        "content_text": "NOTES AND QUERIES \n\nTHE TSANG'S BIG HOUSE IN SHATIN \n\n125 \n\nThe Tsang's Big House, with its bluish bricks, green tiles, thick walls, strong iron gate, and a history of more than 120 years, is probably the oldest building in Shatin. It is fifteen minutes' walking distance from Shatin Market. \n\nThe Big House has an interesting history, which can only be touched upon in this note. Its site was formerly a deserted sandy beach near a Shatin hillside. The house was built by Tsang Kwan-man, who had immigrated from his native town in Wu-wah (24) to settle in Shaukiwan on Hong Kong Island. There he established himself in the stone quarry business, and soon became rich. Tsang later moved from the island which was ceded to Britain to live in Shatin, which then belonged to the District of Pao-an under Chinese jurisdiction. \n\nTsang used coarse sand to reclaim the beach from the sea, and built the Big House on the reclaimed site. Strong solid stones were used for the foundation, and bluish bricks for the surrounding walls, which were then plastered with the ashes of grass roots. Although it was built in traditional style, it is said to be no less strong and solid than modern skyscrapers constructed by machinery. \n\nWhen the Big House was first completed, it was inhabited only by Tsang and his wife. However, they employed many servants and workers to exploit the virgin land in the vicinity for productive purposes. They gave birth to six sons, and the descendants multiplied. The Tsang family on this site is now in its sixth generation. \n\nDuring the reigns of Emperors Chien-lung and Chia-ching in the Ch'ing Dynasty, the Tsangs often contributed gold to the Government in return for official titles. These were limited to a certain rank in the officialdom, and did not carry any definite appointment in authority or official duty, being somewhat similar to the title of Justice of the Peace conferred by the Hong Kong Government. With the official title the Tsangs were entitled to hang a guilded board in their Big House with characters Ta-fu ti (✯✯✯) carved on it, meaning \"The residence of an official,” distinguishing it from the houses of commoners.",

        "content_text": "CHINESE UNOFFICIAL MEMBERS OF COUNCILS\n\n11\n\nfor nomination by the Governor. The new Council met on 28th February, 1884, and consisted of 6 officials excluding the Governor: the Chief Justice, the Colonial Secretary, the Attorney General, the Surveyor General, the Colonial Treasurer, and the Registrar General. There were also 5 unofficials: Mr. T. Jackson (elected by the Chamber of Commerce), Mr. F. D. Sassoon (elected by the Justices of the Peace), Messrs. P. Ryrie, F. B. Johnson and Wong Shing, appointed by the Governor.\n\nThus in 1884 Wong Shing became the second Chinese to serve on the Legislative Council as an unofficial member. He too was a Cantonese from Chung Shan District. In 1841 he entered, with two other Chinese boys, Yung Wing and Wong Foon, the Morrison School in Macao which was later transferred to Hong Kong. In January 1847, Dr. Robbins Brown, an American teacher in the Morrison School, had to leave China on account of ill health. He offered to take a few of his old pupils back to America for further education. Yung Wing, Wong Foon and Wong Shing signified their desire to go and, through Dr. Brown and the Morrison Education Society, expenses for two years for the three boys were arranged. They embarked at Whampoa on the ship \"Huntress\" and proceeded via the Cape of Good Hope, the journey taking more than three months. Upon arrival in the U.S.A. the three boys were admitted to the Monson Academy at Monson, Massachusetts.\n\nAs a result of ill health, Wong Shing did not manage to acquire any academic honours during his sojourn in the United States. On his return to China he was offered an appointment in the Foreign Ministry. He served with Viceroy Li Hung-chang and Marquis Tseng Chi-tze and was a member of the Chinese legation staff in Washington. He resigned later from the Chinese diplomatic service and came to Hong Kong as a merchant. He was also associated with the Anglo-Chinese College and with the London Missionary Society for which he directed its printing establishment under Dr. James Legge. When the Tung Wah Hospital was founded in 1870, he was a founder director. He was naturalized in December 1883 and was appointed to the Legislative Council in February 1884. He was described as a man of property, much-travelled, speaking good English and fully qualified to “look at Chinese affairs with English eyes and at English affairs with Chinese eyes\". This at least had the merit of demonstrating that no hazard was likely to result from having a Chinese representative permanently on the Legislative Council. When his six-year term was up in 1890, he asked not to be re-appointed, and a very prominent \"local boy\", Dr. Ho Kai (later Sir Kai Ho Kai) succeeded him.\n\nDr. Ho Kai, born in Hong Kong in 1859, was the fourth son of the Rev. Ho Tsun-shin (alias Ho Fuk-tong) of the London Missionary Society. Having studied Chinese for several years, he was admitted to Class 4 of the Central School in 1870 at the age of 12. He was an extremely clever and hardworking boy for, according to the school record, he was already in Class 1, the top form, in September 1871. He completed his studies at the Central School the following year, and proceeded to Palmer House School, Margate, England. From there he entered St. Thomas' Medical and Surgical College and received the degrees of Bachelor of Medicine and Master of Surgery from the University of Aberdeen in 1879. In the same year, he was admitted as a member of the Royal College of Surgeons of England by examination. He then turned to the study of law and was admitted to Lincoln's Inn in May 1879. He was Senior Equity Scholar, Lincoln's Inn, in 1881 in which year he passed the finals with flying colours and also married a charming English girl, Alice, the eldest daughter of the late John Walkden of Blackheath. On his return to Hong Kong in 1882 with his newly-wedded wife, he first practised medicine but was unsuccessful, because the Chinese at that time were not prepared to avail themselves of western medical treatment unless it was offered free. He then turned to the Bar and since 1882 had practised as a barrister in Hong Kong.