.S.A., Cuba, Panama, Guiana, Peru, England, and Holland. There were, in fact, two kinds of emigrants; landsmen who went overseas to make a living in a particular country, and seamen who, whether legally or not, left their ships to try their luck in places to which they had been carried. The establishment of Hong Kong as a British settlement in 1842 created a demand for local seamen, many of whom were recruited from the Chinese villages lying near the new centre. Men from Lamma Island and from Lantau Island seem at an early date to have taken service in British and other ships.",

The films concerned the art and archeology of important sites in Korea. In September we were again concerned with Hong Kong History when Dr. Alan Birch, Reader in History at Hong Kong University, spoke on Hong Kong 1937-45: Conquest and Liberation.\n\nAlso in September Dr. Marilyn Grayburn, lecturer in Indian Archeology, University of Cleveland Museum, spoke on 5,000 years of the Indus Valley Civilization, and in October Mr. Lawrence Tam, Curator of the Hong Kong Museum of Art, and himself also an artist of repute and teacher of Chinese Art History, spoke on the Shek Wan Pottery of Kwangtung Province in connection with an exhibition current at the City Hall Museum.\n\nIn December Mr. Henri Vetch, a long standing member of the Society, spoke of his experiences in Peking where he worked as publisher between 1920-1951, when he was imprisoned for three years by the Communists. In January an interesting talk was given by Dr. Wen Hsiang-lai, a neurologist and neurosurgeon as well as authority on acupuncture. He spoke of his recent experiments at the Tung Wah Hospital in the use of electrical stimulation using acupuncture points and needles in connection with drug addiction. And finally Dr. William Parish gave a talk in February on \"Status and Power in Kwangtung Villages under the People's Republic.\" Dr. Parish is associate professor of Sociology at the University of Chicago.\n\nBoth local excursions and overseas trips are a regular feature of our activities and in December Dr. James Hayes arranged a visit to Tsuen Wan where he talked about local temples, rural organization and traditional inter-village feuding. The Society is continuing its programme of cultural tours abroad with a ten-day visit to Kashmir and Kathmandu starting later this week. The trip has been arranged by Dr. Brian Shaw. Where possible we deal directly with hoteliers and pass on group discounts and commissions directly to members travelling. Your Council has been investigating the feasibility of mounting future tours to Afghanistan; the Mohenjo-daro, Harappa, Taxila sites; Ladakh Darjeeling, Sikkim and Bhutan; Dr. Shaw will again be looking into this possibility. Dr. Leigh Wright is also looking at the possibility of a tour to the old Straits Settlements. Now that the Chinese authorities are encouraging travel with.",

Thus the control system achieved its main objective, which was not the protection of women from exploitation, but, as it was commonly expressed in Hong Kong, 'the provision of clean Chinese women for the use of the British soldiers and the sailors of the Royal Navy'.\n\nIn Britain during the 1870s and 1880s the system set up by the Contagious Diseases Act came under attack by various moral reformers who considered that the licensing of brothels by the state implied official condonation of immoral behaviour. They also objected to the discrimination by which the women were compelled to submit to a demeaning medical examination. As a result of a long campaign the system was brought to an end and the Contagious Diseases Act was repealed by Parliament in 1886. In itself this had no effect on the colonial ordinances, but colonial governments were then instructed by the Secretary of State to follow the British example. The Governor of Hong Kong protested vigorously to London, claiming that the repeal of the local Contagious Diseases Ordinance would be unanimously opposed by the Executive and Legislative Councils, by the naval and military authorities and by all classes in the community, since it was the only means of controlling the spread of venereal disease, of preventing the proliferation of brothels in respectable areas of the city and of protecting young girls from being forced into brothel slavery. But the Secretary of State was adamant that the law imposing the compulsory inspection of women must be repealed, though he was prepared to allow the registration of brothels to continue solely for the purpose of providing a means to check against the possible enslavement of their inmates. The Hong Kong government continued to prevaricate, forwarding petitions to London from the keepers of 42 brothels reserved for Europeans and from 23 European prostitutes begging that weekly examinations and the issuing of health certificates might be allowed to continue. These pleas had no effect and the Secretary of State sent Hong Kong a copy of an ordinance which had already been passed in the Straits Settlements with instructions to introduce a similar bill as soon as possible. He also ordered that the issuing of certificates should cease forthwith. Finally in 1889, two years after the original directive from London, a bill entitled the Women and Girls' Protection Ordinance was introduced into the Legis-\n\n10",

