WIENS\n\nmountainous regions of south China but also across the southern borders in Burma, Laos and Vietnam.\n\nThe Yao, like the Miao, also are mountain-loving people, but appear to have originated as ethnic groups in the hill country of east-central China, in such regions as the present provinces of Anhwei, Chekiang and Kiangsu. They were here as early as Chinese records mention them, but they appear to have gradually abandoned these areas, as Han-Chinese settlement increased in density, and friction over land and other matters led the Yao to seek more isolated mountains. Since they were like the Miao in their type of fire-field or forest-burning, shifting cultivation, they inevitably came into close contact with the Miao and have many cultural features in common with the Miao. Elements of the language also appear similar. Some Chinese ethnographers have considered the Wu-ch'i Man a Yao rather than a Miao group, and others believe them to have common origins. This confusion is probably due to strong Mon Khmer influences originating from India and Southeast Asia in the earliest times.\n\n4\n\nOne of the supporting arguments for the common origin of Yao and Miao is the common cult attached to the dog and the tiger. The Yao trace their ancestry mythically to the union of a princess with a supernatural dog-hero called P'an-hu. Yao myths trace their movement southward from both the central Yangtze valley regions and from the Chekiang-Fukien mountains. Folk songs of the Yao indicate further that they crossed over the Nan-ling mountains in great numbers during the period of Huang-ch'ao's rebellion in the reign of the T'ang Emperor Hsi-Tsung (A.D. 874-889),4\n\nWhen the Miao moved into the Kweichow region in the earliest times, they probably found the Yi or Wu-man peoples already in occupation of western Kweichow. The Yi certainly preceded the Han in this part of China, and the Han Chinese have known of the Yi in their present habitats in southwest China for over 2,500 years. But precisely because of this and because they occupied irrigable valley lands, the Han Chinese came into conflict with them. Moreover, because of superior culture, technology and number, the Han gradually took over the T'ai states of the Yangtze valley and assimilated their populations. Those among the T'ai leadership who escaped Han political and cultural conquests were the ones who led their following in migration away from the front of contact. The direction of this slow historical flight was southward and southwestward,\n\nBefore the Han Chinese conquest under the Ch'in dynasty (Third century B.C.), south China contained 6-8 large T'ai states. In Szechwan the T'ai state of Shu was centered on the present provincial capital of Ch'eng-tu. The Pa state was centered at Chungking. In the central and lower Yangtze region were the T'ai states of Ch'u and Wu respectively. The T'ai state of Nan-yueh included such areas as the Canton delta and the Red river delta of Tongking. In Fukien were the Pai-yueh, sometimes politically centralized at Foochow. All of these were absorbed into the political body of China during the 400 years of the Han dynasties. Sinicization, however, took many more centuries and reached its greatest flowering in the Canton delta region during the T'ang period. West of this region in the Yunnan-Kweichow plateaus, however, a Sinicized T'ai power lingered on through the T'ang and Sung periods in the state of Nan-chao, at times strong enough to pose threats to the stability of the T'ang empire. The successor to this state, Ta-li, withered under the Mongol onslaught directed by Kublai Khan, and T'ai political genius moved across the southern borders of Yunnan into the Mon-Khmer cultural sphere in the basin of the Chao Phya river where it evolved the present state of Thailand.\n\n7\n\nT'ai autonomy within southwest China continued in smaller units in the lake and river basins of Yunnan near the Burma borders until the Communist conquest of China.         "content_text": "PERSIANS, ARABS IN T’ANG CHINA\n\n59\n\nManichaean whose doctrines were proposed to the court in A.D. 694.5 There were students from Japan, who, after enjoying a few years of study on Chinese classics, preferred to remain in China permanently. There were also aristocratic Tibetan youths sent by their parents for traditional Chinese scholarship. There were Khoten painters who later became great masters in Chinese artistic circles. There were Sogdians, who introduced polo to the Chinese. Above all, there were Persians and Arabs, whose activities and contributions had tremendous influence on T'ang political and social history.