The popular religion too, was but an ephemeral thing, something to meet the needs of the moment; something too that was not so respectable as the austere worship which fell within the Confucian canon. In short, the impression left by the brief excursion into the past which forms the basis of this article has left me with the firm impression that Confucianism was the dominant influence over people and government in the New Territory in 1898. I hasten to point out that in itself this is not in any way surprising: but in view of the remoteness of the area and its late settlement by Chinese of different race with their undoubted absorption of earlier inhabitants this impression of its pervasiveness and brooding presence everywhere in the Territory at this time is probably worth restating.\n\nNOTES\n\nAs far as possible the notes are designed to supplement the text and not to be a necessary part of it. I have used local source material which has come to my notice during a tour of duty as District Officer South (1957-60) and Islands (1961-62) when I have been in a favourable position to hear of, find and utilise whatever happened to come my way, besides the authorities cited in these notes. I have scarcely used the District History, the San On Yuen Chi (⛧人元誌, last edition 1820, but reprinted by Kwong Tung Printers, Canton, in 1933) nor Mr. Lo Hsiang-lin's Hong Kong and its external communications before 1842 which uses the District History extensively. (It is good to know that a translation of the latter is in the Hong Kong University Press and will appear shortly, so making available in English part of the District History). I ought also to say here that this is my first excursion in the field of Oriental Studies, with all that this implies. I wish to thank Mr. Lo Chi Chung of the District Office for his valuable help. A Cantonese form of romanization has been used throughout.\n\n1 James Haldane Stewart Lockhart (1858-1937) became a Hong Kong Cadet in 1878. He was appointed Colonial Secretary in 1895, the post he held at the time of his Report (8th October 1898) for which he received the thanks of the Secretary of State for the Colonies. He was created C.M.G. in 1898 and K.C.M.G. in 1908. In 1902 he became first Commissioner of Wei Hai Wei, a territory of 285 square miles on the coast of Shantung with an estimated 330 villages and a population of 124,000 which had been leased to Britain in 1898. He remained in this quiet backwater for the next twenty years. Lockhart was a sinologue of some note in his day and wrote a Manual of Chinese Quotations (Hong Kong, Kelly and Walsh, 1903), The Currency of the Far East, 3 vols (Hong Kong, Noronha and Co., 1895, 1898) and a monograph, The Stewart Lockhart collection of Chinese copper coins, (Shanghai, Kelly and Walsh, 1915).\n\nPage 105\nPage 106",

        "content_text": "GOVERNMENT AND PEOPLE IN HONG KONG 1841 - 1962 99\n\nwas actually protecting local Chinese. The Colonial Office had no desire to see the indigenous population handed over to the power of the Hong Kong British business interests. It was not considered until the 1870s that the Chinese might have a part to play in the function of government, the Colonial Office believing that \"the testimony of those best acquainted with them represent the Chinese race as endowed with much intelligence but very deficient in the elements of morality\" (Secretary of State for the Colonies to Sir John Bowring). The first Chinese member of the Legislative Council was not appointed till 1880, and he, so a Colonial Office minute tells us, was a cipher. While obviously it was not practical to give much in the way of electoral power to either the British or the Chinese communities in the nineteenth century, it seems a pity that more was not done between the two world wars when it might have been feasible. There was a certain broadening of the Executive Council by greater community representation soon after the first war, and significantly, as Mr. Endacott points out, what had been the continuous representation on the Council since 1850 of Jardine, Matheson was interrupted in 1921. But the slump in Europe, its effect on the Colony's trade, and the rising militarism of Japan all discouraged progress.\n\nIt is true that the Colony has gained some measure of independence over the years from control from London. It is financially self-supporting, and since 1958 the annual estimates have no longer been submitted to the Secretary of State. Representation on the two Councils, Legislative and Executive, has been broadened, though there is still no elected element. Furthermore, an effort has been made to bring local people into the ranks of the Civil Service, though it has not met with the success of similar efforts in, for example, former African colonies.\n\nMr. Endacott notes that in 1952 for the first time a locally recruited officer was promoted to be the head of a government department; unfortunately, he does not tell us which department, or how often this has happened again in the succeeding thirteen years. For many and various reasons, the recruitment of Chinese to the Administrative Service in particular has been slow. LETHBRIDGE\n\nany interpretation that may be going on'.42 On the other hand, the scarcity of cadets in government caused serious problems at the end of the century. No scheme of localisation, except at the clerical level, had been promoted in Hong Kong; and although Government had been forced, as a result of Sir William Robinson's Retrenchment Committee of 1894, to abolish the post of Clerk of the Councils, one Magistrate and the Superintendent of the Jail, and amalgamate the posts of the Colonial Secretary and the Registrar-General, the number of cadets was still far too small for the efficient administration of even a municipality. Alleyne Ireland, after a visit to Hong Kong at the turn of the century, argued that there was a need for more cadets, and reported that 'no one who has spent four months, as I recently did, in the Colony could fail to be impressed, as I was, with the fact that in the service as well as in the junior ranks of the service there are a few men of the highest ability and usefulness, nor could he fail to notice that such men were few and not many'.43 The reports of the Finance Committee for 1901 showed, moreover, that the attendance included an Acting Attorney-General, an Acting Colonial Treasurer, and an Acting Director of Works. The service of the colony, Ireland adduced, 'has suffered greatly from the evil of acting appointments, and a system should be introduced under which it would not be necessary to transfer so many officials from one department to another whenever a senior official goes on leave'.44 He also pointed out the inadequate size of the Government offices, and 'the employment of a large number of junior clerks, Chinese and Portuguese, at salaries little better than those paid to day labourers'. Ireland, however, did not mention that the incorporation of the New Territories had led to a drain of officials from Hong Kong.\n\nA concatenation of these processes of retrenchment, scarcity of cadets, acting appointments, and ill-paid clerical staff led to a major government scandal which brought to an end in 1895 the career of one cadet, N.G. Mitchell-Innes,45 who had joined the service in 1881, and this scandal led not only to a commission of inquiry but a rebuke from the Secretary of State.\n\nMitchell-Innes' troubles began when Alfred Lister was appointed Treasurer in 1888.         "content_text": "HONG KONG CADETS, 1862 - 1941\n\nNOTES\n\n51\n\n1 Since the end of war with Japan in 1945 both Hong Kong and its Government Service have experienced major changes of circumstance and outlook. Whilst the cadet or administrative grade continues in being there are now (April 1970) administrative officers in a total permanent Civil Service establishment of there are Chinese officers, the first of whom was appointed in 1948.