        "content_text": "147\n\nThe continued existence of a system of licensed prostitution in Hong Kong soon came to the notice of the moral reform societies in Britain which had succeeded in abolishing such houses at home and were determined to end the system overseas as well. Pressure was brought to bear upon the Colonial Office by written appeals from the societies and by questions and speeches in parliament. So in 1893 a new Secretary of State, Lord Ripon, sent instructions to Hong Kong that the registration of brothels and the periodic examination of their inmates, whether nominally voluntary or not, must cease forthwith. Once again the Governor expostulated, forwarding a petition from the leading Chinese who objected that with the abolition of registration prostitutes would have no opportunity to complain about ill-treatment and that brothels would proliferate in respectable residential areas. The Colonial Surgeon also added his views, claiming that it would be cruel to forbid the women to attend for regular examinations; they were well aware of the need for early diagnosis of venereal disease and came of their own free will. But the Secretary of State, under pressure from moral reformers in Britain, was obdurate, and a bill to repeal the 1890 ordinance and abolish the whole system of control was introduced into the Legislative Council in 1894 and passed by the official majority against the unanimous opposition of the unofficials. Hong Kong's long delaying action to avoid reform was apparently at an end.\n\nThe results of this measure were soon evident: prostitutes ceased to attend for their weekly examinations; a large number of new brothels were opened in areas of the city which had formerly been free of them; and the incidence of venereal disease in the garrison soared. In 1897 half the soldiers in Hong Kong were under treatment for venereal diseases, compared to 15 per cent ten years earlier. In Singapore, which had been given the same directive to abolish registered brothels as Hong Kong, the incidence of venereal disease among troops reached 60 per cent. Faced with this situation the governors of the Straits Settlements and Hong Kong submitted a succession of reports to London and proposed draft legislation which would broadly have had the effect of reintroducing the legal system of control that had existed before 1889. MINERS\n\n28\n\nThis report was sent to Hong Kong for comment; a committee was appointed by the Governor which naturally refuted the more extreme of Mrs. Neville-Rolfe's strictures, and disagreed with her recommendations. Correspondence between the Governor and the Colonial Office on the matter continued for several years. Stubbs strongly supported the established system of regulation and the only suggestion that he was prepared to implement was the provision of free outpatient treatment for venereal diseases at the government hospital. Meanwhile in London the National Council for Combating Venereal Disease and other women's organizations continued to badger the Colonial Office to put pressure on Hong Kong, and the report by Mrs. Neville-Rolfe and Dr. Hallam provided a fine source of material for questions in the House of Commons, particularly from a small group of newly elected women M.P.s, led by Viscountess Astor.\n\nThe main focus of parliamentary attention, however, was not on Hong Kong but Singapore. The government of the Straits Settlements had repealed its contagious diseases legislation in 1894 at the same time as Hong Kong and had set up a similar extra-legal system of tolerated houses. As in Hong Kong, newly arrived prostitutes were interviewed by the staff of the Chinese Protectorate, lists of known brothels and their inmates were maintained and brothel mistresses arranged for their girls to be inspected by private doctors under the implicit threat of the closure of their premises. But this system of control had become less effective and comprehensive by the 1920s. All European prostitutes had been deported in 1916 as a wartime measure, and the Japanese brothels had been closed and their inmates repatriated to Japan at the instance of the Japanese consul-general in 1919. Their clientele then turned to the growing number of sly brothels staffed by Chinese and Malay women who were not subject to any form of control and who were, it was alleged, normally infected with disease. This led to a rapid increase in venereal disease among both the European and Chinese population. Exact figures were not available but various doctors estimated the incidence at between 50 and 75 per cent among the local Chinese and possibly at as high a ratio among the Europeans.         "content_text": "153\n\nunanimously recommended the re-enactment of the contagious diseases legislation in its entirety including the registration of all brothels, the licensing of their inmates and the compulsory medical examination of all prostitutes whether working in brothels or independently. The Governor quickly accepted the conclusions of the report; a bill was drafted to implement them without delay; and both were sent home for the approval of the Secretary of State.\n\nThe draft bill immediately evoked a storm of protest. To calm the critics both inside and outside the House of Commons the Secretary of State appointed a new Advisory Committee on Social Hygiene and asked it to consider the bill and the report on which it was based. The committee included the redoubtable Mrs. Neville-Rolfe and Lady Astor. It spent little time in considering the arguments put forward in the Straits Settlements for the state control of prostitution, which it considered to be completely discredited. Its final report asserted that, quite apart from the moral arguments, periodical examinations of prostitutes was medically ineffective in checking the spread of venereal disease; no examination could guarantee that a woman was free of disease, and even if she was she could become infected immediately afterwards or be the carrier of the contagion from one client to the next; such examinations merely gave men a false sense of security and encouraged promiscuity. The committee recommended various measures to improve social conditions, better housing, education and more recreational facilities; more doctors and free diagnosis and treatment. Its main conclusion was that all known brothels should progressively be closed down commencing with those frequented by Europeans, and that all sly brothels should be closed as soon as they were detected. The committee's conclusions were unanimous and the Secretary of State, Leo Amery, had no alternative but to over-rule the Governor and direct that the recommendations of the committee should be carried out. However, as soon as the minority Labour government of 1929 came into office, various pressure groups, such as the Association for Moral and Social Hygiene and the National Council of Women of Great Britain, set to work, writing to the Prime Minister and the new Secretary of State for the Colonies, Lord Passfield (formerly the Fabian Society reformer Sidney Webb), demanding that Hong Kong should follow Singapore's example and suppress all its brothels. There were also more parliamentary questions from Lady Astor and other sympathetic M.P.s.32 In 1930, there was a change of Governor in Hong Kong: Sir Cecil Clementi left to govern the Straits Settlements, and Sir William Peel from the Federated Malay States was promoted to Hong Kong. Clementi had never shown himself very receptive to policy suggestions from London, and his transfer gave the Colonial Office an opportunity to initiate a change of policy. Before taking up his appointment, Peel saw Lord Passfield in London and was informed that it was the policy of the Labour government that all brothels should be suppressed, but that he should first look into the question and submit a report to London.\n\nPeel sent his views to the Colonial Office in August 1930, three months after his arrival.34 He stressed that the abolition of licensed prostitution and tolerated houses was opposed by the military and naval authorities, senior government officials, and the leading members of the Chinese community who sat on the District Watch Committee. Abolition would probably lead to an increase in the number of sly brothels and streetwalkers, and a greater incidence of venereal disease. It would also make it impossible to deal effectively with the international traffic in women: in Singapore, some measure of control could be exercised at the point of entry where immigrants arrived in a few large vessels, but this was out of the question in Hong Kong, where thousands arrived daily in river steamers, junks, and by land; so the licensing and interrogation of intending prostitutes at the Secretariat for Chinese Affairs was the only way of checking that they were entering the profession of their own free will. MINERS\n\nMeanwhile, at the Colonial Office, Dr. Drummond Shiels, the Parliamentary Under-Secretary to Lord Passfield, had decided that action must be taken by the Hong Kong authorities before the League of Nations commission reported. Having consulted the Colonial Office Medical Adviser, and being assured that the balance of evidence was that the existence of tolerated houses did not keep down the incidence of venereal disease, and that this had been confirmed in the case of Malaya, he proposed that Hong Kong should follow the example of the Straits Settlements and close down all its brothels, beginning with those served by European prostitutes, and the brothels with Chinese prostitutes used by British servicemen. Passfield approved this suggestion and a dispatch on these lines was in course of preparation when the Labour government fell from power in August 1931. The arrival of the Chief Justice's memorandum scarcely modified the draft: the possibility of strong local opposition to the closure of Chinese brothels catering for Chinese clients was noted by officials, but it was pointed out that similar warnings of Chinese resentment had not materialized when the mui tsai system had been abolished. The Governor was advised to proceed cautiously and to attempt ‘to elicit the support of more enlightened Chinese opinion', but it was emphasized that it was the aim of the British government to bring about the suppression of all brothels in Hong Kong. This draft was presented by officials to the newly appointed minister of the National government, Sir Robert Hamilton, who authorized its dispatch.\n\n38\n\nThis directive reached Hong Kong in November 1931. The Governor had been hoping that his pleas for an indefinite delay would be successful and he had just told the Legislative Council that any action would be deferred until after the League of Nations commission had reported.\" But this was not to be, and the Executive Council reluctantly agreed that further registration of new prostitutes should not be allowed and that six months' notice should be given to Chinese and Japanese brothels catering for Europeans. J.\n\nA century ago, the government and scientific elite of Hong Kong welcomed an unusual visitor; an Australian Catholic priest and scientist, Julian Edmund Tenison Woods, who passed through Hong Kong as part of an extensive scientific tour of south-east and east Asia. Woods is probably best known outside church circles for his scientific work, and despite limited formal training, he became an active scientist, publishing extensively in natural sciences, especially marine biology, botany, geology and paleontology.\n\nIn 1883, Woods was commissioned by the then Governor of the Straits Settlements, Sir Frederick Weld, to explore and report on the mineral prospects of some areas of the Malayan peninsula. During this time, he was elected an honorary member of our sister branch, the Straits Branch of the Royal Asiatic Society, and two of his nearly two hundred publications are to be found in its journal. This expedition widened in scope, as he took advantage of opportunities to travel more widely, especially on the naval hydrographic ship HMS Flying Fish. Woods eventually returned to Australia in July 1886, after nearly three years research.\n\nDuring this time, he seems to have made four stops in Hong Kong:\n\nJanuary 1885: Hong Kong and Canton\n\nIn mid-January 1885, Woods arrived on the P & O steamer Hydastes from Singapore. He stayed first with the Governor, Sir George Bowen and then with Judge Russell.\n\nSir George arranged for him to lecture on The Mines and Minerals of the Malay Peninsula on 3 February 1885. During his introduction, Sir George expressed surprise at finding a priest involved in scientific pursuits, and his rather tactless remarks have been preserved in the full report which he sent the next day to the Earl of Derby at the Colonial Office:",

