4. The Secretary for Municipal Services may, by notice published in the Gazette, amend the concentrations specified in Column C of the First Schedule.

5. Any person who contravenes regulation 3 or 3A commits an offence and is liable to a fine of $25,000 and to imprisonment for 6 months.

6. Without prejudice to the provisions of any other enactment relating to the prosecution of criminal offences and without prejudice to the powers of the Attorney General in relation to the prosecutions of criminal offences, prosecutions for an offence under any of the provisions of these regulations may-

(a) where the offence was committed in the Urban Council area, be brought in the name of the Urban Council; or

(b) where the offence was committed in the Regional Council area, be brought in the name of the Regional Council.