\n\n2 The title was later changed to \"Cadet on Probation\". In 1862 cadets received a salary of £200 per annum on arrival in the Colony and at the end of two years' study or as soon afterwards as they were declared qualified by a Board of Examiners £400 per annum. In 1924 the salary was still only £350 on arrival and £400 after passing the final examination; in 1936 the amounts were £450 and £525 respectively. Bayard, was very pleased with Tseng's friendly attitude to the United States in his article. Cf. Foreign Relations of the United States, 1887, No. 168, Bayard to Denby, May 7, 1887.\n\n* Ho Kai (Ho Ch'i) was born on 12 March, 1859, the fifth son of the Rev. Ho Jun-yang. Ho Kai obtained his Bachelor of Medicine and Master of Surgery degrees from the University of Aberdeen in Scotland, 1879, and was admitted to Lincoln's Inn on 29 April, 1879. He was called to the Bar on 25 January 1882. Ho Kai was admitted to practice as a barrister in the Supreme Court on 29 March, 1882 after he returned to Hong Kong. From 1882 onward, Ho Kai appeared to be an educationalist, reformist, revolutionary etc. Ho died in September 1914. At the time of his death he was a Member of the Legislative Council of Hong Kong and had been knighted for his public services in 1912. See the account given at pp. 12-16 of T. C. Cheng's \"Chinese Unofficial Members of the Legislative and Executive Council in Hong Kong up to 1941” in JHKBRAS Vol. 9 (1969). After Ho's article was published in the China Mail on 16 February, 1887, it was translated into Chinese entitled \"Shu Tseng Hsi-hou Chung-kuo sheng-shui hou-hsing lun-hou\" by his friend Hu Li-yüan (1848-1916) and was published in the Hua Tsu Jih Pao on 11 May, 1887. Most of Ho Kai's writings like Hsin-cheng chen chian was written in English and was translated into Chinese by Hu. PRYOR\n\nthe Commission reported that \"there are many insanitary properties in the Colony, and dwellings which, in their present condition, are unfit for human habitation.\" The Commission came to the conclusion that it was unnecessary for the government to undertake widespread resumption but that it would be sufficient for various improvements to be carried out at the owners' expense. The principal improvements which were recommended were the provision of open spaces at the rear of premises and the prohibition of cubicles under certain conditions.\n\nIn the compilation of the Commission's report, the views of Dr. Ayres, the one-time Colonial Surgeon, were sought. He very observantly commented that:\n\nMany laws have been made in the 20 years previous to 1894 to remedy the insanitary state of the Colony, but most have remained dead letters owing to the difficulties of enforcing them and the prejudices of the Chinese especially and other sections of the community. The labours of Hercules in cleansing the Augean stables were a trifle compared with that the Government has to contend with in the near future in cleansing the City of Victoria and other inhabited portions of the Colony.14\n\nThe recommendations of the Commission were by and large incorporated in the Insanitary Properties Ordinance of 1899, the provisions of which, however, the then Director of Public Works regarded as a compromise designed to meet objections by the unofficial members of the Legislative Council and the propertied interests which they represented.15\n\nChadwick Returns and New Reforms\n\nDespite all the steps taken by the colonial government to come to grips with the problems created by the disorderly growth of the city, deep feelings of discontent were expressed by certain sections of the community against the inadequacy of the administration's efforts.         "content_text": "The Origins of Hong Kong's Central Market and the Tarrant Affair\n\nDafydd Emrys Evans*\n\nThe public market which at present stands in Queen's Road Central in Hong Kong occupies the site of a succession of older buildings of which the earliest was built as a market in 1842. The early history of this market amply demonstrates the too-seldom revealed complexity of Chinese merchants' commercial transactions at the time of the founding of the Colony of Hong Kong.\n\nHong Kong's first public market opened on the site in May, 1842.1 At the first sale of crown land in the new Colony in June, 1841, the westernmost lots were put up to auction first and the first four, designated at the sale numbers 19 to 16, were not sold but reserved for Government purposes. It was on the lot numbered 16 that the market opened, lying as it did conveniently near to the Upper and Lower Bazaars.2 The Market was, apparently, the brain-child of the Colonial Secretary of the time, Colonel George Malcolm who secured the erection of buildings at a cost of some $3,500.3 He appointed a Chinese named Hwei Aqui as Superintendent and established a fixed list of prices to be charged by the individuals to whom the stalls were let by Government.4\n\nWhen Sir John Davis succeeded Sir Henry Pottinger as Governor of the Colony in 1844, he decided that the Market could operate as a useful source of revenue for the Government and sold the market franchise to the highest bidder who was then free to charge what he could to the stallholders. The successful bidder was, in fact, Hwei Aqui and, though he had apparently given satisfaction formerly when simply in the employ of Government, caused grave dissatisfaction once he was operating the market on his own account, with prices rising far faster than they had previously and without the benefit of Government control over the state of the market.\n\nIt is the few years after the market passed into private hands that it makes its contribution to Hong Kong's history, not only on\n\n* Mr. Evans is Professor of Law at the University of Hong Kong. LACK \n\nhad died the reaction of the Chamber of Commerce to the Governor's suggestion was not perhaps what one might have imagined. \n\nOn 27th September 1906, Mr. E. A. Hewett* the unofficial member of the Legislative Council appointed by the Chamber of Commerce rose to comment upon the budget proposals for the year ahead, and in the course of his speech said— \n\nWith regard to the typhoon shelter, your Excellency referred to the necessity for this which is admitted by all and went on to suggest the Chamber of Commerce might see their way to suggest the means of raising funds, I am sorry to say the Chamber of Commerce do not see their way to meet your Excellency's suggestion. For many years it has been strongly urged by all those interested in shipping that tonnage and light dues should not be levied for the purposes of general revenue. \n\nHe claimed that in 1897 Mr. Chamberlain, the then Secretary of State in reply to a telegram from Sir Wilfred Robinson, “practically admitted that in future light and tonnage dues were not to be raised for such purposes.\" He then said, \n\n\"the shelter benefits all classes of the community and should be borne by the Community and not by the shipping section, we all depend on the native craft, the merchant and the house owner as well as the ship owner and the refuge here is just as much a benefit to the merchant and the house owner as to the ship owner. Consequently, it would be manifestly unfair to ask a portion of the community to raise a large sum of money for the benefit of the whole Colony.\" \n\nMr. Hewett then questioned various sites which had been proposed for a typhoon shelter and raised the possibility of the Colony incurring a loan to pay for it. Then he went on to say that he did not suppose that even had there been a shelter it would have had any effect in avoiding the great loss of life which had occurred on 18th of the month.         "content_text": "92\n\nH. J. LETHBRIDGE\n\ncolony of Hong Kong. In 1845, Charles May, a London police officer, was brought out to organise the new force. Most of the early police recruits were obtained locally from the army, navy, and merchant marine; but in time policemen were recruited directly from Britain or from other colonial territories. The quality and morale of the force was never high. Norton-Kyshe writes that in 1850 a European constable got only $15 a month,\n\nvery far below what the humblest in the Colony required, so that, in the case of steady men, they only accepted the position in the hope of something better turning up. But to this class, unfortunately, the chief objection was the readiness with which they yielded to the temptation offered by the many public houses about, and many of the deaths among the European constabulary were ascribed to their excessive indulgence in ardent spirits, a great portion of which, sold by the low tavern-keepers, was of the most abominable and deleterious description.4\n\nBecause of the demoralised state of the police, Sir Richard MacDonnell, Governor of Hong Kong, reported in 1869 to the Secretary of State that he intended to substitute Scottish for English constables. Altogether forty-five Edinburgh constables were enlisted in 1872. But the Scots contingent proved as susceptible as their English colleagues, for the next year several were dismissed from the force. As a group, they, too, had succumbed to the blandishments and corruptions of Hong Kong. In 1897 it was found that almost all the police—European, Chinese, and Indian—were receiving money illegally from Chinese gambling syndicates, including a British Deputy Superintendent of Police.\n\nBecause of the general shortage of European personnel in Hong Kong, police were often seconded to, or allowed to apply for, positions in other departments. The scarcity of suitable Europeans was, in the main, a consequence of the growing attractiveness of Australia as a land of opportunity, especially after the discovery there of gold in 1851, and of the rapid development of Shanghai, which soon became viewed as an arena more accommodating than Hong Kong for the adventurous and ambitious. Turnkeys at Victoria Gaol were often policemen; and the various Inspectors of Brothels (a post established in 1858), who came under the control of the Registrar General, were in nearly every case former police officers, for the principal duty of such functionaries was to detect",

        "content_text": "MEMORIES OF THE DISTRICT OFFICE SOUTH, NEW TERRITORIES OF HONG KONG\n\nW. SCHOFIELD\n\nMy first introduction to the Southern District took the form of journeys by Water Police launches to various parts of it during the summer of 1919, when I lived for three months in the Water Police station quarters before my first leave. After it I sometimes repeated such voyages for purposes of geological research, on which I embarked with Government encouragement. A professional geological survey of the Colony was being planned in order to help in developing the resources of the Empire after the 1914-18 war, and to most people the Colony's geology was, quite understandably, a sealed book. The coasts and islands of the Southern District afforded many instructive sections, often showing the relations of different rock and mosses in a nearly undecayed state, which except in stream beds could hardly be seen anywhere else in the days before great motor roads cut the hills. This work enabled me to prepare a preliminary report on the Colony's sedimentary rocks and granite batholiths which was presented in 1923 not long before the Canadian geologists began their labours.\n\nIn 1922, while I was working as second assistant to the Secretary for Chinese Affairs and deputy registrar of marriages, on the first floor of the Post Office building, Mr. Wynne-Jones, the D. O. South, whose office was just above mine on the second floor, went to hospital with appendicitis, and I was instructed at ten minutes' notice to go upstairs and do his job till he got better. As I had coveted the job for some time, and had told my chief so (then the late E. R. Hallifax), I was delighted.\n\nIn those days one of the D.O.'s duties was to sit in his office as magistrate for the Southern District, excluding New Kowloon and the Lyemun area.† This court usually functioned from 9 to 10 a.m.\n\n* 1888-1968, Cadet Officer, Hong Kong Civil Service 1911-38.         "content_text": "THE U.S. AND THE QUESTION OF HONG KONG 1941-45\n\nFar Eastern Affairs in the Department of State in 1944, terms “the most difficult supply operation of the entire war\" over the towering hump of the Himalayas. The second difficulty was connected with the priority given to the European theatre. The result was that much of the promised materials to China was often diverted, much to the distress of Hornbeck and others, from its original destination for the European fronts.? Speaking in more specific terms, by late September 1942, US$3.1 billion worth of lend-lease materials were sent to the British Empire, $750 million to Russia, and only $112 million to China. The disparity became even more remarkable by early June: $7,030,000,000 to the British Empire, $1,899,000,000 to Russia, and only $133,000,000 to China.8\n\nUnder the circumstances, it is understandable that the United States should entertain grave anxiety regarding China, especially over a possible collapse of Chinese resistance against Japan. This concern, which the Chinese did everything to keep alive, was universally shared by senior men in the Washington government, including the president himself, H. L. Stimson, then secretary of war, Henry Morgenthau, secretary of the Treasury, Leahy, and many involved in Far Eastern affairs in the Department of State, principally Hornbeck.9 While some doubt was expressed as to how much China could and was willing to contribute to the war effort in the east, the consensus was that her collapse would be a fatal blow to the United Nations, especially the United States, in the Pacific theatre. This event, therefore, must be prevented at all cost.\n\nIt was only natural that the United States, torn by anxiety, should be obsessed with the desire to compensate China as best she could. Consequently, the American government announced at the beginning of 1942 a loan of 500 million dollars to China, with next to no strings attached.10 Meanwhile, the move to push for the allies' recognition of China as one of the great powers, of which Hornbeck claimed himself to be the originator, became increasingly prominent in the American government.11 The outcome was the American insistence that China be included as a signatory, together with Britain, the U.S.S.R., and the United States, of the Declaration of Four Nations on General Security, signed in Moscow on 30 December 1943, and that Chiang Kai-shek, together with Roosevelt and Churchill, be a party to the Cairo Declaration, issued on 1 December 1943.12 The American eagerness to compensate naturally did not allow Madame Chiang Kai-shek's visit to the United States,\n\nPage 30\nPage 31",