At last one island with a very high peak upon it, loomed out from the clouds at no great distance, soon near enough to discern the forests of masts and crowds of steam-funnels, junks, sampans, and small steam launches which told unmistakably of a large seaport. As we neared it in the dull light of that cold foggy day, it looked as picturesque as any place I have ever seen. It may be defined as thick rows of masts; then handsome terraces of houses rising tier above tier upon such a steep incline that they looked as if each higher range were founded on the chimney-pots of the other. About half-way up the houses ceased, and then diagonal and zig-zag roadways, with scattered villas rapidly ascended into the clouds. A piercing cold Siberian wind was blowing keenly upon the animated scene of great rafts of steamers loading and unloading, a goodly fleet of men-of-war, and, as we neared the wharf, excited, surging, shouting crowds at the waterside. Hong Kong has often been described, but its wonderful population must be seen to be understood. Enormous crowds of boat-women, junk sailors, and coolies, which make a living stream on the quay, have no parallel in Europe or Asia.\n\nCertainly Hong Kong is not a Chinese town, but a town for Chinese, but yet not of European architecture, nor like the Straits Settlements. Its crowded by-streets and lanes, the absence of horse-carriages, the presence of chairs and jinrickshas make it very peculiar. There are plenty of soldiers in red coats and plenty of sailors in naval uniform, and all sorts of picturesque Chinese costumes, a few Hindoos and Malays, besides Parsees of portly presence and European dress surmounted with a hat like a stove-pipe.\n\nI am not going to describe any more of Hong Kong. I believe it is the most hospitable town in the East, almost surpassing the Straits Settlements and Shanghai. The merchant princes live in real splendour, extravagant if you will, but really comfortable. In winter sporting, hunting and other such amusements are out of the question; but for cricket, lawn-tennis, foot-ball and such like, and for balls, parties, private theatricals, & c., it",

        "content_text": "118\n\nD.L. MICHALK\n\nHai-pei Hainan Tao, i.e., the “Circuit or Intendantship of North of the Sea (straits) and South of the Sea” (Mayers, 1872). Since Hai-pei was already used to describe coastal Guangdong, the practice arose of referring to the island south of the sea as Hainan (Schafer, 1969), although it was not until 1921 that it became the official name of the island (Liu, 1938).\n\nThis new administrative footing established by the Mongols paved the way for the constitution of the island in 1370 as the Prefecture of K’iungchou Fu, named after the major city of the island (near present-day Haikou) which was first settled in 631 A.D. (K'iungchou fu chih, 1920 edition). The new prefecture was placed under the jurisdiction of Guangdong Province, an arrangement which has continued to the present. This new status marked the promotion of the island from remote dependency to an integral part of the imperial realm.\n\nRebellion, taxes, piracy and trade\n\nUndoubtedly, this integration was stimulated by the emergence of a flourishing commercial sector which had begun with limited trade in the Tang-Sung period (618-1280) when Hainanese cotton and incense aloeswood were exchanged by the Li for axes, salt, and cattle for their ceremonial rites (Savina, 1929). Through the increase in communication necessary for trade, and intermarriage between settlers and the Li aboriginals, an intermediate community emerged which accepted the supremacy of Chinese rule and adopted their customs and life-style. Known as Shu Li (literally tamed or civilized Li), this group served Chinese masters by tending livestock and tilling fields (Swinhoe, 1872a) in the buffer zone between the Chinese settlements on the coast and the unconquered mountain strongholds of the Sheng Li (literally wild or savage Li) in the island's interior. As their numbers increased, however, the Shu Li caused more anxiety to the Chinese Government by constant rebellion than the wild mountaineers, although most uprisings were self-inflicted by the rapacity of Chinese merchants and injustices meted out by government officials. Only when the Chinese garrisons were known to be weak did the Sheng Li sally forth from their impenetrable mountains and wreak devastation in the settled plains.\n\nPage 135\n\nPage 136",

        "content_text": "59\n\n30\n\nPope Hennessy. This was the Normal School, which was opened in Queen's Road East, Wanchai, on 12th September, 1881, under the headmastership of A.J. May, previously Acting Third Master at the Central School. Partly because Hennessy had not taken the precaution of gaining the prior approval of the Colonial Office in London, and partly because several members of the Education Commission then sitting to consider the elevation of the Central School to collegiate status were unconvinced of the necessity for separate provision of teacher education, the scheme failed. On the recommendation of Dr. George Bateson Wright, the Acting Inspector of Schools who, as Headmaster of the Central School, was normally in a state of dispute with the substantive Inspector, E.J. Eitel, the Wanchai Normal School was closed in October 1883. A.J. May returned to his ordinary teaching duties at the Central School, at first as merely an “extra-master” and, according to Gwenneth Stokes, “always very much on his dignity.”\n\n31\n\nAnd of the original 1881 intake of ten students, only two eventually became teachers. Meanwhile, the failure of the Normal School project led to a resumption of the pupil teacher scheme at the Central School. To avoid the problems faced earlier, first by Stewart and then by May, the revised pupil-teacher scheme gained additional stability by the requirement that each pupil-teacher articled had to deposit $100 with the Government Treasury. Further progress in the field of teacher education in Hong Kong was slow, the next major step being the establishment of “evening extension courses” in 1906, the formalization of these under the aegis of the newly established Technical Institute in 1907, the running of teacher education courses as a part of the Arts Faculty curriculum at the University of Hong Kong from 1916 onwards, and, finally, the establishment of the first permanent training college for teachers in Hong Kong in 1939.\n\n32\n\nAlthough the Normal School was shortlived and made only a minimal contribution to the teaching supply of Hong Kong schools, it was an interesting experiment. Comparable British colonies in Asia, the Straits Settlements and the Federated Malay States launched no such experiment to supply teachers capable of using English as the medium of instruction. They have also a degree of relevance, over a century later, for the West's involvement with present day China's modernizing programme.\n\nThey are to be read in conjunction with other modern works on this period of China's self-strengthening efforts, including those listed in Dr. Leibo's introduction to Transferring Technology.\n\nProsper Giquel, a French naval officer, came to China during the Second China War. After service with the Joint Commission that guided the administration of the city of Canton during its four year occupation by the Allies, during which he laid the foundations of his knowledge of written and spoken Chinese, he joined the Chinese Maritime Customs at Ningpo. When that city was captured by the Taiping Army, he assisted the Sino-French \"Ever Triumphant Army” to recapture it, and later commanded it in the operations that led to the recapture of Hangzhou, for which he received high rank and honours from the appreciative Ch'ing government. Towering above at third-floor level, beneath a canopy of stars, the palm-tops shivered in the breeze; while below in the dim rose light of the table lamps, turbaned bearers moved noiselessly, and the murmur of conversation mingled with the low strains of soft music to conjure fantasy.\n\nIt was only with the arrival of the British that the Chinese, attracted by the rule of law, the security of life, and the open door, moved in numbers to Malaya, so that they are now two million, amongst a population totalling five million. They have been of great service in developing the country. They own many of the tin mines, much of the rubber, nearly all the retail shops, and they are the wealthiest community. But, as is characteristic of the Chinese everywhere, they are not assimilated. They remain a community apart, and even, surprisingly, send members to the People's Political Council at Chungking, the representative organ which advises the Chinese Government, and which is supposed to be democratic but cannot be, as the electoral machinery is controlled by the Kuo Min Tang party, and the secret ballot is as yet unknown in China.\n\nThe British colony, the actual Straits Settlements, covers only a very small part of the area of Malaya. Such control as the British may have over the remainder derives from treaty relations with the Rulers of the several States. How to frame a satisfactory sort of Malayan union out of the ten components of a country as small as England is a problem as yet unsolved. I expect it is the knowledge that the allegiance of the Chinese in Malaya is claimed by the Kuo Min Tang that makes it difficult for the British to recruit them for the armed forces, as though their allegiance were to Malaya. The Americans in the Philippines, where there is not a similar number of territorial divisions, would be faced with the same problem in an easier form were 41% of the population Chinese, instead of 1%.\n\nIn fact the Chinese in Malaya were quite happy. Through the Secretariat for Chinese Affairs they were able to make their views known to the Government. Unless external political pressure is brought to bear they are unlikely to make trouble. Here again they have found conditions of security, comparing only too favourably with those in the homeland, and they know when they are well off.",