\n\nUntil his death in 1914, Dr. Ho Kai rendered his services freely and ungrudgingly to the Hong Kong community. For many years he was a valuable member of many important committees, including the Standing Law Committee, the Public Works Committee, the Examination Board, the Medical Board, the Sanitary Board, the Po Leung Kuk Committee, the Tung Wah Hospital Advisory Committee, the District Watch Force Committee, the Architects' Advisory Board and the Advisory Committee of the Hong Kong Technical Institute. CHENG \n\nDr. Ho died in September 1914 at the age of 55 leaving over ten sons and daughters by his second wife who was a Chinese. \n\nThe fourth Chinese to serve on the Legislative Council was Wei Yuk, son-in-law of Mr. Wong Shing. He had another name Wei Bo-shan17 and Po Shan Road is named after him. He was born in Hong Kong in 1849 of a wealthy family, his father, Wei Kwong, being compradore to the Hong Kong branch of the Chartered Mercantile Bank of India, London and China (now the Mercantile Bank Ltd.). After many years of Chinese studies under private tutors, he entered the Government Central School. In 1867, at the age of 18, he proceeded to England to attend the Leicester Stoneygate School. In 1868 he went to Scotland and studied for four years at the Dollar Institution. After a European tour, he returned to Hong Kong in 1872 and then worked in China for a short period. When his father died in 1879 he succeeded him as compradore to the bank. He was a very public-spirited citizen, well-known for his charming manners and pleasant personality. In 1880 he was elected a director of the Tung Wah Hospital and in 1887 became its Chairman. He was appointed a Justice of the Peace in 1883. \n\nWei Yuk's appointment to the Legislative Council was additional to and not in replacement of Ho Kai, and came about as follows. \n\nDuring 1894, the Governor, Sir William Robinson, forwarded to the Secretary of State a petition signed by the Honourable Messrs. Thomas Whitehead, Paul Chater, Ho Kai and other residents in the Colony, asking for unofficial membership in the Executive Council; \"free election of representatives of British nationality in the Legislative Council\"; \"a majority of such representatives in the Legislative Council\"; and freedom of the official members to vote according to their conscientious convictions.18 \n\nThe Secretary of State, Lord Ripon, criticized the petitioners' demands as lacking in clarity on the ground that the petitioners \"asked for the free election of representatives of British nationality without reference to the qualifications of the voters\". Thus if the petitioners intended that only those from the British Islands should vote and be eligible for election, this would exclude the Chinese who comprised nine-tenths of the entire population.         "content_text": "KING MONGKUT AND THE KINGDOM OF SIAM\n\n87\n\nPursuing this conciliatory line Brooke came to Bangkok determined to win the confidence of the Siamese and to allay their fears. He wrote to a friend:\n\n\"I shall not seek to make a treaty in a hurry. I shall try to remove apprehensions and obstacles and pave the way for the future. The King is old and a usurper; he has two legitimate brothers, clever and enlightened, who ought to be raised to the throne.... A treaty extorted by force would be but a wasted bit of parchment... The Prince Chow-fa Mongkut is an educated man, reads and writes English and knows something of our literature and science\".2\n\nWith such admirable sentiments Rajah Brooke arrived at the mouth of the Menam. Everything went wrong. The Sphinx ran aground attempting to cross the bar at Paknam. When he met the Praklang (the Foreign Minister), every point he raised was opposed. Was there any need for a treaty? What was wrong with the Burney treaty of 1826? When Brooke asked for more freedom of trade the Praklang replied that trade was already free. As for the British having a Consul at Bangkok and being exempt from Siamese law, both proposals were unnecessary and improper. Later talks with the Siamese Ministers made no more progress. They asked Brooke to put his points in writing but letters between the two sides made no more progress than conversations. It was clear that the Siamese did not want a treaty or any improvement in trade or diplomacy with Britain.\n\nThe Brooke mission was obviously failing. And as frustration grew Sir James's conciliatory attitude changed. Finally he advised force. In a dispatch to the Foreign Minister he wrote:\n\n“Should these just demands firmly urged be refused, a force should be present immediately to enforce them by a rapid destruction of the defences of the river which would place us in possession of the capital and by restoring us to our proper position of command, retrieve the past and ensure peace for the future, with all its advantages of a growing and most important commerce.\"3\n\nBrooke alleged, with some justice, that the Burney Treaty had been broken by the Siamese.         "content_text": "KING MONGKUT AND THE KINGDOM OF SIAM\n\n95\n\nSiamese were willing to have a treaty which would open up trade and increase Western influence. They had some anxiety, however, about what the Cochin-Chinese, the Vietnamese would think about the treaty. Would they conclude that the Siamese had surrendered to the British? King Mongkut asked Bowring time and again to go to Cochin-China to make a similar treaty. The King was also anxious about the kind of man who would be chosen as British Consul, if this article of the treaty were accepted. Would he be as much a gentleman as Sir John? Bowring assured him that only the best man would be appointed and that he hoped to go to Cochin-China.\n\nThe whole business for this momentous treaty was transacted in the most felicitous manner. King Mongkut and his equally intelligent Prime Minister, Praya Suriwongse, understood the issues at stake; these were not merely the details of imports and exports, the appointment of Consuls and the rights of foreigners, they were no less than the independence of Siam and the beginning of her modernization. It was much to Bowring's credit (and to Harry Parkes and young Bowring) that he was able to gain the confidence of the King, to allay his fears, and to assure the Siamese that the new policy that the treaty was launching was greatly to their own as well as to the British advantage.