\n\nI\n\nMany Persians, Arabs and others lived in Tang China. The Turks, Uighurs, Tocharians, Sogdians, Koreans and Japanese for the most part lived in Ch'ang-an and the Chams, Khmers, Javanese and Singhalese in Canton. Persians and Arabs, however, were also to be found in these two places and in Yang-chou and Ch'üan-chou as well. All these foreigners in the early Tang period shared the same kind of life as the T'ang Chinese. In A.D. 714, the T'ang government had to establish a special office known as Shih-po-ssu (Superintendent of Customs) to look after the foreign affairs in Canton and in other cities along the coastal region.\n\nForeigners in T’ang China were not all law-abiding. Uighur nationals sought out Chinese businessmen and young Chinese wastrels and made shady deals with them in the capital. Persians and Arabs, on the other hand, would lure young beautiful Chinese girls to become part of their possessions and even engaged in the slave trade in Canton. Also, some of them would purposely encourage those Chinese who were in need of money to pledge their land, furniture and sacred relics for ready cash.\n\nThe Chinese pawn-shop came into being in late T’ang period and this kind of practice is believed to be the embryo of the modern pawn-shop. The moneylenders' business was regarded as a plague in the beginning of the ninth century and the emperor had to issue a decree in A.D. 822 prohibiting such practice or every Chinese in the Empire would be in debt.7 The Turks were as notorious as the others.         "content_text": "NOTES AND QUERIES\n\nVISIT TO THE SUKHOTHAI SITES IN THAILAND\n\n163\n\nThe first overseas tour of the Hong Kong Branch of the Royal Asiatic Society went to Thailand from 1-6 February 1973. Twenty members took part.\n\nThe purpose of the tour was to visit the historical sites of Sukhothai, Srisachanalai and Kampengpetch in the centre of the country; these are the abandoned cities of the Sukhothai kingdom which asserted its independence from the Khmers about 1220, reached its apogée under Ramkamheng (r. ± 1275—1317), and declined after the foundation in 1350 of Ayuthia, which subjugated the northerly kingdom in 1378, when the Sukhothai king, Mahadharamaraja II, transferred the capital to Pitsanuloke to reign as a vassal of Ayuthia. The Sukhothai kingdom is famous for its export celadons which in recent years have found their merited place in world porcelain collections for their originality and texture.\n\nHowever, the tour first stayed in Bangkok and, using a converted rice barge, saw some old temple paintings in Dhonburi and Nonthaburi.\n\nWat Chalermprakiad on the Chao Phrya River is a picturesque and half-ruined temple built by King Rama III in memory of his mother. The temple is surrounded by a double wall, the inner one having square towers with circular openings showing the strong Chinese artistic and architectural influences in Siam during that king's reign (1824-1851). The building to the right of the central edifice is in a state of total ruin, but still has its original doors and windows with their lacquer and mother-of-pearl exteriors and their lotus-painted red and blue interiors. Those of the main building, which is in a far better state of preservation, are predominantly red and green. There is excellent stucco work over the doors and windows and broken porcelain is used for characteristic decoration on the roof lines. The rustic setting of the temple, with its teak kuti or monks' houses surrounded by rain trees and breadfruit trees dominated by the tapering white chedi in the centre, left a strong impression of dignified serenity.\n\nWat Po Bang O, off Klong Bangkrouay, is a small old temple also in rural surroundings which has interesting examples of original 18th century paintings with some 19th century overlay showing",

        "content_text": "NOTES AND QUERIES\n\n165\n\nments which were capable of delicate romance and noisy battle music.\n\nA tour through the large compound of the National Museum gave a perspective of the best examples of Thai art from the Dvaravati to the Ratanakosin periods. The latest discoveries of pots from Ban Chieng, thought to date from approximately 5,000 BC, were on display. In a museum as packed with treasures as this is hard to select any one piece as particularly outstanding; certainly the magnificent Avalokitesvara from Chaiya and some of the early Khmer pieces were much appreciated. The museum has the added advantage of containing the buildings of the former palace of the second king, which themselves are attractive and include the chapel of Buddhaisawan with its large lacquer cupboards and fine frescoes. The lavish carving of the royal funeral carriages, the rajarot, was also noted.