        "content_text": "175\n\nthere are rainwater catchments discharging into underground water storage tanks.\n\nOuter defences consist of a dannert or barbed wire topped chain link fence, slit trenches, barbed wire entanglements, and at some locations concrete bunkers sunk into the hillside. Dense thickets and tangled undergrowth form a natural defence outside the perimeter. A later Police Commissioner, Charles Sutcliffe, who came to Hong Kong from Tanganyika, had the idea of improving the natural defences by planting the Mauritius or Cape Thorn. His idea was to cultivate the thorn all along the border fences and around the observation posts as a general security measure. The plan was not successful as the plant did not grow very well and in most areas never really developed as expected.\n\nThe man who gave his name to the new observation posts and whose idea it was to build them, was Duncan William MacIntosh, C.M.G., O.B.E., who assumed command of the Hongkong Police Force on Nov. 22, 1946. At the age of sixteen he joined the Royal Irish Constabulary in 1920 and served with that force until 1922 when he joined the Airdrie Burgh Police. In 1929 he was appointed an Inspector of Police in the Straits Settlements and was interned in Singapore during the occupation. After the war he became Acting Commissioner of Singapore Police, from where he was posted as Commissioner to Hong Kong in 1946.\n\nCommissioner Macintosh was responsible for reorganising the Hong Kong Police Force after the liberation, and to him goes the credit for laying the foundations on which so much of the present efficiency of the force depends. One of his most important tasks was to improve the low morale among the men under his charge. He set about this by beginning a long battle to upgrade police pay, conditions of service, and above all living accommodation. He also concentrated on improving professional standards, and reorganised the Police Training School. He succeeded in his efforts in boosting morale, improving recruitment, and established an esprit-de-corps essential to the running of an efficient police force.\n\nAfter leaving Hong Kong in 1953 on retirement, Mr. MacIntosh accepted appointment as Adviser to the Iraqi Police and spent some time in Baghdad.         "content_text": "208\n\nnior Inspector of Nuisances' and the 'Instructions to Head Watchmen and Watchmen' are of importance in this current study and, since the duties of the Watchmen contained in these instructions are so different from those originally envisaged by the creators of the District Watch scheme, their relevant parts are reproduced at the end of this paper.\n\nBefore continuing with a discussion of the District Watchmen's role in sanitary inspections, some explanation of the word 'nuisance' is appropriate. In the context of Victorian Britain, the term 'nuisance' implied something much more than the modern milder meaning of 'pest' or 'irritant.' 'Nuisance' was a general term to describe anything noxious which would offend the senses, whether these were sight, sound, smell or touch. Brenda Yeoh, in her study of colonial Singapore, describes it as 'an elastic term which encompassed many possibilities from filthy premises to undesirable animals.' She further mentions the comprehensive list of nuisances in The Acts and Ordinances of the Legislative Council of the Straits Settlements from 1st April 1867 to 1st June 1886 compiled by Mr C.G. Garrad which extended over two pages. Given the graver meaning of the term in the nineteenth century, it can be seen that the post of Inspector of Nuisances was much more important than might be regarded today from its title. Inspectors of Nuisances were found throughout the British Empire and also in the Treaty Port of Shanghai.\n\n14\n\nReturning to the removal of the District Watchmen to undertake sanitary duties, what we have here is the appropriation by the Hong Kong Government of the whole of an existing viable private security force to be used by the Government for a completely different function. Moreover, this change would incur the Government in only minimal additional expense since the bulk of the watchmen's wages would still be met by the Chinese merchants. There can be no doubt that the plan was put into operation since, in the Blue Books for 1883-85, a total of six Head District Watchmen and thirty-seven District Watchmen appeared under the heading of Sanitary (a sub-heading under Public Works Department) at an annual cost to the Government of $24 for each Head District Watchman and $12 for each District Watchman. During these three years the Chinese merchants continued to provide these men with an annual wage of $180, in the case of a Head District Watchmen, and $72 per annum for each District Watchman. HORSNELL\n\nAnyone who walks or drives along Austin Road, Kowloon, past the Kowloon Bowling Club towards Chatham Road, cannot fail to notice the imposing entrance to Gun Club Hill Barracks.\n\nThe old cannon on its granite base at one side of the iron gates guarded by a sentry, and the massive granite retaining wall resembling the wall of an unassailable fortress, make a fitting entrance to the barracks. Yet it did not always look like this. The granite retaining wall was built when the cutting for Austin Road was made, and the main entrance to the barracks originally was from Chatham Road. In the old photograph one can see what the entrance looked like at the turn of the century. Colonnaded buildings stand on the site of the present WOS and Sergeants' Mess, a building in the centre stands on the site of the present Record Office and Training Centre, and a building on the right is where the present Officers' Mess now stands. This building is still there although somewhat remodelled with a front entrance wing added in 1935.\n\nIt is not known for certain when the barracks were established, but in early 1860, before Kowloon was ceded to Britain after the China Wars, several areas had already been mapped out as possible sites for military barracks. A memorandum from the Secretary of War, dated 1860, stated \"The necessity for increased accommodation for the garrison has long been apparent to the military authorities, and the acquisition of a healthy site like that of Kowloon, points at once in the direction in which accommodation must be found.\" One of the sites which was mapped out was Whitfield Barracks, named after Maj. Gen. H.W. Whitfield, Maj. Gen. China, Hong Kong and Straits Settlements (1869-1874) to the west of Nathan Road in Tsimshatsui. Another site was Gun Club Hill, probably one of the nine hills which gave Kowloon its name. The site then encompassed the Kowloon Cricket Club ground, but the present 25 acre site is bounded by Chatham Road, Austin Road, Jordan Path, Jordan Road and Gascoigne Road, this last road named after another CBF - Maj. Gen. Sir W.J. Gascoigne KCMG, Maj. Gen. China and Hong Kong (1898-1903).",