        "content_text": "THE U.S. AND THE QUESTION OF HONG KONG 1941-45\n\n11\n\nBritain of Hong Kong, and the development by Great Britain of a great port which he felt had benefited the whole world. He said that it was British territory and he saw no good reason why it should cease to be such. He went on to say that perhaps some arrangement could be made with the Chinese whereby the question of sovereignty could be adjusted but the political control and administrative responsibility remain with Great Britain. He referred to public utterances of his own to the effect that he was not Prime Minister for the purpose of being a party to a liquidation of the British Empire. He said that he had convictions on that subject and that he was perfectly willing to say so frankly to anybody.\"45\n\nIt might well have been his own weak performance in London, among other things, which prompted Hornbeck early in January 1944 to urge the Secretary of State not to repeat Woodrow Wilson's mistake in being too much of a \"gentleman\". The American government must obtain from Britain agreement and cooperation in any reasonable course of action upon which the United States might choose to insist, especially in relation to colonial matters, before the defeat of Germany when Britain still depended on the Americans for their preservation.46\n\nThe Secretary's reaction to the advice is not known. But it appears from his memoirs that he was not in favour of coercion in dealing with the Anglo-American differences, and specifically with the question of Hong Kong.47 In any case, the Department of State had become less and less consulted by the President with regard to general war and foreign policies. The War and Navy Departments and the Treasury were far more important in the President's mind. On the personal level, moreover, Hull was certainly not one of Roosevelt's trusted few. Hull himself was conscious and sensitive of the truth: that FDR was his own Secretary of State.\"48 In fact, many of Roosevelt's utterances at the major Allied conferences, beginning with the Cairo Conference late in 1943, were made without prior reference to and consultation with the Department of State. Hull resigned late in 1944, frustrated and in poor health.\n\nDespite Roosevelt's well-known anti-imperialist and anti-colonial stand and his interest in Hong Kong, his behaviour regarding the future of the British colony was generally characterized by weakness and the lack of persistent and direct pressure on Britain. Very little is known about its origins though it is believed that it had started publication in 1884 for the specific purpose of reporting on the Sino-French War. There are at present two collections of this paper. One is at the Provincial Library of Taiwan at Taipei, from which a photographic reprint was made in 1964 under the editorship of Wu Hsiang-hsiang (Shu-pao, Taipei reprint, 1964; hereafter referred to as Shu-pao I). Another collection was discovered by Fang Han-ch'i 方漢奇 in Soochow, and he published those parts related to the “anti-imperial struggle\" of Hong Kong workers in 1884. He strongly opposed the sending of an investigatory commission from London, which the Colonial Office had been pressing upon him. Peel's views were supported by the Permanent Under-Secretary and officials in London, who advised against any immediate action. A League of Nations commission to enquire into the international traffic in women and children was about to visit the Far East and this gave a good reason for delay, since any sudden change of policy would appear to be either designed to impress the commission or else to be an admission of guilt. Lord Passfield accepted this advice.\n\nFor the next six months the question was allowed to rest. Then in June 1931 Peel again wrote to the Colonial Office, enclosing a long memorandum on the legal position of brothels in Hong Kong written by the Chief Justice, Sir Joseph Kemp. This legal exposition concluded by warning that, though the suppression of all registered brothels might possibly lead to less illicit intercourse, it would probably arouse great resentment if the Chinese brothels patronized by the Chinese were to be suppressed. He continued: ‘I fear the danger of shaking the loyalty of the Chinese community as a whole and their confidence that the government will respect Chinese customs generally. The risk may have to be run, but I think it is a real one. It must be remembered that the Chinese do not view prostitution as we do. They look upon it with a more lenient eye, though excess is reprobated just as excess in other forms of self-indulgence is reprobated. Prostitutes are not social outcasts to the same extent as in 'Western' countries. A prostitute often becomes a highly respectable concubine . . . I realise that this is a very difficult defence to make, especially as the English public do not always realise the delicacy required in ruling an alien civilisation.' Peel offered up a small sacrifice to appease the Secretary of State: he suggested that the seven brothels containing European prostitutes should be closed down. This was not a sign that Peel had been converted to the moralists' point of view; European prostitutes were customarily deported from Hong Kong from time to time, since their presence was considered demeaning to European prestige in the East. This decision to close the brothels employing European, Australian and American women was endorsed by the Executive Council in July 1931.",

The Hong Kong Telegraph in its obituary observed “In the early part of his career he had an uphill fight but his eloquence and thorough grasp of the law quickly placed him in the leading ranks of the Bar and after the retirement of Hayllar he had no rival. No important case could come before the court without Francis being retained\". The China Mail said “As a lawyer he had limitations but they were due to lack of early legal training rather than lack of ability. He had a ready grasp of the main points of a case and was unequalled as a reader of character, particularly Chinese character, and an expert cross-examiner\". The speed with which he prospered may be judged from the fact that he took silk in 1886, being only the third member of the Hong Kong Bar to do so. In his letter to the Colonial Secretary requesting the Governor to recommend him to the Secretary of State for appointment Francis wrote \"His Excellency is well aware that this is an honour which according to the recognised custom and etiquette of the profession is always asked for and when properly applied for is seldom refused”. The Chief Justice (now Phillippo) wrote \"Mr. Francis is fully deserving the honour he seeks. On the retirement of Mr. Hayllar Q.C. he obtained the position of leading counsel at the Bar in conjunction with the Attorney General. In nearly every case he holds a brief on one side or the other, and as leading counsel when more than one counsel is employed”. Governor Bowen wrote \"he has risen into leading and lucrative practice at the local Bar where he is making, as I am informed, some £4,000 annually. I have no hesitation in recommending that his application be granted\". The newspaper reports of cases bear out the above observations. Only towards the end of his life when his health began to fail did anyone else challenge his supremacy. He died before the start of the Hong Kong Law Reports but one of his cases is reprinted from a newspaper: Tang Kai Shang v. Ng Pak To H.K.L.R. Vol. 6 for 1911 p.90.