\n\nThe Treaty of Friendship and Commerce was signed on 18th April, 1855, less than a month after the arrival of the mission. Its first article pledged perpetual peace and friendship and the protection of the two nations' subjects in each other's countries. Article 2 provided for the appointment of a British Consul at Bangkok who would have jurisdiction over British subjects in Siam. The third article was an extension of the second, requiring that Siamese offenders should be given up to Siamese justice and British offenders to British justice, that is, the Consul. This was the system of extra-territorial rights which had recently been obtained from the Chinese after the Opium War. It was an infringement of Siam's sovereignty but it gave assurance to British subjects that they would not be exposed to the severity of Siamese justice and encouraged the setting up of business houses. This right was given up in 1909, long before its withdrawal in China, in return for the independence of Kedah and the other northern Malay States from Siam. I have been told that the Customs' cruisers confine themselves to the inner waters, and act against smuggling and not piracy. It may be so; but smuggling and piracy may be considered as frequently only different branches of the same profession, the members of which will take to either as they think it safer, and likely to be more profitable for the occasion. That law and order are the rule increasingly in Hongkong and along the coast is a growing impression, and that impression is a surer preserver of the peace than the gallows, the axe, and the sword. Bad men are kept habitually obedient to the law by the form of justice armed with power in their mind's eye more than by outbursts of indignation occasionally aroused against them, and from which they always hope to escape.\n\nEre I leave the subject of crime, I may be permitted to say a few words on the police force of the colony. All along its history, the good organization of this has been perhaps the most difficult part of the duties of the Government. Experiment after experiment has been tried as to the constituents of the force; and as long as I can remember, that is, since the very first attempts at its formation, charges have been advanced against it of inefficiency, drunkenness, and openness to bribery. My own conviction has been for many years that the strength of the police force ought to consist of Chinese. I pressed my views on this point on Sir Richard MacDonnell soon after he arrived in the Colony, and he put them on one side. I stated them to the Commission which held its sittings on the subject during the present year, and I was glad to find that about one half of its members were disposed to coincide with me. I believe that the Chinese people are in the mass law-abiding and fond of order. I believe that there is a large body of Chinese merchants who have as great a stake in the Colony as the British and merchants of other nationalities have. I believe that by a cordial communication with them a body of native policemen might be obtained who would be sufficiently reliable, and who, with a smaller number obtained from home as the Government has lately done, a considerable proportion of its present force would keep the Colony almost free from crime. When the barbarian troops entered the capital military measures became totally impossible and whether we attack them or pacify them we shall incur harm. Thus we have to weigh up and discuss these two methods and to act expediently in order to relieve the present crisis.\n\nAfter the exchange of treaties the barbarians returned to Tientsin and sailed south one after another. Moreover, their demands are still based on the treaties. Thus those barbarians really do not covet our land and people. By good faith and justice we can still win them over and control their nature, while we plan our own recovery. This appears to be somewhat different from the situation in previous dynasties.\n\nYour servants have taken into account the overall situation and consider that our attempts to ward off the barbarians at the present time is rather like Shu's treatment of Wu. Shu and Wu were enemies yet when Chu-ko Liang held the reins of state he sent envoys to win the friendship of Wu and make an alliance with Wu to attack Wei. Surely he did not forget his determination to annex Wu for a single day. It was rather because he had to weigh up the favourable and unfavourable aspects of the situation and the relative degree of urgency.\n\nSo, if he did not suppress the hatred in his heart but risked all in a single test [i.e. by war with Wu] the result would be even worse than this. Now although the barbarians do not stand in the same relation to us as did the equal states of Shu and Wu yet the antagonistic situation between the barbarians and us is similar.\n\nAt the present time the barbarian behaviour is fierce and insubordinate. All our countrymen share a common indignation. Your servants know something about moral principles (i li); how could they forget the best interests of the state?\n\nNow the Nien are ablaze in the north and the “long haired rebels\" [the Taipings] in the south; our supplies are exhausted and our troops are tired. The barbarians have taken advantage of our weakness and as a result they have gained the upper hand.\n\nIf we do not restrain our anger but antagonize them then we may suffer unexpected reversals at any moment. If we forget the injuries they have done us and make no preparations we shall leave our sons and grandsons a cause of sorrow.\n\nThe men of old had a saying: \"Consider peace and friendship as a temporary expedient, consider attack and defense as a basic condition\". His official rank corresponded with that of a Lieutenant-Governor, so that he received a salute of only fifteen guns compared with the seventeen of first-class Crown-Colony Governors, such as that of Hong Kong. But, as R.F. Johnston pointed out: 'his actual powers, though exercised in a more limited sphere, are greater than those of most Crown-Colony Governors, for he is not controlled by a (Legislative) Council.'33 Lockhart's official duties, which of course kept him extremely busy, were nevertheless limited in nature, and the tempo of life in the Territory did not change dramatically during his tenure of office, for after the lease was signed, little was done with the Territory. At first, it was thought that the port could be transformed into a fortified naval base like Hong Kong, but to do so would have been extremely costly and would have involved the construction of a long breakwater and extensive dredging work in the harbour. In fact, the port was never utilised as a strategic naval base; it became merely a naval rest centre and a place where the British China Squadron lay at anchor when it paid its annual summer visit to North China. A few visitors also arrived from time to time and stayed at its European-style hotel, and an English school34 attracted boys from China, Japan, and Hong Kong.