\n\nThe group visited Suan Pakkard Palace in Bangkok, the home of H.R.H. Princess Chumpot of Nagara Svarga, whose large collection of antiques, including some fine Ban Chieng and Sukhothai pieces, is elegantly and informally arranged in adjoining traditional Thai houses modernised for contemporary living. The grounds also contain the only lacquer pavilion to survive the Ayuthia period; with its fine decoration it has been restored to its former grandeur. After visiting the palace the members of the tour were entertained to lunch by Her Royal Highness.\n\nPitsanuloke was used as a base for the visit to the Sukhothai area. In that city Wat Mahathat with its exceptional polished bronze statue of the Sukhothai period, Phra Buddha Chinarat, was seen. At Sukhothai itself some time was spent in the vast area of Wat Mahathat, strewn with ruined chedi, chapels and ante-chapels, where there is a number of stucco Buddha statues recently restored. The well-preserved Khmer style temple Wat Si Sawai, with its three symmetrical prang and double enclosure of brick and laterite was in its severity in marked contrast with the ebullience of Wat Mahathat. The ruins of Wat Trapan Ngoen and Wat Sra Si and their moats were noted, the massive walled Wat Si Chum was visited, with its vast and contemplative Buddha open to the sky surrounded by high walls with a hidden staircase in their mass, up which the adventurous climbed. The site of the ancient celadon kilns, Tao Turiang, was seen and Wat Saphan Hin, at the end of a long stone path up a hill from which it gets its name, offered a fine view over",

These are the 19th century temples in wood. The Shwenandaw was built by Thibaw in 1880, five years before he was taken away in captivity by the British and the kingdom ended. Most of the materials came from part of a palace occupied by King Mindon which was dismantled. The elaboration of the carving is overwhelming and one suspects that to like it, after the sober majesty of Pagan, is to border on bad taste. The Shweinbin to the south of the city is even more elaborate, and still being a very active monastery the monks' saffron robes form a strong contrast to the teak wood greying with age, sun and rain on the outside. Like all wooden buildings these temples are raised above the ground on pillars and the space beneath is used for storage.\n\nMandalay has few other temples of note; those on the hill are mostly modern, and the Kuthodaw near its base dates from 1857 and is more important for the 729 stone slabs containing all the Buddhist scriptures which King Mindon had made for the Fifth Synod. The authorized version of the Tripitaka was inscribed on the slabs, each beneath its own vaulted canopy. Atumashi was built in 1880 and resembles more an Italian palace, but as only the base remains after a fire in 1890 it is hard to judge fairly. The Mahamuni was rebuilt after a fire in the 19th century and is architecturally without interest. The gold-covered bronze image is much revered and seen at night with chanting monks and the faithful at its feet is impressive.\n\nThe most interesting thing in the temple, apart from the stalls lining the temple approach, are the six bronze figures in one of the adjacent buildings. They are two of men, one probably a warrior, three of lions, and one of a three-headed elephant (erewar) and are undoubtedly Khmer, possible of the 12th century. They were probably taken by the Siamese at the sack of Angkor in the 15th century and removed to Ayuthia. The Burmese king Bayinnaung took them from Ayuthia when he sacked the city in 1563 to the then capital at Pegu. King Rajagyi of Arakan took them as spoils of war from Pegu and they were taken from Arakan by Bodawpaya in 1784 to Mandalay.\n\nThe journey to Sagaing takes one past the numerous sites of the capitals of the Alaungpaya dynasty which estimated that a new centre would give a new direction to adverse fortune associated with the old. In this way Shwebo was capital from 1752 to 1765, Ava from 1765 to 1783, Amarapura from 1783 to 1823, Ava again",