\n\nReading the newspaper reports of his cases Francis comes across as a forceful, and often pugnacious and outspoken, advocate who took every possible point for his clients and never gave up. On one occasion an opponent complained that his truculence in court was quite intolerable and Francis responded by saying of the opponent's speech \"such stuff as that is rubbish\". In 1883 there was criticism of his ungentlemanly behaviour when prosecuting R. Fraser Smith, the Editor of the Hong Kong Telegraph and a frequent sparring partner, for libel. The criticism may well have arisen out of disappointment at Fraser Smith's acquittal. As time went by he tended to assume omniscience and in 1887 an opponent was moved to say of him \"my learned friend appears to think that he is not only an authority on law but on every department in the colony”. Francis was minded to treat that as a statement of the obvious. However Hong Kong was well used to robust and idiosyncratic characters and indeed it had all the flavour of a frontier town. In 1859 the Secretary of State, the Duke of Newcastle, said that \"Hong Kong must be protected from the reckless libels which have so long poisoned the very atmosphere of the colony”. Francis was not only outspoken in Court. The Hong Kong Telegraph in its obituary said “his outspoken utterances estranged many persons who would otherwise have employed him professionally. But his talents were so conspicuous, his experience so great and varied, that he was bound to make his way to the front\". The China Mail said of him that “he had a ready temper but bore no malice\". A sort of verdict on him in his lifetime appeared in the Hong Kong Telegraph in 1891 in a series of articles on \"The Local Devil's Own\". It reads \"John Joseph Francis Q.C. is Hong Kong's leading counsel and one of its most prominent citizens. He served with distinction in the army and having acquired a taste for the Bar while serving Her Majesty elected to serve behind it, and by sheer hard work and natural ability succeeded beyond his most sanguine expectations. It is popularly supposed that to have Francis on your side means winning a case with the special exclusive order of Hong Kong jurymen. He is a warm hearted man in his own fashion and has done a lot of good for a certain class in Hong Kong”. The only deliberate act of discourtesy by him in his professional life that I have found was when the Chief Justice of the day refused to accede to his request not to sit after lunch on a Saturday and he did not attend. The Government was contemptible but Mr. Francis has diverted to himself a portion of the criticism that would otherwise have been monopolised by the Government. The whole affair makes an ugly page in the annals of the colony\".\n\nThere was reaction also inside the Government. Ackroyd wrote to the Colonial Office saying \"Mr. Francis is not a general favourite in Hong Kong and therefore the feeling in his favour on this occasion is all the more forcible testimony”. A Government memorandum recorded \"It has been decided not to give Francis the C.M.G. and it is impossible to vary that decision in the light of his letters. It will be seen that in his letter of 29 May he asks for the reason why he has not been honoured to the same extent as May. He should be politely told that the Secretary of State must decline to enter into correspondence on the subject”. The Governor recommended that Francis should be noted for a C.M.G. \"if he is quiet between this and then\" (i.e. the next honours list). According to a memorandum in 1902 Francis was so noted but “it was not finally decided that he should be given the C.M.G.”\n\nAfter the death of Francis, Ackroyd wrote to the Daily Press “He was a most useful citizen. As Chairman of the Plague Recognition Committee I recall he had put aside his professional duties and sacrificed his large practice for some months to help the Colony in her hour of trial\" (in fact he did not entirely abandon his practice). “He did a great and good work and I deeply regretted that these deserving services had not met with their reward but I suppose some official jealousy prevented him receiving that mark of Her Majesty's favour which he surely deserved and which he would greatly have appreciated\". The Colonial Secretary, J.H. Stewart Lochkart, brought this letter to the attention of the Governor writing “Ackroyd was knighted and now draws a handsome pension of more than £1,200 a year. So far as the Hong Kong Government is concerned his supposition of official jealousy is entirely unfounded. The services of Francis were brought to the notice of the Colonial Office by Sir William Robinson, and Mr. May when he was on leave at home also informed the Colonial Office of the good work done by Francis. However that may be, he took a strong stand in a letter he addressed to the Anglo-Oriental Society for the Suppression of the Opium Trade.\n\nHis statement was couched in a high moral tone.\n\n\"Opium is a subject of discussion of which England and China can never meet on common ground. China views the whole question from a moral standpoint; England from a fiscal. England would sustain a source of revenue in India, while China contends for the lives and prosperity of its people. The ruling motive of China is to repress opium by heavy taxation everywhere, whereas with England the manifest object is to make opium cheaper, and thus increase and stimulate the demand in China.”\n\nLi recognised that the crux of the issue was the importance of opium for the revenue of India, and thus indirectly of Britain. He contended that China did not tax opium because of the revenue it produced, but “the present import duty on opium was established, not from choice, but because China submitted to the adverse decision of arms. The war must be considered as China's standing protest against legalising such a revenue.\n\nA Shanghai paper did not believe the letter was composed by Viceroy Li. It stated: \"It bears the impression of foreign --- we had almost written missionary penmanship throughout.” It was perhaps the product of one of the Viceroy's advisers trained in a missionary school, such as Wu T’ing-fang (Ng Choy) or Chan Lai-sun. Whoever wrote it, it went out under Li's name and must have represented his opinions.\n\nThe letter became the subject of a question in Parliament to the Secretary of State for India as to whether the Indian Government was taking any steps to review Britain's position on the opium",

        "content_text": "71\n\n1901 (see below).\n\n36\n\nBrewin, who was promoted to Registrar General in 1901, had also served briefly, from 1897 to 1901, as Inspector of Schools in succession to E.J. Eitel. His endorsement was, therefore, particularly valuable. He had been appointed, together with his successor as Inspector of Schools, E.A. Irving, and the Chinese member of the Legislative Council, Ho Kai, to the 1901-1902 Education Committee, the report of which contains blatant calls for the separate educational treatment of the different races and a clear recommendation, compatible with the extremes of colonialistic paternalism, that, as far as Chinese education was concerned, the Government should concentrate its efforts and finances on the education, in English, of the few who could be regarded as potential leaders. Interestingly, the Secretary of State for the Colonies at this time, Joseph Chamberlain, totally rejected this recommendation (Chamberlain to Sir Henry Blake, Governor of Hong Kong, 12th September, 1902, in CO129/311, p. 481).\n\n\"For certain individuals, this explanation is something of a euphemism since the “medical and sanitary precautions\" involved burning down their homes.\n\nThe Plague first broke out in Hong Kong in the Spring of 1894. The death rate for the first five or six months was over 2,500, and, though, it was the Chinese population which was most affected, the Europeans were not untouched. Lady Robinson, the wife of the Governor of Hong Kong, was, for example, a victim. Dr. E.J. Eitel, the Inspector of Schools, provided details of the rumours circulating among the less educated Chinese, and their effects, in a memorandum to the Colonial Secretary on 22nd May 1894. Eitel wrote to report and explain \"the panic which has suddenly decimated the attendance in the local Chinese Schools\" and noted that the rumours began to spread in districts affected by the Plague on Sunday, 20th May and reached other districts the next day. The principal rumours were (a) that \"the Government intended to select a few young Children from each School to subject them to a surgical incision of the liver in order to obtain bile, this being the only known remedy for curing the plague”; and, (b) that \"every School would be visited by officers who would examine every child and send to the \"Hygeia\" anyone having the least boil or pimple on its body\". Eitel speculated about the origin of the panic, attributing it to \"the malicious distortion of the native medical fraternity\" and concluded: “I do not think anything very effectual can be done to remove the suggestions of native malice to native ignorance and suspiciousness. Distrust of the Government is still rampant among the lower classes of Chinese. Education will remove it in time. (Memorandum No. 38 of 22nd May, 1894, by Dr. E.J. Eitel, Inspector of Schools; in CO129/263, p. 190-193). 