        "content_text": "222 \n\nA Bold Approach to War \n\nI have referred to the indomitable spirit that animated the British troops and sailors of the War. This was something one cannot fail to notice in the various accounts of the War. As in the First Burma War, there was a boldness that must have taken the Chinese aback whenever it was demonstrated. Being practically universal, one minor example may serve to illustrate the rest. It comes from J.D. Vaughan, later a magistrate in the Straits Settlements, who had served as a midshipman on the Honourable East India Company's steam frigate Tenasserim in 1842, and is recounted here largely in his own words.46 \n\nA few days after the capture of the Yangtse city of Chin-kiang-foo, his captain took two of the ship's boats with twenty or thirty men each, with a brass three-pounder at the bow, and went to a town on a canal flowing into the great river. The writer was in one of these boats. The ship's Chinese carpenter, a Southern Chinese picked up at Singapore, could write but could not speak the Mandarin language of the area. Armed with a slate, and a truly astonishing degree of sang-froid, he made the captain's wishes to purchase provisions known to a large throng of citizens and soldiers who had assembled on the banks. Negotiating with a mandarin, they got all that they wanted, and during their brief stay were treated with the greatest civility and kindness. “A table and chairs were brought, and the elders of the city had a most interesting conversation with us through the invaluable carpenter. It was a curious sight to see the skipper sitting as cool as a cucumber smoking his cigar surrounded by our foes.\" \n\n“Few men,” Vaughan says, “would have ventured so fearlessly into the very clutches of an armed foe within a few miles of a captured city with war raging all around; and strange to say we came away un-harmed and not an angry face was to be seen amongst the crowds of men who flocked out of the gate of the town to see us.” \n\nMany other instances can be found in the books on the War, and indeed it was the norm. This verve derived from military and naval discipline and tradition, and from the leadership shown by, and expected of, British officers of the day. Cotton ginning factories, sugar cane crushing mills, fibre decorticating plants, tobacco grading and packing factories, saw mills and tin smelters had been constructed to reduce the bulk of primary products and make them more convenient for export. Other industries were started for the purpose of import substitution. In almost all the sugar producing colonies sugar refineries had been set up. Edible oil, lard and soap factories were established using local produce in Nigeria, Ceylon, Nyasaland, Trinidad, Jamaica, British Guiana, British Honduras and Fiji. Breweries had been established in the Gold Coast, Kenya, Cyprus, Malta, Jamaica and the Straits Settlements; match factories in British Guiana, Jamaica and Trinidad; a canned pineapple factory in Malaya. This is by no means an exhaustive list of industrial enterprises in the colonial empire in 1932. All these factories had been set up to serve the local market and had taken advantage of tariffs which had originally been imposed by colonial governments for revenue purposes. In some cases this level of protection was sufficient to make the factory viable. In other cases the company contemplating investment asked the governor for the tariff to be increased so as to exclude competitive imports or asked for a guarantee that no excise duty would be imposed or that any excise duty would be levied at a reduced rate.\n\nColonial governors showed no reluctance to grant these concessions in order to encourage the establishment of local industries in spite of the loss of customs revenue and the increased prices paid by the consumer for goods previously imported. Often governors neglected to seek specific permission from the Colonial Office to make such changes to the schedules of their customs ordinances. In a number of cases the Colonial Office heard of the new protective duties only when British manufacturers complained that they were being excluded from the colonial market. When an industrial project was referred to London governors used various arguments to support the protection of infant industries in their colonies: that the proposal was a legitimate development of local resources; that it would relieve unemployment; that a pledge of protection had already been given by government to the promoters; or that the proposals had the support of the unofficial members of the executive and legislative councils.\n\nNormally the Colonial Office did not refuse to sanction the grant of assistance to the new local enterprise. For example, in 1927 the legislative council of Jamaica passed an ordinance to increase the tariff on biscuits, soap, edible oils, cordage and matches and to remove the excise duty on soap, edible oils and matches in order to protect local industries. The Colonial Office sanctioned this ordinance without any adverse comment. Once an ordinance had been passed by a colony's legislature and had received the governor's assent it",

The governor protested to the Colonial Office at Hong Kong's exclusion in 1907, 1910 and 1912 but the Canadian government refused to include Hong Kong within its preferential tariff on the grounds that goods from China might be shipped through Hong Kong's open port and fraudulently obtain the benefit of Canada's preferential tariff.\" So Hong Kong's exports of cement and refined sugar were taxed at the highest rate and soon lost their market in Canada. In 1912 a trade agreement was negotiated between Canada and the West Indian colonies whereby Canadian exports were granted preferential tariffs in return for Canadian preferences on Caribbean cane sugar, cocoa beans and lime juice. The West Indian colonies negotiated this trade agreement directly with Canada and the secretary of state for the colonies raised no objection. These preferences were increased by a new trade agreement in 1920 and were generalised to benefit goods from all empire sources.20 The Colonial Office invited all colonies and protectorates to consider the practicability of introducing preferential rates of duty for goods of imperial origin. But most of the colonial empire was prevented by international treaties from imposing discriminatory tariffs. Northern Rhodesia, Kenya and Uganda, being part of the Congo Basin, were forbidden to discriminate by the Convention of St. Germain (1919); Nigeria and the Gold Coast by the Anglo-French treaty of 1898; and Tanganyika, Togoland, Cameroons and Palestine were mandated territories of the League of Nations which prohibited discrimination. By 1932 the only colonies which were free to adopt imperial preference but had not done so were Somaliland, Ceylon, the Straits Settlements, Hong Kong and certain islands in the Pacific.\" Canada and New Zealand were the only dominions which granted any preferences to the colonial empire before 1932. Australia, South Africa, Newfoundland, Southern Rhodesia and India granted none.\n\nThe world trade depression which began in 1929 convinced British politicians that the liberal principles of free trade which had been followed for the past 70 years must be abandoned. The National government elected in 1931 quickly passed the Import Duties Act which imposed a general duty of 10 per cent ad valorem on all imports. Section 5 of the act granted an entire exemption from the general duty to imports from all colonies, protectorates and mandated territories, provided that at least 25 per cent of the value was derived from materials grown or produced or from work done within a part of the empire.\" Imports from the dominions and India were exempted from duty only until November pending the outcome of an Imperial Economic Conference.\" A circular despatch was sent by the Colonial Office to all colonies and protectorates drawing attention to the great advantages extended to the colonies by the Import Duties Act and inviting them to give similar preferences to United Kingdom manufactures",