Even at the best of Chinese times local families enjoyed \"virtual autonomy from the imperial court\" (p. 163).\n\nRebellion against Chinese rule, indeed, was endemic throughout the later phases whether peasant led or fomented by leading families. The whole confrontation culminated in the major clashes with T’ang officialdom in the ninth century, which also saw an uneasy alliance of some Vietnamese factions with the inland Nan Chao kingdom.\n\nFor all his development of the Vietnamese pre-Chinese roots, this is not a unique position. Taylor's contention that scholars have tended to neglect this aspect (p. xvii) is not borne out by the work of others such as D.G.E. Hall (see his History of Southeast Asia, MacMillan, 1955) and George Coedes (see his The Making of Southeast Asia, Berkeley, 1966).\n\nIn spite of a heavy emphasis upon anti-Chinese rebellion and the throwing-off of Chinese rule, and earlier of the inculcation of Chinese cultural models, Vietnam at independence in the tenth century was not only a very impoverished and ravaged land, but also a pretty rude place. There was nothing of note in buildings; cultural levels were far below those expected in a T'ang province; and nothing to compare favourably with the grand styles of the contemporaneous Champa and Khmer kingdoms to the south and west.\n\nThis is an absorbing book, and a valuable contribution as filling some gaps in our knowledge of ancient Vietnam.         "content_text": "He served with the 8th Army in North Africa, where as an officer cadet he was among those deployed to surround the Abdin Palace, King Farouk's residence in Cairo, while tanks were moved into the square, a show of force to oblige the King to call on the Wafd leader Nahas Pasha to form a government.\n\nGibb was then with the 8th Army in its drive into Italy, before transferring to Intelligence, to be parachuted into Yugoslavia to join the British units helping Tito's partisans.\n\nAfter the war in which he was mentioned in despatches - Gibb returned for a short time to work at Lloyd's before going to the Far East as a journalist for the Sunday Times and other papers.\n\nIn Singapore he switched to photography and was one of the first to realise the potential of 16mm film for television. Operating from South-East Asia and the Far East, he quickly became a master of documentary film.\n\nA key point in Gibb's career as a film-maker occurred in the Great Caves of Niah in Borneo in 1954, when he watched the dangerous process whereby birds' nests were gathered from the roofs of the caves and turned into delicacies for the Chinese table: out of that moment grew his prize-winning Borneo series.\n\nDrawn by the legendary appeal of the Angkor complex of ruins, Gibb rebased himself in 1960 in Phnom Penh, the capital of Cambodia, to which he drove from Singapore in his Land Rover.\n\nGibb's enduring interest in Khmer architecture and sculpture, of which Angkor is the supreme expression, was accompanied by an awareness and admiration for the French archaeological achievement in Indo-China. He became a close friend of the late Bernard-Philippe Groslier, the last French curator of the Angkor ruins, and was a frequent guest at the Conservation in the days before Cambodia was engulfed by turmoil.\n\nThis Anglo-French intellectual entente proved to be an enduring influence on Gibb's work. Earlier this year Gibb was in close contact with the Ecole Francaise d'Extreme-Orient, which was interested in his films for their archives; and his Angkor films are to be shown at a commemorative ceremony at the Musée Guimet in October.\n\n¦\n\nXV",

In April 1975, the Khmer Rouge took power in Cambodia, after the defeat of Lon Nol's Khmer Republic forces, and entered Phnom Penh. Under the leadership of Pol Pot, the Khmer Rouge remained in power for nearly four years, pursuing policies which resulted in the death of nearly two million people through execution, starvation, and disease. The question of a tribunal to bring those responsible to justice has been on the drawing board for several years but has yet to materialise. Roderick has lived and worked in Cambodia and provides a factual, objective and unemotional account of the tragedy of Cambodia and what may lie ahead.\n\nThe exploits of H.M.S. Hermes on the China Station in the 1930s occupy Jonathan Parkinson. Hermes was the Royal Navy's first purpose-built aircraft carrier and was, by all accounts, a happy ship. She was ultimately sunk by the Japanese off Batticaloa in 1942; a sad end to a distinguished career spanning nearly 20 years.\n\nWhere would our Journal be without the redoubtable Keith Stevens? Keith has produced another splendid article for this volume. It recounts the Russo-Japanese War fought largely on Chinese soil - and with scant regard for the Chinese people who suffered greatly - almost exactly 100 years ago.\n\nThe Notes and Queries section is an important miscellany of this and that. Each little and not so little piece represents an investment in time and effort by the individual concerned. Included is another piece on the Chinese Labour Corps in Europe during World War I (See The Chinese Labour Corps in France, 1917-1921, Vol. 40, JHKBRAS, pp. 33-111, and various Notes and Queries in Vols. 41 and 42); some interesting photos which I will leave readers to mull over themselves; a further moving piece (which was almost an article) on Samuel Cornell Plant by his nephew Michael Gillam no less (see The Life and Times of Captain Samuel Cornell Plant, Vol. 41, JHKBRAS, pp. 407-416); a note on the Belilios Star (Hong Kong's official life-saving medal); and a piece on what became of the Tyndareus Stone which used to adorn the sitting out area beneath High West (Victoria Peak) before it was plundered - I see no other word for it - by the British Army in 1993.",