39 In Arnold Wright (ed.), Twentieth Century Impressions of Hongkong, Shanghai, and the Other Treaty Ports of China: Their History, People, Commerce, Industries, and Resources (London: Lloyd's Greater Britain Publishing Company, Ltd., 1908), p. 182, for example, Mok Tso Chun, “a native of the Heungshan district\" and formerly one of the directors of the Tung Wah Hospital, is described as the Chief Compradore of Butterfield and Swire. In the Anglo-Chinese Commercial Directory of circa 1915 (Chief Editor, Jan George Chance), a Mok Jao Chuen, clearly the same person as Mok Tso Chun, appears as Compradore for Butterfield and Swire, while a Choi Kung Po and a Mok Kon Sang appear as Assistant Compradores. Mok Man Cheung acted as witness to the will of Mok Tso [or Jao] Chun and the will, itself, makes it clear that Mok Kon Sang was Mok Tso Chun's eldest son. It was certainly not unusual for Compradores at this time to find positions for younger relatives.",

Therefore I must postpone the question to the next session.”\n\nMr. Whitehead was not to be put off so easily. He attacked from another quarter: \"Your Excellency, in Lord Knutsford's despatch of May 21 he refers to his despatch of March 26 and His Excellency Governor Des Voeux's reply. Would it be possible for the Government to lay this correspondence on the table?”\n\nHis Excellency felt unable to comply as in his opinion the question of Mr. Whitehead related to the entire correspondence on the matter and his action in regard to this was dependent on instructions from London.\n\nMr. Whitehead stated his reason for pressing his request. A public meeting was to be held the following week to pass resolutions on the matter. The recent correspondence would be of great value in determining how best to challenge the official reasons given for the appointment.\n\nThough Mr. Whitehead had asked for the correspondence from 1868 to 1876, they were in fact not needed as the Chamber of Commerce had copies of these. Before the meeting they were published in Hongkong newspapers as background information for those attending.\n\nThe Governor suggested that the meeting be postponed until he had received a reply from London to his request to make the correspondence public.\n\nIn concluding the exchanges, Mr. Whitehead complained of the way in which Hongkong was being treated: \"It is on the face of it a most arbitrary proceeding on the part of the Imperial Government, and cannot be justified in any way.”",

        "content_text": "61\n\nTHE KIUKIANG INCIDENT OF 1927\n\nP. H. MUNRO-Faure\n\nThe turgid waters of the Yangtze rolled by to the sea, four hundred and eighty miles away. They swirled past the two hulks, alongside which river steamers came to discharge the cargoes of cotton material, hardware, salt, and those edible sea-products so dear to the heart of the Chinese gourmet; loading in return tea, porcelain, grass-cloth, and camphor.\n\nInshore small wavelets glistened in the wintry sun, and lapped along the edge of the dark mud, which sloped down to the water in front of\n\n* Editor's Note. Paul Hector Munro-Faure was born in 1894 of Swiss/Scottish parentage. Educated in England, he entered the Supplementary Army Reserve in 1912, and volunteered on the outbreak of War, being commissioned in the Sherwood Foresters. He was wounded on the Somme in 1916, and, on his recovery, was attached to the King's African Rifles, with whom he saw action in Tanganyika. By the end of the War he had risen to the rank of Captain. He was Mentioned in a Despatch for distinguished services in the field, and was commended in writing by the Secretary of State for War.\n\nAfter the War, he joined the Asiatic Petroleum Company, and remained in their service until the outbreak of the Second World War, as Manager of one or other of their offices in China. In 1937 he established a Chinese Refugee Safety Centre in Shanghai, and was later decorated for this by the Chinese Government with the Brilliant Star with Ribbon. In 1938 he was connected with the International Relief Committee in Nanking, by whose Chairman he was commended for his work for the displaced. He was also commended at this date by the Secretary of the Admiralty for his work in evacuating from that city civilians at risk.\n\nOn the outbreak of the Second World War he was commissioned as Major (shortly afterwards Lieutenant-Colonel) in the Special Operations Executive. He worked at first in the Bush Warfare School at Maymyo, Burma, which trained Chinese guerillas for behind-the-lines work. (For this school, see \"Prisoners of Hope\", Michael Calvert, (London, 1951), where Lt. Col. Munro-Faure is mentioned at p. 11). He then opened a similar school near the front lines in the Hangchow-Nanking area. For this he was awarded an OBE in 1943. Later still he worked between the front lines on the north-east frontier of Burma, attempting to ensure the continuing support for the British of the native princes of the region, in the face of Japanese, and particularly Chinese, attempts to replace the British as the dominant local power. He was commended for this work by his Commanding Officer. In 1944, he was recalled to England. After the War he was seconded as Oil Attache to the British Embassy in Romania. He retired in 1949, and died in 1956.\n\nLt. Col. Munro-Faure wrote a book of Memoirs in 1944-1945, in 11 chapters, covering his experiences in the Kiu Kiang Incident (1927), and between 1937 and 1944, together with an exposition of his views on the proper role of foreigners in China. The text is in the Imperial War Museum, London,\n\nBecause of the immensely valuable picture these Memoirs paint of the Kiu Kiang Incident (in which the writer was closely involved), of China during the early War years, and of the border areas of Burma during the period when the present troubles in the area were first developing, it is proposed to print them as a series in this and the next several issues of the Journal.",