In November 1932 a Canadian manufacturer of rubber shoes complained to the Canadian minister of trade and commerce that in the last two months 15,000 pairs of rubber shoes had been imported into Barbados from Singapore at prices far below that of shoes produced in Canada. The Canadian minister wrote directly to Cunliffe-Lister asking for his help. He expressed the fear that unless something was done additional factories would be erected in Singapore and Hong Kong to take advantage of the new tariff and cheap Asiatic labour. The colonial secretary replied that it would be impossible to introduce in any colony legislation discriminating against goods produced in another colony; this would cut across the principle of solidarity between various parts of the empire which had been accepted at Ottawa and would inevitably cause a serious revulsion of feeling in these colonies.35\n\nExports of rubber boots and shoes to the West Indian colonies continued to increase at an alarming rate throughout 1933. They even penetrated the Canadian home market. Factories in Hong Kong which had previously exported their boots and shoes to China and the Philippines found themselves priced out of these markets by new protective tariffs and turned to export their products to the West Indies and Britain. Canadian and British footwear manufacturers faced with the loss of markets which they had formerly monopolised claimed that the Singapore factory was owned by Japanese interests who were seeking to evade heavy duties by setting up factories within the empire. In fact all the factories in Singapore and Hong Kong were owned and managed by Chinese businessmen. The empire content of the shoes was over 90 per cent since they were made from Malayan rubber and British canvas by British subjects working in a British colony and carried to Britain in British ships. There were no grounds for denying imperial preference to Hong Kong products in accordance with the Ottawa agreements. The Canadian prime minister, R.B. At 532 pages, therefore, this Volume, No. 42 is another bumper effort.\n\nThere are 11 contributions in the ARTICLES section, which must be something of a record.\n\nAndrew Abraham has provided a most scholarly paper on the pros and cons of the transfer of the Straits Settlements from the jurisdiction of the Indian Government to the Colonial Office in 1867.\n\nContinuing our review of the Battle of Hong Kong during World War II, there are contributions from Chohong Choi and Anne Ozorio. The former rehearses Allied thinking on an invasion of Japanese-occupied Hong Kong and possibly the Chinese hinterland behind it, which area might then have been used as a base from which to bomb Japan. Chohong then discusses, somewhat novelly, the challenges to such an invasion from the weather. Ed. - The Straits Settlements was a former British crown colony on the Strait of Malacca, comprising four trade centres, Penang, Singapore, Malacca, and Labuan, established or taken over by the British East India Company. The British settlement at Penang was founded in 1786, at Singapore in 1819; Malacca, occupied by the British during the Napoleonic Wars, was transferred to the East India Company in 1824. The three territories were established as a crown colony in 1867. Labuan, which became part of Singapore Settlement in 1907, was constituted a fourth separate settlement in 1912.\n\nThe Straits colony, occupied by the Japanese during World War II, was broken up in 1946, when Singapore became a separate crown colony. Singapore attained full internal self-government in 1959, became a part of Malaysia in 1963, and became an independent republic in 1965. Labuan was incorporated in North Borneo (later Sabah) in 1946, which in turn became a part of Malaysia in 1963.         "content_text": "Turnbull, an established historian, equivocally suggests that the transfer was based on an inaccurate and unbalanced feedback of the community's feelings:\n\nNo dissenting voice was raised in London and Calcutta, and the colonial office naturally had the impression that the demand for transfer was based on general dissatisfaction with rule from India, with the entire merchant body clamouring for change. In fact, it had required years of agitation on the part of Read, Woods and a small minority of enthusiasts in Singapore to arouse interest in the transfer, and apart from the brief period of panic in 1857 in when the petition was framed, the majority even of European merchants in Singapore were not actively in favour of the change, while the Asian merchants showed almost no interest in the movement.2\n\nIn spite of these conflicting points, I hold that the transfer was needed as the problems raised in the Straits merchants' petition were material and bona fide enough to necessitate the transfer of the administration from Calcutta to London. However, my essay attempts a revisionist's approach to the transfer controversy, questioning its necessity and examining its legal significance through an orchestration of the pot-pourri of relevant issues, in the hope that this methodology may help to provide a clearer awareness and legal understanding into this much taken for granted transfer, thus according it the new angle of attention it deserves.\n\nBackground history of the Straits Settlements3\n\nSingapore, Malacca and Penang were combined to form the Straits Settlements in 1826. The Straits Settlements became the fourth presidency of India, and remained an Indian dependency until 1867. The EIC obtained possession of Penang in 1786, as a base to protect the company's expanding China trade and a centre for the collection of Straits produce from the Malay peninsula and the eastern archipelago for shipment to China. When Singapore was founded in 1819, it was placed under the administration of Bencoolen (in Sumatra) where Raffles was lieutenant-governor. Malacca was administered by the Dutch until the signing of the Anglo-Dutch treaty in 1824, whereby it was ceded to the British among other terms. Two years later, Singapore and Malacca came under the Penang Presidency.\n\nAccording to Turnbull, the Straits Settlements were the East India Company's most incongruous offspring….The Straits Settlements formed a scattered unit, which was difficult to administer efficiently.” In legal terms, it included Western laws at constitutional level, and local legal systems under the control of sultans.\n\nPhysical/geographical problems\n\nPenang Island lay opposite Province Wellesley (a strip of land about 30 miles long and three miles wide) which the EIC acquired from the Sultan of Kedah in 1800. Malacca was about 260 miles to the south of Penang. Singapore Island was a further 120 miles south, at the tip of the Malay Peninsula.\n\nThere were problems of communication between these settlements, being only by means of sea. Until 1861, the Straits government possessed only two antiquated sailing gunboats and one steamer, used mainly to ferry the governor, recorders and senior officials between the three stations. Communications with the EIC's headquarters in Calcutta were also poor, and until 1864, a monthly steamer service between Calcutta and the Straits Settlements remained the only link with the seat of government.\"\n\nAdministration problems\n\nAccording to Turnbull, '[d]ivision of interest between the East India Company and its eastern dependencies was even more formidable than the geographical and physical problems of administration. The sole value of the Straits Settlements to the East India Company was to protect and stimulate the China trade. When [the EIC] lost its monopoly of this trade in 1833 Calcutta was left with an unrewarding and expensive burden. She could not abandon the Straits Settlements but constantly begrudged the drain they made upon India's financial resources and upon the time and attention of senior officials over the next thirty years.'",

        "content_text": "In Calcutta's eyes, the main duties of the governor of the Straits Settlements were to 'balance his budget and to insulate the settlements from complications in the hinterland.' This policy, as Turnbull puts it, was doomed to fail;15 instead it provided the background causes for the agitation of the European merchant community for the transfer of the Straits Settlements from the India Office to the Colonial Office in London.\n\nFor example, as the settlements prospered, the European merchants demanded more expensive and sophisticated administration, an efficient judicial system, defence, and security for their property and trade.1 However, due to Raffles' free trade policy, which was extended to all three settlements, and the failure of land and agriculture, there was insufficient revenue to fund these demands.\n\nThe activities of ambitious pioneers, mainly Chinese migrant workers, who were 'lured by the wealth of the interior [of the Malay states],' made it impossible for the Straits government to cut the settlements off from the affairs of the Malay states. Calcutta maintained its policy of non-intervention to the end, but in practice, every would-be final settlement the government of India authorized merely provided the basis for further involvement.18\n\nThe petition of 1857, wherein the grievances of the Straits merchants were cited\n\nIn 1857, the Straits merchants sent a petition to the House of Commons,19 explaining their grievances with regard to the administration of the Straits Settlements under the EIC, and requesting a transfer of control (by means of an Act of Parliament) from the EIC to the Colonial Office. However, some of the issues raised to the House of Commons appear to be questionable (that is, not all the issues were as serious as they were made out to be). This calls for an examination of the validity of these hazy 'problems,'20 in order to assess the necessity of the transfer.\n\nIn the process, I will also highlight the way in which constitutional and legal changes were introduced in the Straits Settlements.         "content_text": "5\n\nalso study how the English system of law was introduced into a largely Far Eastern society and the extent of its impact.\n\nThe nature of the Calcutta administration\n\nLackadaisical attitude\n\nOne of the most glaring problems in the Straits Settlements was the failure of the Indian authorities to establish an effective form of government. This was due to its distance and lack of accessibility which cultivated an indifferent or disinterested attitude on the part of the Indian officials.21 The Indian government was far more interested in its Indian territories than in its possessions in the Malay Peninsular.22 This led to the administrative problems in the Straits Settlements. Owing to this indifference, the men sent from India were young and inexperienced who knew nothing of the problems in the settlements but were only too eager to return to India to reap bigger rewards and promotion.23\n\nLack of representation in Legislative Council\n\nAs the administration of the Straits Settlements was highly centralised in India, the governor of the Straits Settlements had very little authority and merely supervised administration.24 All important matters had to be referred to India for a decision and the governor had no executive or legislative power.25 All the legislation for the Straits Settlements was planned by the Indian government. As the Straits Settlements had no official representation in India, it could not block any legislation that could prove detrimental to the Straits Settlements.26\n\nThus it can be established that the 'roots of the transfer movement lay in the constitutional rearrangement in the Straits Settlements of 1830 and the [Indian] Charter Act of 1833. Even before 1826, the Spanish silver dollar and local copper cent had been used widely by the Straits merchants in their trade and commerce, (even though in theory, in 1835, the rupee was the currency of account for official purposes until 1867).\n\nThe directors of the EIC, considering only the Indian Empire's interests,29 established a uniform rupee currency throughout its territories, which of course included the Straits Settlements. In 1854, a bill was introduced to the Indian legislative council 'to improve the law relating to the copper currency in the Straits,' which provided for a copper currency based on fractions of the rupee.30 According to the Currency Act, the Indian pice was to be made legal tender instead of the copper cent and the rupee was to be enforced as legal tender.31\n\nThis Act was fiercely objected to by the Straits merchants, and in response to the opposition, the directors ordered the act to be repealed in 1857. Mr Ballie (Secretary of the Board of Control of the EIC) argues that 'it was very natural that the governor-general should desire to establish a uniform currency throughout the whole of the territories subject to his authority'32 and that after the complaints made at Singapore, this grievance was redressed, and that therefore the petitioners did not have a right to complain.**\n\nPage 36\n\n33\n\n35\n\nThe 1867 Act legalised a currency which was already assured,” and by the time the transfer to the Colonial Office took place, the currency issue was virtually resolved. However, as it was a problem that could have been prevented instead of cured, I would accord little credit to the Indian government's role in this issue.\n\nPiracy and western laws\n\nThis was another arguable \"problem\" that was cited in the petition, and used as an example of the Indian government's inefficiency. Piracy was widespread in the Straits until the mid-19th century, and was a threat to the property and commerce of the merchants. The pirates that predominated in the 1830s and 1840s were pirates of the Sulu archipelago, Illanun pirates from Mindanao and Dyaks from North Borneo. Complaints were that 'no systematic measures of protection have ever been adopted or carried out by the EIC, who have been content to leave the service to be performed by the Royal Navy.”37",