But there was internal armed conflict within Cambodia, and the war in Vietnam also overflowed into Cambodia in the late 1960s and early 1970s.\n\n1970-1975 The Khmer Republic\n\nWhile the King was absent, General Lon Nol and Prince Sisowath Sirik Matak deposed him, and declared a republic. Nevertheless, the new Republic failed to gain effective military control of the whole land, despite continuous fighting with internal and external opponents, among them the Khmer Rouge,\n\n1975-1979 Democratic Kampuchea (DK)\n\nIn April 1975, the Khmer Rouge took power, after the defeat of Lon Nol's Khmer Republic forces, and entered Phnom Penh. Under the leadership of Pol Pot, the Khmer Rouge remained in power for nearly four years, pursuing policies which resulted in the death of nearly two million people through execution, starvation, and disease.\n\n1979-1989 People's Republic of Kampuchea (PRK)\n\nIn 1978, the Vietnamese army advanced into Cambodia, and together with Khmer Rouge defectors, overthrew the Khmer Rouge regime. The new government, the People's Republic of Kampuchea, did not enjoy wide international recognition, and at the same time continued armed conflict with the Khmer Rouge and other forces within the country.\n\n1989-1993 The State of Cambodia\n\n[1992-1993 United Nations Transitional Authority (UNTAC)]\n\nWith the withdrawal of Vietnamese forces, the name of the country was changed to distance the new government from the Khmer Rouge period, and the use of “Kampuchea\".         "content_text": "91\n\n1993-now Kingdom of Cambodia\n\nSihanouk returned as king, and the name Kingdom of Cambodia was again used. The Khmer Rouge withdrew from participation in the political process, and continued armed conflict until 1997. As the military strength of the Khmer Rouge declined, this conflict became more and more sporadic.\n\n2. The proposed Tribunal\n\nThe atrocities of the Khmer Rouge began to be documented in the period of the People's Republic of Kampuchea. For example, the S-21 \"Tuol Sleng\" was established from 1975 to 1978 as a security office for interrogation and extermination of prisoners. The site, in a suburban Phnom Penh high school, has been a museum to the victims since 1980. Assessment and documentation of the many cases has continued through the subsequent two decades, and a substantial record is maintained by the Documentation Centre of Cambodia (DC-Cam).\n\nIn 1979, the PRK government had held a trial, in which Pol Pot and Ieng Sary were convicted and sentenced to death in absentia for their crimes. However, the trial was not accepted internationally because of concerns about the processes, and because of the diplomatic isolation of the PRK government.\n\nResponses to the atrocities in the former Yugoslavia, and in Rwanda, included the establishment by the United Nations of international tribunals at The Hague and at Arusha, respectively. International pressure for some kind of legal resolution of the atrocities in the period of Democratic Khmer also increased, as did pressure within Cambodia itself.\n\nIn 1997, the Cambodian government asked the United Nations for assistance in organising a process for the Khmer Rouge trials. This led to the adoption of a resolution in the UN General Assembly in December 1997, enabling the Secretary-General to negotiate. Negotiations dragged on, with Cambodia producing a draft law in 1999, and that law passed the National Assembly in 2001.2 The United Nations negotiator, Hans Correll, objected that the law did not give effect to the agreement between the United Nations and the Royal Government.         "content_text": "93\n\nThe crimes within the jurisdiction of the Extraordinary Chambers are crimes under Cambodian Penal law, crimes of genocide, crimes against humanity, crimes against the Geneva Conventions, and crimes under other international agreements applicable to Cambodia.\n\nThe word \"tribunal\" is convenient to briefly describe these Extraordinary Chambers.