to declare such school to be an unlawful school within the meaning of this Ordinance:

Provided that, before making such declaration, the Governor in Council shall cause notice to be given to the manager of the intention to make such declaration and of the grounds on which it is intended to be made, and calling upon the manager of such school to show cause why such declaration should not be made, and such manager shall have a right of audience before the Council prior to the making of the declaration.

20. A person who acts in contravention of or fails to comply Penalties. with any of the provisions of this Ordinance or of any regulation shall be deemed to be guilty of an offence against this Ordinance and where no other penalty is provided shall on summary conviction be liable in respect of each offence to a fine not exceeding two hundred and fifty dollars and in the case of a continuing offence to a further fine not exceeding ten dollars for every day, subsequent to the day on which he is convicted of the offence, during which the contravention or default continues.