        "content_text": "61\n\nHis father, Jazedbouzid, seems to have been bishop of Ch'ang-an in 781, and paid for setting up the tablet. The main inscription, in Chinese, contains a section devoted to the praises of a certain I-ssu whose numerous benefactions to the Nestorian church in China are listed. Jazedbouzid has been identified, probably correctly, with this benefactor. Certainly, as he paid for the tablet's construction, we would expect his generosity to be recognised somewhere in the inscription, and the section praising I-ssu, ‘our great donor', is the only part of the inscription where such an acknowledgement is given.\n\nIf I-ssu and Jazedbouzid are one and the same person, the fulsome tribute to Jazedbouzid's virtues, in an inscription which he himself paid for, may seem rather immodest, but is understandable. I-ssu's career was impressive. He was high in the favour of the emperor Su-tsung (756-762) and was appointed second-in-command (chieh-tu-fu-shih) of the Shuo-fang army group in 756 on the outbreak of a major rebellion by a number of frontier armies under the command of the Sogdian general An Lu-shan. The Shuo-fang armies, adjacent to the three north-eastern army commands which supported An Lu-shan, remained loyal to the throne and, led by the respected general Kuo Tzu-i, put in some hard fighting against the rebels. According to the Sian tablet inscription, I-ssu had a good war:\n\n\"When duke Kuo Tzu-i, secretary of state and prince of the Fan-yang region, was first put in charge of military operations in Shuo-fang, Su-tsung ordered him to accompany the duke to his command. Though he enjoyed the privilege of access to the duke's sleeping-tent, he made no difference between himself and others on the march. He was teeth and nails to the duke, and ears and eyes to the army.\n\nThe rebellion was finally crushed in 762 and I-ssu emerged from the war with a considerable reputation, and a number of military and civil decorations, listed in detail on the Sian tablet. There is no reason why he should not later have become a bishop in the Nestorian church, and if Jazedbouzid was indeed I-ssu it is not surprising that he considered himself of some consequence.\n\nIt is just possible that Adam, metropolitan of China, and Adam, son of the war-hero Jazedbouzid, were the same person. We do not know, but it would be interesting to find out something about these three.\n\nSir William Robinson was Governor of Hong Kong from December 1891 to January 1898. His governorship covered a most difficult period in the history of Hong Kong, during which 'misfortunes after misfortunes assailed the colony in swift succession', to quote from Sayers. The year 1894 was a particularly bad one for Robinson and Hong Kong. His wife died but not from plague. Two very severe typhoons struck Hong Kong in September and October, causing much devastation and many casualties. He eventually succeeded Lockhart as Colonial Secretary in 1902 and as Sir Henry May, became Governor of Hong Kong in 1912, the first local cadet officer to have risen to the highest rank.\n\nFor details about Lowson's subsequent career and life, I am indebted to Mrs. Ashburner for giving me some biographical notes. He came back to Hong Kong to continue his work in the Epidemic after his holiday in Japan. In 1896, he married Miss Isabel Lammert at the St. John's Cathedral. His bride was the second daughter of G.R. Lammert, the auctioneer, whose firm Lammert & Co. was the first of its kind in the Territory, with rooms in Duddell Street for many years. He went on leave in 1897 but soon after went to India at the request of the Secretary of State to advise the government in their efforts to stamp out plague. However, he did not stay long. To quote from an obituary notice, 'he quarrelled with the authorities in a very downright fashion after a few months and took himself to England. This sounds like Hong Kong all over again!' He was back in Hong Kong after this episode. In 1901, he became ill with tuberculosis. On sick leave in Australia, he was asked to advise the Government of South Australia about plague. Eventually, in 1902, he was invalided out of the service at the age of 36 only. He was awarded a gold medal, but not the CMG which was what he would have liked. Back in Scotland, after a period of convalescence, he was active in public affairs in his home town, Forfar. He was elected to the Town Council in 1905 and served continuously for thirty years, during which he was Provost from 1925 to 1931. During the First World War, he served as a Medical Officer of Health for troops quartered in the area. He died in 1935, aged 69.\n\nFrom a number of obituary notices which Mrs. Ashburner kindly sent me, I have gathered some descriptions of Lowson. 'He had a most forceful personality.' 'Pale faced, bright-eyed and black-haired, he stood about five feet ten and had hardly any flesh on his bones.' That was his appearance. About his work on the Forfar Town Council, 'Into the duties of his office he entered with characteristic energy. It was not long before he had shaken his seniors out of their self-complacency.' Also, 'He criticised at every opportunity the Council's methods of doing business and he attempted and did indeed bring about many much-needed reforms.'         "content_text": "The New Territories were leased from China for 99 years from 1st July 1898. Then followed the New Territories Order in Council of 20th October 1898, by clause 1 of which those territories were declared to be\n\n\"part and parcel of the Colony of Hong Kong in like manner and for all intents and purposes as if they had originally formed part of the said Colony.\n\nBy Clause 3 of the same Order-in-Council it was ordered that, from a date to be fixed by the Proclamation of the Governor, all laws and Ordinances which should on that date be in force in the Colony should take effect also in the New Territories. The laws in force in the Colony of Hong Kong at that date were such of the laws of England as existed on the 5th April 1843,\n\n\"except so far as the said laws are inapplicable to the local circumstances of the Colony or of its inhabitants.\n\n718\n\nand local Ordinances modifying the laws of England in force on 5th April 1843.\" The Secretary of State instructed the Governor in a despatch dated 6th January 1899-\n\n\"On the principle that the new territory shall be taken to be and so far as possible be treated as an integral part of the Colony, it is desirable that as many of the existing laws of Hongkong as are applicable to its circumstances should be at once applied, the administration of the laws being carried out with tact, discretion, and sympathy with native custom and prejudice\n\n+++\n\nA week before the British flag was hoisted at Taipo and the territories were taken over from the Chinese authorities the Governor, Sir Henry A. Blake, issued a Proclamation which included this passage:-\n\n\"I would also impress upon you that this territory having been leased by His Imperial Majesty the Emperor of China to Her Britannic Majesty the Queen, as subjects of Her Majesty's Empire, your commercial and landed interests will be safeguarded, and that your usages and good customs will not in any way be interfered with.\"",

        "content_text": "The terms of the Order-in-Council were echoed and further implemented in the New Territories (Exemption from Laws) Ordinance, 1899 (No 6 of 1899). The position, therefore, as regards proceedings other than land cases is that such of the laws of England as existed when the Colony obtained a local legislature, that is to say, on 5th April 1843 are the governing laws subject to two provisions,\n\nFirstly \"except so far as the said laws are inapplicable to the local circumstances of the Colony or its inhabitants;” Secondly \"and except so far as they have been modified by laws passed by the said legislative.”\n\nThe first provision has always been construed to let in Chinese customary law when a necessity arises of preventing injustice or oppression. The passages already quoted from the Secretary of State's despatch and from the Governor's proclamation bear out that construction in regard to the application of section 5 of the Supreme Court Ordinance to the New Territories.\n\nAs to the date for the recognition of customary law to be applied in such cases, opinions differ. One opinion is to be found appended to the Report of the Committee appointed in 1948. The choice there offered is between custom existing in 1841, when Captain Elliot took over Hongkong, that existing in 1898, when the New Territories were leased to the United Kingdom, or that existing in 1905, when the New Territories Land Ordinance, 1905, was enacted. The anonymous author of that opinion inclined to select the latter year, but the Committee expressed no opinion on the matter. The New Territories Administration, on the other hand, has interpreted “Chinese Law and custom” to mean the law and custom of Manchu China as it existed on April 20th, 1899. For reasons given in my previous article, it is submitted that as in the Colony of Hongkong, so in the New Territories, a court should apply the Chinese customary law existing at the time that court is called upon to determine any issue. Particular support can be found for that submission in respect of the New Territories in the opinion of the Attorney General in 1898 that it was \"hardly necessary...to enter into the question as to whether any and, if so, which of the laws of England in force on 5th April, 1843... should be specially included in an exempting Ordinance, because such laws were only brought into force in Hong Kong “so far as they were not inapplicable to the local circumstances of the Colony or its inhabitants.” The Government was\n\nPage 17\n\n \n...",