\n\n4. Retributive Justice\n\nJustice is a complex concept. It will be dealt with under three headings: Retributive Justice, Restorative Justice, and Distributive Justice.\n\nRetributive Justice is concerned with both the rewarding of good and the punishment of evil. Commonly, we think of retribution largely in terms of punishment and revenge. It underlies many of the criminal law systems of the world, and the simplest expression is that the perpetrator of a crime deserves to be punished for her or his offences. So, those who have suffered under the Khmer Rouge seek retribution for their suffering by the punishment of those responsible for the suffering.\n\n4.1 Retributive Justice and Closure by Legal Statement:\n\nA legal process can bring closure to injury by coming to an official conclusion that one party was right, and another was wrong. The punishment involved represents a legal quantification of the degree of injury. For many victims, a legal process can bring a clear reversal of the verdicts of the Khmer Rouge, and re-establish their sense of rightness both individually and before the community. Such a closure enables people to leave an injury behind, and move on in their lives.\n\n4.2 Retributive Justice and a Culture of Impunity:\n\nThe fact that such grave crimes remained unpunished contributes to a culture of impunity which continues in Cambodia.         "content_text": "94\n\nconcerned that if there were no trials, it would aid and abet Khmer Rouge impunity.\n\nIn this sense, retribution operates both internationally and nationally. Retribution acts as a deterrent to those who may think of establishing regimes like those of the Khmer Rouge. But it also supports efforts to re-establish the rule of law within Cambodia itself by the example of punishing such grave crimes.\n\n4.3 Retributive Justice and Revenge:\n\nRevenge has been a constant in human history. It can be seen as a self-help response to an offence, in order to ensure that there is no impunity. Traditional literature has brought down to us many examples of the social obligation to revenge an offence, and the attempts to channel and limit that obligation through a legal system.\n\nIf there is no effective legal system to undertake the institutional revenge of a people, then the way is open for private revenge. Ultimately, this is socially destructive, and can lead to a never-ending cycle of revenge without closure.\n\n4.4 Retributive Justice and Individuals:\n\nTrials are focussed on individual perpetrators of guilt. In this way, individuals must accept accountability for their acts and omissions. One advantage of this process is that it avoids loading accountability on to a community or group, and avoids the stereotypes leading to ideas of collective guilt. These stereotypes are likely to lead to further violence, creating an unbreakable cycle of violence.\n\nWhile retributive justice is a key component of the legal system, it is insufficient by itself to lead to reconciliation. This leads us to two additional aspects of justice, restorative justice, and distributive justice.\n\n5. Restorative Justice\n\nRestorative Justice is concerned with restoring the parties, as far as possible, to their original position. In a sense, it is more about \"rights\" and less about “wrongs.”",

        "content_text": "95\n\n5.1 Restorative Justice and the Individual Criminals\n\nCriminal justice systems, both nationally and internationally, focus on the perpetrator of crimes. The central person in the criminal trial is the perpetrator as defendant, and it is his or her rights in the process which are usually the subject of attention. Certainly, restorative justice has a role for the perpetrator, and through trial and imprisonment works to restore harmony in the community through restoring the wrongdoer to the community. If there is no chance of restoration, the wrongdoer has no process for acknowledgement of crimes, for forgiveness, and even no process for accepting appropriate punishment. Unless the wrongdoer can be included in the restorative process, there is no choice but to remain an “out-law”,\n\nBut the boundary between perpetrators and victims may not be clear. A specific problem in the Cambodian story has been that perpetrators have themselves been victims. For example, child prisoners of the Khmer Rouge were brutalized and themselves became perpetrators. The brutalization of children and their use as perpetrators is also known in other conflicts, for example in Uganda and in Sierra Leone.