NOISE CONTROL

To provide for the prevention, minimizing and abatement of noise; the appointment of a Noise Control Authority; the powers and duties of the Noise Control Authority relating to the control of noise; the creation of offences; and for connected purposes.

Short title and commencement

1.

(1) This Ordinance may be cited as the Noise Control Ordinance.

(2) This Ordinance shall come into operation on a day to be appointed by the Governor by notice in the Gazette and notices under this section may appoint different dates for the coming into operation of different provisions of this Ordinance.

Interpretation

2. In this Ordinance, unless the context otherwise requires-

"annoyance" means annoyance that would not be tolerated by a reasonable person;

"Appeal Board" means the Appeal Board constituted under section 21;

"Authority" means the Noise Control Authority appointed under section 3(1);

"Chairman" means the person appointed as Chairman of the Appeal Board under section 20(2);

"construction noise permit" means a construction noise permit issued under section 8(1);

"construction site" means a place where construction work is carried out;

"construction work" includes

(a) any work in connection with or for the construction, demolition, reconstruction, shoring, alteration, maintenance or repair, of the whole or any part of any building, arch, bridge, chimney, dock, hoarding, shelter, tunnel, wall, pier, wharf or other structure or any road, slope, embankment, street, railway, tramway, airport, channel, drain, service lane, sewer, water conduit, lighting or public utility;
