PRIVATE ROADS
116. This Part not to apply to certain private roads
(1) The Secretary for Transport may, by notice in the Gazette, specify private roads to which this Part shall not apply subject to such conditions, if any, as are specified in the notice.
(2) A notice under subsection (1) may specify the private roads to which it relates by-
(a) naming such roads;
(b) describing the area within which such roads are situated; or
(c) reference to a plan,
or any combination thereof.
117. Application of Ordinance to private roads
Sections 36, 37, 38, 39, 40, 41, 42, 43, 44, 45, 46, 47, 48, 50, 51, 52(1) and (10)(a), 55, 56, 57, 60, 61, 63, 80, 84(1)(c), 103(1)(b) and (3)(a), 107, 109 and 110 shall apply to private roads as they apply to roads and, for that purpose-
(a) the other provisions of this Ordinance which relate, in any way,
to those sections; and
(b) the provisions of any other Ordinance which relate, in any way, to those sections or to the provisions referred to in paragraph (a),
shall apply accordingly.
118. Application of regulations to private roads
(1) Subject to any regulations made in pursuance of subsection (2), all regulations made under this Ordinance (except section 12) shall apply to private roads as they apply to roads and, for that purpose-
(a) the other provisions of this Ordinance which relate, in any way,
to such regulations which apply to private roads; and
(b) the provisions of any other Ordinance which relate, in any way, to such regulations which apply to private roads or to the provisions referred to in paragraph (a),
shall apply accordingly.
(2) Where any power is conferred by this Ordinance (except section 12) to make regulations, such power shall include the power to-
(a) specify that all or any regulations made in pursuance of that
power shall not apply to private roads; and
(b) modify or qualify the application to private roads of all or any
regulations made in pursuance of that power.