\n\n5.2 Restorative Justice and the Individual Victims:\n\nGenerally speaking, trial systems which focus on the perpetrator are not sufficiently attentive to the individual victims. Indeed, the process of a trial, with its necessary testing of evidence, may operate to \"re-victimise\" the victim. Restorative justice demands a process in which the restoration of the victim is also a key focus. At the international level, the Tribunals for the former Yugoslavia and for Rwanda gradually developed procedures for the protection and counselling of witnesses, usually victims. The procedures of the new International Criminal Court have taken a step forward by providing for compensation for victims, as well as protection and counselling.\n\n6. Distributive Justice\n\nDistributive justice is concerned with the allocation of resources and of opportunities within a society - including international societies.         "content_text": "96\n\non Civil and Political Rights, and the International Covenant on Social, Cultural and Economic Rights, in claiming that rights inhere in individuals and in communities to a fair allocation of the earth's resources and opportunities. This includes access to the legal system.\n\n6.1 Distributive Justice and a Fair Trial\n\nMany international conventions and other instruments emphasise the right to a fair trial, although they may differ in practice as to what such a trial might involve. Article 13 of the Agreement of March 2003 refers to the right to a fair and public hearing, to be presumed innocent until proved guilty, to engage a counsel of his or her choice, to have adequate time and facilities for preparation of defence, to have counsel provided if lacking means to pay for one, and to examine the witness against him or her.\n\nThe issue which caused the United Nations to withdraw from negotiations with the Royal Government was the question of a fair trial. The Khmer Rouge had particularly targeted intellectuals of various kinds, including lawyers. The courts formed in the aftermath of the Khmer Rouge regime were created using judges with few if any legal qualifications. Prosecutors had even less legal formation.1 Besides the lack of trained personnel, participants and commentators have drawn attention to the lack of independence of judges and prosecutors, who are subjected to government interference.1 The recent history of Cambodian governments suggests that the concept of judicial independence is an alien concept: courts are expected to respond to government directives.1 Even in the absence of interference, the prosecutors may claim that they lack the funds to carry out investigations.\n\n6.2 Distributive Justice and Fair Trials\n\nDistributive justice requires that like cases should be treated alike. But the proposed tribunal for the Khmer Rouge is limited in jurisdiction to one period in Cambodia's history, the period of Democratic Kampuchea. Yet commentators have pointed out that there may have been breaches of law committed by other participants in the long-running wars which have affected Cambodia.12 If these are excluded from scrutiny, then the legal process becomes a kind of \"victor's justice\"",

        "content_text": "99\n\n7.2 From Truth to Reconciliation:\n\nOne of the more successful examples of such a structure is the Truth and Reconciliation Commission process in South Africa. But a limitation is apparent: while the Commissions may be able to discover the truth, this does not automatically lead to reconciliation. Reconciliation is a more complex process, involving acknowledgement of fault (perhaps on both sides), a change of heart or repentance, a giving and receiving of forgiveness, and a desire to walk together again. The law is a very limited instrument, and cannot by itself bring about internal change.19\n\nReconciliation also requires sensitivity to the particular culture of those involved. The primary source of meaning for many Cambodians is their religion. The majority are Buddhist, and the process of reconciliation needs to be based on a Buddhist understanding of what reconciliation means. But Buddhism, as with other religions, suffered great losses during the period of Khmer Rouge rule, and both monks and people may lack the religious sophistication to approach the task well20. One of the questions, for example, is the Buddhist belief in Karma, which sees suffering in this life as the consequence of wrong-doing in a previous life. If taken in an over-simplified way, this may lead to blaming the victim of atrocities for their suffering, and taking the focus away from the perpetrator.\n\nAlthough Buddhism is the principal religion of Cambodia, and is the state religion, observations have suggested that the generation who were formed during the period of Democratic Kampuchea may not be committed to religion, and may indeed be in practice secular.21 Their approach to reconciliation will be different from the approach of those who are deeply rooted in Buddhism.\n\nSmaller groups in Cambodia are the Muslims (especially the Chams and those of Malay descent) and Christians. Both groups were particular targets of the Khmer Rouge. Both religions have sophisticated approaches to reconciliation, although because of the years of troubles, individual Muslims or Christians may be poorly informed about these approaches.",