\n\nLockhart was administering a mainly agricultural region, equivalent in area to a small-sized Chinese district magistracy (hsien). The leased Territory, with its population composed principally of fairly well-to-do peasant farmers, fishermen, craftsmen, and artisans, was in composition like that of the New Territories which he had left. Lockhart did not feel called upon to alter drastically the life of this old, settled community, nor indeed was it the intention of the Colonial Office that he should. The Order-in-Council under which British rule in Weihaiwei was inaugurated stated: 'In civil cases between natives, the Court should be guided by Chinese or other native law and custom, so far as any such law or custom is not repugnant to justice and morality.'\n\nLockhart attempted, then, to preserve as much of the fabric of Chinese society as was possible. In his report for 1902, he wrote: \"With the policing of the territory at Hong Kong as a guide, it might have been thought that this question (the maintenance of peace and good order) was one easy of solution; but it required no long residence here to reveal that the conditions existing in the new territory of Hong Kong and those of Wei-Hai-Wei are widely different.         "content_text": "150\n\nC. MARTIN WILBUR\n\nBefore the sale can be considered official it must be stamped by the Ti-pao, and it is then registered at the office of the district magistrate. This process is called kuo kê (#1), \"passing the cutting off\", meaning the transference of the tax liability of the old owner to the new; or, cutting off the slip showing the tax liability from the old deed and pasting it on the new. Since registration costs to the amount of five or six percent of the purchase price, excluding extras, it is common, and perhaps universal, to understate the sale price on the copy of the deed sent in to the magistrate. Thus do the people do their part to equalize the excess taxation to which they are subjected on all occasions. For his part in the deal, the Ti-pao gets a small fee.\n\nIII\n\nBeyond its interest in collecting taxes the central government feels in some measure bound to preserve peace and prevent crimes in the villages. To affect these aims it works both through the Ti-pao and through the recognized village elders (when the two are not synonymous). The Ti-pao is the accredited police chief of the village. A good idea of the multifarious nature of his duties is given by a description of them in the Ta Ch'ing Hui Tien:\n\nIf any of the undermentioned offences are committed within the Tithing, the Tithing man shall be specially responsible for making the necessary inquiries and reporting the fact, viz: theft, corrupt teaching, gambling, hiding and absconding from justice, kidnapping, coining, establishing secret society, and so on. He shall also be required to report all suspicious characters arriving within his bounds, and see that the necessary alterations are made from time to time in the Register of Individuals in each family.         "content_text": "VILLAGE GOVERNMENT IN CHINA, 1933\n\n163\n\nespecially because they are the last court of appeal where customary law applies beyond them is the magistral court, which every Chinese has learned to fear.\n\nThe Ti-pao is an individual whose position is almost the personification of that very thin tie which links the government of the village with that of the nation. He derives authority from both sources, for he is supposed to be one of the villagers, chosen by them, and performing certain administrative duties for them; but at the same time he is specifically sanctioned by the magistrate, receives authority from him, and performs certain governmental duties.\n\nIn his position as responsible functionary in the village the Ti-pao may handle many of the administrative duties of the village council, in a measure usurping its authority. As agent of the central government the Ti-pao is usually involved in the two spheres where the government touches the village, namely, the collection of taxes and the preservation of peace.\n\nIn some cases the Ti-pao is himself charged with the collection of taxes; in others he merely indicates who owns the land, and the proper tax. Because of this latter responsibility it is his duty to officiate in all sales of land, and to know the owner and value of all property. On the side of preserving the peace the Ti-pao's duties are multifarious. He is the accredited police head of the village and chief informing officer for the government agents. At the same time he is the defender of the people, and it is his duty to report any miscarriage of justice in which one of his constituents is the victim.\n\nAlthough the Ti-pao is charged by the magistrate with these duties, it is the elders who are given the responsibility for the peace and good conduct of the village as a whole. The government finds this method of delegating responsibility to be effective and inexpensive, and it is in full accord with custom, especially the custom of mutual responsibility.\n\nThe predominant attitude of the village toward the government higher up is one of avoidance, for on the whole relations between the two are seldom in favor of the people.         "content_text": "162\n\nWEI PEN-T'I\n\nplace for the British to trade in China was the port of Canton, wrote that it was understandable that the British would want to take advantage of the peace and quiet of the Chinese Empire to facilitate their trade overland, but, as there had never been a precedent for their trading in Sinkiang, a fact borne out by old Moslem traders as well as various local chieftains despite British claims to the contrary, local authorities had decided to permit the traders to buy provisions, but had refused them the right to travel. \"We are seeking Your Majesty's advice on the wording of this refusal because we do not know how to draft communications to foreigners,” concluded Wu-lung-a.5\n\nA hypothesis can be drawn here that, to the Ch'ing court, the presence of these traders in Sinkiang was another indication that the British were seeking further penetration into China at that time. Remembering the Amherst ships that surveyed the China coast a few years before, and in view of the intelligence brought by the traders that the British were already in control of both Kashmir and Afganistan, the new Emperor was more willing to let Juan Yüan adopt a hardened policy towards the British in Canton. In fact, Juan Yuan was called to Peking shortly after the news reached the Emperor that the British traders were in Sinkiang.6 He was in Peking from 28 May to 25 June 1822. During that period the Emperor received him in audience five times. Juan Yüan recorded with great pride and joy that he was presented with several embroidered silk purses, and during these meetings with the Emperor the principles of foreign policy were established. These principles were made public subsequently through a court letter to Juan Yuan. They were:\n\n62\n\nThe principle of compensating for life lost with a life was to remain valid.\n\nIn instances where foreign nationals, civilian or naval, committed crimes against the Chinese in China or Chinese waters, they must submit to Chinese justice.\n\nForeign naval vessels as well as their personnel were in Chinese waters, ostensibly for the protection of their commercial vessels. Thus, if they should violate Chinese law, their nation's supercargo must be held responsible for the surrender of the culprits to Chinese authorities.\n\n4\n\nJuan Yuan was also directed by the Emperor to notify the British supercargo at Canton that since there was no piracy in the waters off Kwangtung, there was no need for them to send naval escorts for their",

        "content_text": "H. J. LETHBRIDGE\n\nshe opened a shop in Hong Kong, selling curios and objets-d'art. In 1927 she took a consignment of Chinese antiques, many from her late father's collection, to New York to sell. On October 10, 1927, she met her future husband in that city. Sir Travers Humphreys avers she was not, to English eyes, good-looking; others claimed she was attractive.20 But all agree she was charming and good-natured, much involved in charitable work.\n\nLess is known about Dr. Miao. Wai-sheung's relatives and friends never met him. He was a year younger than his wife. He was born in Chekiang (Chiang Kai-shek's native province) and, at the time of his trial, had a mother and sister living in Shanghai in the Chinese city. He claimed his father was a member of the Chinese Legislative Council (sic) and a Justice of the Peace. Miao studied law in China and later at Loyola University, Chicago. He was described as being extremely tall and slim, fluent in inaccurate English. His wife, a Cantonese, was petite, under five feet tall; so they were a noticeable couple together. They were married according to the rites of the American Episcopal Church. Siu was a devout Christian. Miao was probably a Christian, for Christianity was a sign of modernism in the early 1920s among the westernised, educated elite in Shanghai (later Marxism or Nationalism was to largely supplant all forms of religion and YMCA fraternalism among Chinese students and intellectuals). A newspaper report stated, in any case, that Miao 'professed Christianity before he died' (i.e., was hanged).91\n\nAfter marrying in New York, they honeymooned in Buffalo, then Albany where the bride had a minor operation to facilitate sexual relations (probably dilation of the hymen). About four or five weeks after their wedding, they left for a two-months' vacation in Europe before returning to China. They landed at Glasgow, stayed in Edinburgh a day or two, and on June 17, 1928, stopped at Grange-in-Borrowdale, a Cumberland village, close to Derwentwater. On the next day, January 18, they went for a walk in the morning, returned for lunch, and left for another walk, hand-in-hand, at two o'clock. However in a report to the Governor (Hennessy) he wrote \"if after the circumstances shall be forgotten, say a year after the Regiment shall have left the Colony, you should think it fit to remit any portion of the sentence it might be done”. In another case of robbery in which two defendants were convicted by a majority of the jury of four to three he wrote “I know the Chief Justice has expressed dissatisfaction at verdicts by majorities but the judges have found themselves bound to accept them as conclusive and the practice has been to act on such verdicts. I felt myself obliged to follow such precedents\". He recommended that they be pardoned because a co-defendant who pleaded guilty asserted that they were innocent. In September 1881 the Governor discharged them, and the two soldiers, from prison and was abused by the press for his \"capricious leniency”. (In 1894 an Ordinance provided that a majority of five to two was required in criminal cases). When criticised for hearing proceedings in camera he said \"I mean as long as I sit on this bench to continue to exercise the discretion vested in me by law to hear a case in camera when the ends of justice appear to me to require it, in entire disregard of all obloquy to which it may expose me”. When he ceased to act as Puisne Judge the Chief Justice wrote to the Governor to say that he entirely agreed with the Daily Press that Francis had earned for himself a high reputation for ability and clear-headedness. In addition he was appointed to the Commission of the Peace in 1878, and a member of the Commission to Revise the Laws and Ordinances of Hong Kong in 1887. He was also an examiner of candidates for admission as attorneys both when he was a solicitor and after his call to the Bar. He was never appointed acting Attorney General or Chief Justice, which appointments carried a seat in the Legislative Council (the latter until 1889) and that according to his obituary in the China Mail was a matter of regret to him. The system of acting appointments could have disadvantages as Francis pointed out. In 1885 there was a rumour that the Puisne Judge was going on leave for twelve months and that E.J. Ackroyd the Registrar of the Supreme Court would be appointed to act in his place. Francis wrote to the government expressing the view that officers of the Supreme Court should not be appointed to the bench and that the Registrar was a far more important official than the Puisne Judge. Though today things are different in Hongkong, a completely mutual relationship is yet to be achieved between all sections of the community. He believed Chinese views on matters affecting public welfare should be known and taken into consideration in decisions made by the Government and its officials. He was a strong advocate of equal treatment of all groups within the Colony and was opposed to class legislation. These policies were not welcomed by a large part of Hongkong's expatriate population. When Ng Choy was named to the Legislative Council there were murmurs of displeasure.