        "content_text": "However, in response to a petition by European merchants in 1835 to the EIC against piracy, some action on the part of the Indian government was taken, through the use of steam warships (for example, the Diana and HMS Wolf). These ships were effective in fighting piracy, and according to LA Mills, 'piracy in the Straits greatly decreased for several years... Conditions never became as serious as they were before 1836.'38\n\nHowever, Turnbull says that these measures only gave temporary relief and that, within a few years, the position deteriorated. Moreover, in the 1850s, a new breed of pirates began to haunt the merchants' commerce. They came from China, and the Chinese imperial government was too weak to suppress them. The main theatre of Chinese operations was the Gulf of Siam, although many vessels were captured near Singapore.40\n\nThe Indian government did not pay much attention to the problem as it was involved in the second Anglo-Burmese war at that time, and as Calcutta had passed no laws to detain suspicious vessels, there were no legal means to curb piracy. In 1857, the Indian legislative council had passed an inadequate law which permitted the right of search, but did not solve the problem of proving intent. No improvement was made to the naval force in the Straits Settlements in the last ten years of Indian rule, which consisted of only three gunboats (a 'lilliputian fleet'41).\n\nEventually the Chinese pirates were gradually eliminated from the Straits waters as a result of a series of treaties and agreements between China and other western powers (such as with Prussia 1861, Denmark 1863, the Netherlands 1863, Spain 1864, Belgium 1865, Italy 1866, and Austria-Hungary 186942), the contents of which included co-operative measures to wipe out piracy. The Hong Kong 'Ordinance for the suppression of piracy' was the first real blow delivered against Chinese piracy.4\n\nThe Indian government played a minimal role with regards to the combat of piracy in the Straits. The problem was brought under control through a list of other factors, including foreign treaties and ordinances, and hence, the merchants' complaints were not without reason, as little credit can be attributed to the Indian administration in this respect.",

        "content_text": "The EIC and relations with the Malay states\n\nIn the merchants' own words, 'The Supreme Government of India had uniformly discouraged the local Government at Singapore from interfering with matters beyond the limits of the Island. The cultivation of friendly relations with Native States and Chiefs has been neglected.'44 In this section, I will examine the merchants' reasons for this complaint, and also assess the accuracy of their claim. Rupert Emerson, a historian, calls the period during the Indian government's administration of the Straits Settlements 'a half-century of inactivity.' This is arguably the truth but not the whole truth, because DGE Hall, another historian, tends to disagree with Emerson's assertion. He says that 'one only has to glance through the many volumes of records relating to the period to realise that even if there was little or no spectacular achievement there was plenty of activity.' 'Even if by inactivity is meant the pursuit of non-intervention policy in native affairs, the term is misleading.\n\nPage 48\n\nThe Calcutta administration, wherever possible, adhered to a policy of strict non-intervention in the affairs of the Malay States. This policy had its roots in Pitt's India Act of 1784,49 which stipulated that the EIC's aim was peace, not interference in local politics or extension of the company's territories.50 The main reason for this policy was to avoid any form of entanglement in the internal troubles or wars of the Peninsula which could incur unnecessary expenses for the EIC,51 As it was, the EIC had lost its monopoly over the China trade in 1833 and, with this, the Straits Settlements ceased to be a source of direct profits, and were maintained at an annual loss.52\n\nPage 51\n\nYet despite the law on non-intervention, there was evidence that in some cases concerning threats to British interests, whether commercial, political or involving prestige, local administrators often found it necessary to intervene. In such cases, the actions were often condoned by the Supreme Government. Thus, there was a violation of Pitt's India Act (which eventually did lead to the change in British policy of non-intervention to intervention in 1874),54\n\nPage 53\n\nThio summarises the politico-legal scenario thus:\n\n...when responsibility for the Straits was transferred from the Government of India to the Colonial Office in 1867, the British were already bound by treaties with four of the five states south of Kedah, two of whom they\n\nPage 75\n\nPage 76",