        "content_text": "100\n\n7.3 Ending hostilities:\n\nIn many cases, especially during a civil war, a clear military victory may be immensely costly in terms of combatant and civilian lives. A priority for a government or other party may be simply bringing the armed conflict to an end. But a combatant party may be unwilling to give up its armed power, if it means that the party retaining arms will wreak vengeance.\n\nIn this situation, many governments have offered amnesties during the conflict to persuade the parties to lay down their arms. Without some kind of amnesty, it may not be possible to persuade the combatants to give up fighting. Sometimes amnesties have applied to all combatants, including the leadership, while at other times governments have tried to drive a wedge between leaders and followers by excluding leaders from the amnesties.\n\nIn the Cambodian situation, the Khmer Rouge remained a powerful military force well into the 1990s, and continued to have support from abroad. In these circumstances, the Cambodian government repeatedly offered amnesties - and even inclusion in the government - to persuade the leadership of the Khmer Rouge to give up their military campaigns, and offered Khmer Rouge combatants incorporation in the government's armed forces, at equivalent ranks.\n\n23\n\nOne result of such a policy is that perpetrators and victims may find themselves together in the post-conflict society, with all their issues unresolved.\n\nThe existence of these amnesties will create a problem for the Tribunal. Article 11 of the draft agreement initialled in March 2003 provides that the Royal Government will not provide amnesties. Only one amnesty, in 1996, is recognised, and the validity of that amnesty will be a question for the Tribunal to resolve.\n\n7.4 Building a post-conflict society:\n\nAfter a long period of conflict, a common desire is to move on to a new and peaceful situation.         "content_text": "101\n\nissues may be left unresolved, at least there is some hope for the future, and concentration on building a peaceful future can be a common task, uniting former enemies.\n\nWhere the end of the conflict has not been achieved through military victory, but through a negotiated settlement and through the use of amnesties, the settlement may be too fragile to bring perpetrators to justice. This is especially the case where there have been too many injustices, and where all sides to a conflict have something to fear.\n\nThe current Cambodian Prime Minister, Hun Sen, has used this kind of language to argue against legal resolution of old injuries, saying in 1998: “If the wound does not hurt, should we poke a stick into it and make it bleed again? If we bring the pair [Nuon Chea and Khieu Samphan, who defected from the Khmer Rouge to the government in December 1998] to prison…it could lead to renewed civil war.”24\n\nAn additional factor in the Cambodian situation is the time that has elapsed since the end of the Khmer Rouge rule: nearly a quarter of a century has elapsed, and many of the protagonists have died. \"Brother Number One\" of the Khmer Rouge, Pol Pot, died on 15 April 1998. Half of the Cambodian population has been born since that time. The issues are important, but they do not have the same importance for those who were not directly involved.\n\nOne writer has suggested that the policy of trial of a few leaders, and exemption for the mass of perpetrators, is the \"middle way\" policy for Cambodia, and the most likely to contribute to building a peaceful future.25\n\n8. Conclusion\n\nThe past, and in particular the scale of the atrocities under the Khmer Rouge, necessitate a tribunal which can deliver retributive justice is still a requirement despite the long passage of time since the events in question. The future, including both the personal resolution of issues for victims, and the dismantling of a culture of impunity, also necessitate such a tribunal. In practice, the Extraordinary Chambers will be limited to a few cases, and will not be responsible for retributive justice across the whole population.",