\n\nThe choice, however, was a happy one.\n\nNg Choy, a barrister educated in England, was a diplomat by nature. During the period he represented the Chinese on the council, he steered successfully the treacherous course of cooperation with Governor Hennessy's \"pro-Chinese policy\" and cross currents of opposition it aroused among the European colonials. All of his good sense, ability to relate to people, integrity of character and humour were needed, and these did not fail him.\n\nIn 1882 he resigned to join the staff of Viceroy Li Hung-chang at Tientsin as a legal adviser. It was not easy to find someone who would fill the seat so capably. Ho A-mei, never backward, was willing and eager to compete for the high prize. His competitors were only a handful. Prominently mentioned were Dr. Ho Kai, Wei Yuk, Leung On and Wong Shing. Ho A-mei aspired to join their ranks.\n\nWho were these men and what were their qualifications?\n\nWei Yuk had been educated in Scotland and was compradore of the Chartered Bank, having succeeded his father in that position.\n\nGovernor Hennessy had made him a Justice of the Peace in one of his bids to tie the Chinese more closely to the Government. For this reason, the life and career of Mok Man Cheung needs to be examined to enable the full significance of his publication to be gauged. As will be seen in more detail below, Mok made his effort to help his compatriots nearly twenty years after he had left the teaching profession and several years after he had ceased being a professional interpreter and translator. By 1904, Mok Man Cheung was well established as a compradore and commission agent. There was certainly no financial need behind his writing of the book. Instead, he should receive the credit for having taken up the challenge of being a middleman and go-between in the most practical and, to his fellow-Chinese, the most helpful of ways. That he deemed this task worthwhile is a comment which itself provides insight into the social history of the time and, especially into the social history of education.\n\nSignificance of the life and career of Mok Man Cheung (the setting for snapshots 2 and 3)\n\nIn many ways, Mok Man Cheung was a typical product of the interaction of Chinese culture and enterprise with British colonial, bureaucratic, and commercial power. This interaction put a premium on the development of a group of middlemen or go-between. As the details outlined below demonstrate, Mok Man Cheung's education and career qualify him for membership of several of the categories analyzed by Carl Smith for the emerging Chinese elite in Hong Kong, even though his name has not yet been singled out by Smith. He was \"English educated\". He worked for a time as a translator. He became involved in the educational and the legal professions. He moved into the compradore class and, later, as “commission agent\", also performed compradorial services on a freelance basis. Under \"Clothing and Wearing Apparel\", the reader could discover a way to pronounce \"Pyjama\", \"Silk stockings\", \"Breeches\", \"Chemise\", \"Mosquito net\", \"Knickerbockers\", \"Cholera belt\", \"Combination\", \"Pantaloons\", and \"Swallow Tail coat\", while the separate section on \"Chinese Clothes\" introduced him to the pronunciation of such objects as \"Wadded Coat\", \"Mandarin robe\", and \"Queue string\". The section on \"Crockery and Household Articles\" and the separate section on \"Household Articles\" provide an interesting glimpse of some of the personal belongings which Mok Man Cheung assumed would be characteristic of his readership. Some of the less educated Chinese rioted because medical and sanitary precautions intruded on their property rights. Others, estimated as at least 80,000, fled Hong Kong. And many panicked because of superstitious rumours similar to those which were beginning to spread in China about the activities of the Western missionaries.38 It would be interesting to discover Mok Man Cheung's attitudes and activities during these tense years. The last time his name appears in the Blue Book as Chinese Clerk and Translator at the Supreme Court is 1898. It seems probable, therefore, that he left Government service at the end of 1898 or early in 1899 and, aided perhaps by family connections, entered the even more profitable undertaking of serving as an assistant compradore for a major European trading company. In January 1899, he made first use of his career experience as an interpreter and translator by publishing a very substantial (2,717 pages) English-Chinese Dictionary, entitled Ta Tsz's Dictionary, a project more notable for its industry than its originality.\n\n40\n\nShortly after he left Government service as a translator at the Supreme Court, the cause célèbre was the assassination of a radically-minded (Sun Yat-sen supporting) school teacher in his own classroom by gunmen hired by the police chief in Canton. Relations between the British, many of whom were shocked at the \"gross and daring violation of British territory” by the Chinese Imperial Government, and the Chinese in Hong Kong did not improve as a result.\n\n41\n\nIn that year (1901), Mok Man Cheung was on the compradorial staff of Butterfield and Swire, one of the leading European Hongs in Hong Kong. Thereafter, he remained in the business of commercial go-betweening, both as a fully-fledged compradore and as a free-lance \"commission agent\". In 1910, he was appointed a non-official Justice of the Peace. His name appears in the Hong Kong Government's Blue Book on the list of JPs from 1910 to 1917. His standard of English, however, was a handicap in aspiring to the membership of the Legislative Council.