23. Any person who transmits or causes to be transmitted by telegraph a message which he knows to be false or fabricated shall be liable to a fine of one thousand dollars and imprisonment for three years.

PART V.

Radiocommunication.

26. (1) In this Part and in any regulations made thereunder—

“radiocommunication” means any telecommunication by means of Hertzian waves;

“radiocommunication station” includes every apparatus or collection of apparatus which can be used for radiocommunication or radiodistribution, whether for transmitting or receiving or for transmitting and receiving, and whether such apparatus or collection of apparatus be complete or not.

(2) Subject to the regulations made under section 31 nothing in this Part shall prevent any person from making or using electrical apparatus for actuating machinery or for any purpose other than the transmission or reception of messages.

27. The provisions of this Part shall not apply to officers or men of His Majesty's Army, Navy or Air Force using wireless apparatus in the performance of their official duties or to apparatus so used.
