MALICIOUS DAMAGE.

To consolidate and amend the laws relating to malicious injuries to property.

[14th June, 1865.]

1. This Ordinance may be cited as the Malicious Damage Ordinance.

Injuries by fire to buildings and goods therein.

24 & 25 Vict. c. 97.

2. Any person who unlawfully and maliciously sets fire to any church, chapel, meeting house, or other place of divine worship shall be guilty of felony, and shall be liable to imprisonment for life, and, if a male under the age of sixteen years, with or without whipping.

3. Any person who unlawfully and maliciously sets fire to any dwelling-house, any person being therein, shall be guilty of felony, and shall be liable to imprisonment for life, and if a male under the age of sixteen years, with or without whipping.

Any person who unlawfully and maliciously sets fire to any house, stable, coach-house, out-house, warehouse, godown, office, shop, store, mill, storehouse, granary, hovel, shed, or fold, or to any farm building, or to any building or erection used in farming land or in carrying on any trade or manufacture or any branch thereof, whether the same is then in the possession of the offender or in the possession of any other person, with intent thereby to injure or defraud any person, shall be guilty of felony, and shall be liable to imprisonment for life, and, if a male under the age of sixteen years with or without whipping.

5. Any person who unlawfully and maliciously sets fire to any engine-house, warehouse, or other building belonging or appertaining to any port, dock, or harbour shall be guilty of felony, and shall be liable to imprisonment for life, and, if a male under the age of sixteen years with or without whipping.