\n\nWong Shing was Wei Yuk's father-in-law. He was a man of high principles, but quiet and reserved. He had been in the first class of the Morrison Education Society School in Hongkong and with three of his classmates had been taken to the United States to further his education by the headmaster of the school. His health, however, did not permit him to finish his studies. He returned to Hongkong and took up employment with the London Missionary Society, in a short time becoming manager of the Society's printing establishment. For a brief period he was with the Chinese Educational Mission in the United States, but now he was looking after his properties in Hongkong and managing other business interests. He had no ambition to be a prominent public figure but when Ng Choy's successor as Councillor was named at the close of 1883, it was Wong Shing.\n\nIn January 1883, however, it appeared that Dr. Ho Kai was the most likely candidate for the seat. He had left Hongkong when still a young boy to receive an education in Scotland and England. He reminded the Governor that in spite of its degrading nature it was a universal method of punishment in Chinese courts. If it was claimed that this is a barbarous custom, he held this to be sentiment, “and I say sentiment should not be imported into the administration of law, which for public safety needs to be sternly carried out.”\n\nHe further pointed out that even in England flogging was still generally practised for heinous crimes. He advocated the same practice in Hongkong—not total abolition but cautiously administered flogging for only very serious crimes. He believed that \"the security, peace and quietness of the good law-abiding people should not be undermined by any sentimental feeling for the roughs.\"\n\nBut if the abolition of flogging was not to be advocated, the indiscriminate practice of the whip was equally undesirable. The writer cited an instance in which a magistrate ordered a horse-boy flogged because his master charged that he had ill-treated a racing horse and therefore had committed a \"malicious injury\" to property.\n\nHe also pointed out that there were laws on the books in Hong-kong which awarded up to fifty strokes for the crime of injuring plants and trees, as well as “for obeying calls of nature in any public, exposed or improper place to the annoyance of others.\"\n\nStill in force was the provision for fifteen strokes for not co-operating with the Fire Brigade if the Justice of the Peace \"shall think fit and the offender shall be a Chinese.”\n\nAnother correspondent, who signed himself as \"An Englishman,\" used Ng Choy to illustrate the unreasonableness of the necessity for Chinese abroad at night to carry a light.\n\nHe declared: \"I consider it a disgrace to British rule that such a man as Ng Choy, a barrister, should be liable at the present day to be stopped in the street here after dark unless he adopts the childish practice of carrying a lantern.         "content_text": "and a treadmill was in operation for punishment up until the early 1900s. Prisoners were escorted to Court, so it is believed, by a tunnel. Although the author went to Victoria Prison in the 1970s, on Justice of the Peace visits, he is unable to substantiate this.\n\nA few colonial-style buildings, such as the Helena May Institute (completed 1916) on Garden Road, and the old Supreme Court building (foundations laid 1903, completed 1912) in Central District, are still in use. The latter is now the Legislative Council Chambers, and has been described as \"Lutyens classical revival style adapted for the tropics\".\n\nIn spite of forceful protests by the Heritage Society which was wound up, despondently, in 1983 — and the Conservancy Association, the Repulse Bay Hotel, the previous Hong Kong Club building, and the old Kowloon Railway terminus (except for the tower2) have all succumbed to the wrecker's hammer. The average Hong Kong citizen, it seems, has limited interest in conservation. He or she believes that a building has an economic life span, and, after that, it should go. To be fair, the Government, advised by the Antiquities and Monuments Office and the Antiquities Advisory Board, has declared a number of structures, for instance the Stanley Police Station (1859)13 as Monuments under the Antiquities Ordinance. Other Monuments include the steps and gas lamps in Duddell Street, Central District; rock carvings and inscriptions; old villages, for example Sam Tung Uk in Tsuen Wan; and the District Office, North, building at Tai Po in the New Territories.\n\nThe Territory also possesses a variety of other old structures, such as the fort and battery at Tung Chung and the fort at Tung Lung. There are also ancestral halls and study halls, like Shut Hing Shue Shan, at Ping Shan, and Chou Wong Yi Kung Shue Yuen, in Kam Tin.\n\nAmong other declared historical Monuments are Wan Chai Post Office (1915)1* in Queen's Road East, Western Market in Sheung Wan, and the Pathological Institute,1 in Caine Lane. As of 1990, such Monuments totalled 43. One of the most famous of Hong Kong's old buildings was Murray House (circa 1843).1 It was demolished carefully in 1982, and the parts were labelled, numbered and stored. The intention is to re-erect it on another site.\n\nIn 1935, the then new 66-metre high Hong Kong Bank (the third bank on that site) was fully air-conditioned (the first large building in Hong Kong).",

He is certainly a somewhat uneducated man, not only without fine manners, but a man who actually insults with the coarsest expressions when he sits to do justice. Yet it was nonetheless he alone who was ready for these obstinate clans, who broke their year-long overweening clannishness, and who brought the issue to a full and satisfactory solution. May it remain a successful conclusion to this affair in Sham Chun!\n\nOn his arrival he first of all required that all the weapons and armour of the allied clans be handed over to him. We heard that the Cheung clan had also made a delivery of their weapons, so that they could make an immediate appearance before Tin On-pong's seat of justice. Several houses of the Tsoi clan were burnt as a punishment. The Yuen clan were threatened in a similar way. The latter clan had among its members three graduates of the second rank (counting up from the bottom), and these were called before the Magistrate to defend their clan's claims.\n\nThis was so far successful that when the final decision was read out, it was that the \"Transit Toll\" should be divided, with four parts going to the Yuen clan, and six parts to the Sham Chun she hok.” (The she hok is a public building where, when disputes or other matters arise, the elders of the clans, the graduates, and the title-holders of the surrounding district meet together to take council on them.) However, since the Cheung clan is closest to the she hok it is likely that it will get the major share of the she hok's six parts. Furthermore, to conclude peace between the parties, it was decreed that the Yuen clan should sell the site of the landing place, and the rights over it, to the Cheung clan. This decision clearly favours the Cheung clan, since the people of the Yuen clan will lose all their rights to the matter under dispute. The Cheung clan will never again allow them to intrude into what is now to be the Cheungs' portion, whether the time be short or long.\n\nFinally, the Yuen clan were required to surrender one\n\nPage 273",