        "content_text": "course, think about The Little Man; it can't think about little men.\" This is not to decry what individual officers could, and usually did, do for personal complainants in specific cases.\n\nSir David Trench had his own ideas; thoughts from on high are less easily smothered than unsolicited disturbances from below. The received wisdom, which equally impressed most of the interlopers, was that since most of the population might want to return home across the border at some time, the electoral roll would be far too fluid to embrace a stable, identifiable and representable society; and that in any event direct elections to Legislative Council (Legco) were unthinkable, because they would be hi-jacked by the Communist Party of China (CPC) and the Kuomintang (KMT) from Taiwan; the fundamental Chinese political battle would then be fought out in the streets and on any hustings of Hong Kong, which the Chinese People's Republic (CPR) would never be willing to stand idly by and watch being conceivably won by Hong Kong Chinese Nationalist sympathisers. However Trench recognised that Legco was not the only possible forum for expression of popular feeling.\n\nTrench had no problems with sharing some of the lifestyle of the taipans and Chinese millionaires who were so noticeable among those traditionally appointed by governors to Exco and Legco, and whose nature he did little to change; despite the familiar jibe that he ranked third, after the taipan of the Hongkong & Shanghai Banking Corporation and the Chairman of the Royal Hong Kong Jockey Club, all knew that in the last resort he recommended the names of Executive Councillors to the Secretary of State. In his earlier days, however, he had preferred the raffish and disrespectful ambience of the multi-racial Foreign Correspondents' Club to that of the Hong Kong Club, Fanling [the Governor's official residence in the New Territories Hon. Editor] and the Jockey Club; while he enjoyed the actual sports of golf and racing for their own sakes; he never lost touch with his humbler post-war acquaintances in the Chinese community, such as his language teacher. He insisted that the introductory review chapter of one year's colonial annual report should spell out the wide sweep and valued authority of the great number of statutory, non-statutory and ad hoc committees which he believed to be a valid response to critics who would not understand why the people had no democratically elected voice in his councils. In 1901 he was posted to South Africa to serve with the mounted infantry, taking part in operations in Cape Colony and the Transvaal [December] and the Orange Free State (January to May 1902]. From 1904 to 1908 he was appointed as Inspector of Chinese Labour in the Transvaal. He was the Military Secretary to the Governor of Madras in 1907, and in May 1914 he transferred to the Reserve of Officers with the rank of Major, but was recalled in August 1914 serving again with the DLI before being transferred to the Royal Flying Corps and then transferring back again to the infantry, commanding 17th Battalion of the King's [Liverpool] Regiment [Pals] before being severely wounded and gassed at Trones Wood in July 1916, being invalided home in early August 1916 aboard the Asturias. He was again gassed, after returning to France on the night of the 29th July 1917 at Guillemont. He established the HQ for the CLC at Noyelles in 1917, staying at the villa, with an unusual name of “Daisy Cottage\", serving as GHQ Adviser Chinese Labour, from 1917 to 1919. During World War II he was a Zone Commander for the Yorkshire Home Guard and died on 24 January 1950 at the age of 76.\n\n4 pai is a section and tou is a head or boss.\n\nDecauville was a French company that manufactured a portable light railway system much used by the military.         "content_text": "creation of protected local industries could be justified only where the colony had natural advantages for the development of an industry and where it was likely eventually to be profitable without protection. However, regard should also be paid to the principle of trusteeship and where the commercial interests of Britain and the general economic well-being of the colony were in conflict, colonial interests should prevail. These ambiguous recommendations gave the Colonial Office a considerable area of discretion to determine whether or not a colony should be allowed to institute a protective tariff or provide other assistance to a proposed new industry.\n\nThese recommendations did not affect the situation in Hong Kong and Singapore, where Chinese entrepreneurs were successfully exporting shoes and other goods manufactured from imported raw materials without the assistance of any protective tariff. Their home market was small compared to their export markets and they could easily undercut any foreign competitors. The committee regarded the invasion of the British and dominion markets by cheap rubber shoes produced by oriental labour as an evil, but it opposed the imposition of import duties on colonial manufactures since the Ottawa agreements had granted entry free of tariffs to all imports from the dominions and India; discrimination against colonial products would undermine the principle of free trade within the empire and call into question the preferences and privileges which the colonies had extended to imports from Britain. Instead of tariffs on colonial manufactures the committee recommended that efforts should be pursued to assimilate conditions of employment and factory and workshop regulations to those in force in Britain by the adoption of the International Labour Conventions by the colonies. The committee also suggested the encouragement of negotiations between manufacturers in Britain and in the colonies to divide the market by the assignment of quotas between them.\n\nCunliffe-Lister welcomed the report in spite of the rejection of his idea of protection for British manufactures against colonial competition. The report was circulated to the cabinet for the information of ministers but objections were unexpectedly raised by the secretary of state for India and the chancellor of the exchequer. The main doubt was whether the report went far enough in recommending the discouragement of new industries in the colonies. So the report was remitted for further consideration by another committee, but nothing was done for three years. In the meantime the Colonial Office proceeded to act on the principles recommended in the report. Instructions were sent to all colonies that any proposal to protect a local industry must be referred to London at the earliest possible stage and no bill to impose or increase a protective tariff should be introduced into the legislative council without prior authorisation by the colonial secretary.