Intervention, therefore, could not be avoided. There was indeed constant intervention, notwithstanding all the rules to the contrary and all the thunders of Calcutta and the East India House, '57\n\nHowever, in spite of Thio's and Hall's assertions, the truth of the merchants' complaint is not invalidated, because between 1824 and 1873, British rule in Malaya was indeed ‘inactive,258 as their official policy was still in accordance with Pitt's India Act. In several cases, the actions of the Straits Settlements government implied some form of intervention, or at least limited interference in the affairs of the Malay States, when they violated the policy of non-intervention; but even then, nothing more elaborate was undertaken than the occasional punitive expedition, which was not enough, in 'the interests of British commerce.'60 Insofar as this was concerned, it would appear that the Straits merchants did have a legitimate complaint to the House of Lords, because their statement would appear to have been bona fide and to hold a substantial amount of evidential truth. Problems were still prevalent, albeit small or insignificant as Mills makes them out to be. In this regard, the Straits Settlements were better off being under the Colonial Office, and concluding thus, the \"problems\" were justified ones.\n\nAt this point, I wish to draw attention to the different systems of law existing simultaneously in the Straits Settlements. There were the Indian laws (passed by Calcutta, modelled on English law) which were either unsuitable to the Straits Settlements or did not cover \"illegality\" in many cases, as we have seen. Then there were the English laws which were more predominant after the transfer but even before 1867 were still the official laws to be applied insofar as the public sphere was concerned. Matters were a little more complicated in the private sphere, as in the case of the local laws under the Sultans, for example, pertaining to Malay customs and religion, discussion of which is beyond the intended scope of this essay.\n\nChinese secret societies—\n\nA wealth of material can be obtained on this issue which has been well-researched by many scholars. However, with regards to the petition and the transfer, all that need be said (despite the topic's complexity) is that the merchants had a legitimate cause for complaint because the Chinese secret societies were dangerous and caused problems; for example 'rivalries of hostile societies and clans gave rise to disturbances and outrages, often of a very grave nature.' These examples also illustrate the gradual introduction of the English system of laws (an alien system) being drawn into and manipulated to serve the purposes of an Eastern society.\n\nHowever, although the problem was reduced, it still exists until the present day. Nevertheless, the Colonial Office did try to improve the situation; a beginning was made, and hence, it could be deduced that the transfer meant a positive step in this area. In this sense, the grounds of the petition were justified.\n\nFurther to the last paragraph of the preceding section, I note again that there were several systems of law regulating the society of the Straits Settlements. In addition to the laws passed by the Indian regime,74 there was also the intervention of the British Parliament from time to time;75 and there were the Chinese secret societies which had their own courts of justice, which provides an example of an alternative system for settling disputes. Thus, amidst radical change in the mainstream administration of justice, there was also continuity in the Chinese system, and it did not die out after the transfer, but instead became a subterranean practice which still continues to exist.\n\nIndian convicts\n\nThis was the last of the problems cited in the petition, and also another hazy issue. Although the merchants complained of the fact that the 'felons sent here [were] being those whose crimes are those of the deepest dye' and that many were sent to the Straits Settlements on a permanent basis, analysis shows that in actual fact the convicts were not as dangerous nor as disadvantageous as they were made out to be.\n\nThe convicts were a source of cheap labour, and hence economically viable. Furthermore, even though they were loosely guarded, very few ever tried to escape. There were occasional violent incidents but these were few and far between, and convicts rarely rebelled against authority. These ex-convicts married local wives, and some even rose in prominence.82 The European merchants complained mainly about the high cost of keeping the convicts (for example, as early as 1841, they grumbled about the costly body of troops to be maintained in the Straits Settlements mainly because they were penal stations).83\n\nThere were some disturbing facts about the Indian convicts pertaining to the growth of Indian-type secret societies,85 and to the spread of criminal activities among present and ex-convicts. There are no statistics to prove how far these groups were involved in crime, but there were nevertheless a few notorious incidents.87\n\nOn the whole, the convict \"problem\" was not really a problem. The Indian government did make some attempts to improve the situation. However, this only took place after the petition of 1857 to the House of Commons. Thus, even though most defects of the system were remedied by the time of the transfer to the Colonial Office, little credit can be given to the Indian government in this issue. Taking into account the context in which the convict problem was cited in the 1857 petition,88 it is not difficult to sympathise with the European merchants,8991 and hence, this \"problem\" in my opinion, was a bona fide one.\n\n## Conclusion\n\nThe transfer was governed by a series of factors. The overall argument has been broached with a revisionist's method of assessment. However, the conclusion is nonetheless an orthodox one in that having clarified the \"problems,\" most would appear to have been bona fide and convincing enough to necessitate a liberation from the Indian government's rule. In this respect, the transfer was a necessary, and hence, a justified move. The act that was eventually passed by Parliament, to change the government of the Straits Settlements from the India Office to the Colonial Office, was the result of a complex variety of causes, which also explains how legal changes were brought about, not in isolation, but in the context of and in accordance with the Straits society's requirements. The regulations of the Straits Settlements were made subject to London's control, and this is a confirmation of the primacy of the English legal system in which was entrenched the rule of law in the Straits Settlements.",

        "content_text": "18\n\nHowever, there were also cases where the British did intervene in the Malay states during the period 1824-73. It is evident that, to a certain extent, the British were inconsistent with their policy of non-intervention, but compared to the period after 1874, when the policy was reversed, these interventions were limited and they only occurred where unavoidable (Ibid. p 179). In this respect, I would argue that the merchants had valid grounds for their petition of complaint to the House of Commons.\n\nThe EIC's non-intervention policy reflected realism and flexibility. They took the stance of non-intervention wherever their commercial interests and political prestige were not threatened, but their policy changed according to the dictates of time, thus in reality, causing them to play dual roles of non-activity and intervention in accordance with the change of times. Whilst the period 1824-73 was not marked by any 'spectacular action or further territorial advances', it can neither be described as being inactive, because as Tan observes, '[c]ases of intervention were...more in evidence than cases of non-intervention' (Tan D E, supra, p 120), and I will highlight some of the more important and interesting ones. From its footholds in the Straits Settlements, the EIC gradually extended its influence over the independent Malay States chiefly through trade and treaties. (Thio E, British Policy in The Malay Peninsular 1880-1910 Vol 1 - Introduction pg xvi-xvii)\n\nThe following examples could be used as evidence to challenge the truth of the merchants' statement of complaint, although in the final analysis, their complaint was a bona fide one.\n\nCases of Intervention\n\nAfter 1826 the Malay states tended to look to the EIC as the arbiter of local politics to whom they reported the ascension of new rulers, and appealed for help in settling internal disputes and quarrels with their neighbours. (Thio, Ibid. p xvi-xvii) For example, the proximity of thriving Singapore to Johore led the British to intervene in the affairs of Johore. When Sultan Hussein died in 1835, Governor Murchison refused to acknowledge Hussein's son, Ali, as the Sultan. It was only in 1852 that Acting-Governor Blundell persuaded the Supreme Government to recognise Ali as the rightful Sultan. Later, compromise was reached when Ali accepted an empty title of Sultan and Temenggong Ibrahim retained control over Johore in 1855. (Thio, supra, p xvi-xvii)\n\nThere were cases of intervention for example, in Kedah, Perak and Selangor, brought about by Robert Fullerton, Burney, Anderson and James Low:\n\nWhen Robert Fullerton was governor of the Straits Settlements in 1824, he completely reversed the earlier British attitude of giving in to the claims of Siam, thus embarking on protection and expansion of British interests in the Malay Peninsula by checking Siamese attempts at extending their influence over the northern Malay states. Thus, when Ligor prepared to invade Perak and Selangor in 1825, he sent a Penang squadron to patrol the river mouths to prevent any attacks. (Mills L A, British Malaya 1824-1867, Chap 8 p 141; other examples of intervention included the following: Burney's Preliminary Treaty with Ligor in 1825. (Mills, Ibid, Chap 8 p 143-146); the Anderson Treaty (involving Selangor and Perak) in 1825. (Mills, Ibid, Chap 8, p 145-146; Purcell, supra, Chap 6, p 70)\n\nThe Burney Treaty of 1826 saw British attempts to secure independence for Selangor and Perak (Newbold, British Settlements in the Straits of Malacca Vol. 2 p 26); and later, the Low Treaty of 1826 promised British assistance in maintaining Perak's independence. These two treaties had more effect on the Malay States than any other treaties, the greatest consequence being a marked ending of Siamese southward ambitions, and thus securing the British position in expanding further into the Malay States at a later stage. However, signing these treaties showed non-compliance with Pitt's India Act. Thus, where Low's Treaty was concerned, the Supreme Government continued for some time to condemn it as unauthorised and never really ratified it. In effect, the intervention in the Malay States was still somewhat restricted by the Government's policy. (Mills, Op Cit. Chap 8 p 162) Other examples include Fullerton's challenge of Ligor's claim to the Kurau District in 1826, and the Burney Treaty of 1826 after which the British ceased to intervene in Kedah.