        "content_text": "Kwu Ling, for instance,\" and official action is not remembered in the fighting between Tsuen Wan and Shing Mun, or in that between Tai Wai and Cheung Sha Wan, at about the same dates. Between 1850 and 1880 it would seem that the policy of the District Magistrate was to turn a blind eye to inter-village disputes unless this was impossible.\n\nKrone, in his 1858 \"Notice of the Sanon District\"2 speaks at some length on inter-village warfare in the area and the ineffectiveness of the District Magistrate in responding to it. The District was \"troubled and insecure... internecine wars are almost always raging between some or other of the villages, and these wars ... are often long-continued and sanguinary. The people are of a quarrelsome nature, and fond of rapine [and, in the sub-mandarin's view,] depraved and so drowned in all manner of wickedness as to have lost their human nature. ... The Mandarins have very little power.\n\nThe people do not allow the Mandarins to interfere with their own local government. Law suits, differences and offences are seldom brought before the Mandarins. The disputes between villages and clans are settled by the gentry. If they cannot come to an agreement, all connection is broken off, and without any declaration of hostilities, the disputants commence a predatory war on each other; in these quarrels, many a bloody battle is fought, hundreds of men perish, and whole villages are destroyed. Men of neutral villages or clans are generally well distinguished, and their rights respected.... etc'. Krone notes particularly a long-fought inter-village war at Sha Tsing (7 JP, Shajing). Here, the District Magistrate eventually came with 1,000 soldiers to make peace (this was probably in 1852 or 1853), and was not only ignored, but threatened by both combatants; intervention by neutral clans allowed the Magistrate to retreat with his \"face\" intact, but his intervention had no effect on the course of the dispute.\n\nThe Basel Missionaries also had a low opinion of the District Magistrate in this period. One said, in 1861, “The San On Magistrate is a miserable, dirty fraud and hypocrite. He demands outward respect, but does no justice. Hence differences, by being denied a hearing, grow to quarrels, then to blows, then to war, while he sits at home and does nothing”.13\n\nThis ineffectiveness may not have been the normal situation of the district. It is sometimes elsewhere, puzzlingly, quoted as Whitcome. Did she have a step father one wonders? Or was this an unfortunate mistake by some writer and a case of give a slip-up five minutes start and the truth never catches up with it?' This could be the case. Certainly the name on the huge family memorial, in the Hong Kong Cemetery at Happy Valley, is carved as Alice Walkden.\n\nBefore the couple arrived back in Hong Kong in 1882 the then Governor, Sir John Pope Hennessy, announced to the Legislative Council that this young Chinese had taken the highest honours at Lincoln's Inn. 'It was something that a gentleman belonging to the Colony should have gained such honours.'\n\nAnyway, back in the British colony in those days the 'superstitious' Chinese generally did not take readily to 'newfangled,' western medicine and Ho Kai switched to law. But a brilliant Chinese with fluent English was rare in those days. He was enticed into business. He also entered public service and, in addition to sitting on a number of other government committees, sat on the Sanitary Board (the forerunner of the Urban Council) and, in 1890, became a Legislative Councillor. He was the third Chinese to sit on this august body. He was also a Justice of the Peace.\n\nHaving lived in the West for a number of years it is not surprising he developed strong views about social reform and the modernisation of China. He became an associate of statesman Dr Sun Yat-sen. This was at a time when China was striving to rid itself of the Qing dynasty and there was danger the country would be assimilated by colonial powers.\n\nIn his latter life Ho Kai spent most of his time serving the community. He helped, together with his colleagues, to mould the Territory in which we now live. Ho Kai was capable and, understandably, there was no need for him to take to heart the Chinese axiom: 'If you do not become a good minister be a good physician.'\n\nHe was 'lionised and eulogised' after his death by all sectors of",

But obviously things are going to continue to change, just as some of us in the 1970s could visualise that an organisation similar to the Vocational Training Council (VTC) was not so far away. But just as in the colonial 1950s and '60s 1997 was seldom mentioned, looking into the crystal ball today to decide what technical education will look like half a century from now has to be another story.\n\nThank you again for inviting me to share this very special day with you.\n\nAbout the Speaker\n\nDr D D Waters, who was born in 1920, sailed from England for Hong Kong in 1954. It has been his home ever since. He taught building at the old Technical College (now the Polytechnic University) becoming Head of the Building Department in 1963. In 1968 he was appointed Principal, more than one year in advance of the opening of Hong Kong's first Technical Institute at Morrison Hill.\n\nIn 1972, he was transferred to the Education Department Headquarters to oversee the setting up of additional Institutes. He later became the Assistant Director (Technical Education) and responsible to the Director of Education for Hong Kong's technical education system.\n\nDr Waters served as a Justice of the Peace in the 1970s and was made a Companion of the Imperial Service Order by Her Majesty the Queen in 1981, largely for his work in technical education. In 1998 he was awarded a Bronze Bauhinia Star, by the Hong Kong Special Administrative Region of China, for his work in heritage conservation.",
