Certificate of Registrar of the Supreme Court that the costs of an appeal have not been paid.

REGISTRY, SUPREME COURT, HONGKONG.

I hereby certify that at the sitting of the Full Court on the day of 19., an appeal by C.D. against a conviction [or order] of J.P., Esquire, a magistrate of the said Colony, came on to be tried, and was then heard and determined, and the Full Court thereupon ordered that the said conviction [or order] should be confirmed [or quashed] and that the said [appellant] should pay to the [respondent], for his costs incurred by him on the said appeal, the sum of $, and which sum was thereby ordered to be paid to me, the undersigned, on or before the day of 19., to be by me handed over to the said [respondent]; and I further certify that the said sum for costs has not, nor has any part thereof, been paid in obedience to the said order.

1. Where in pursuance of any Ordinance or statute, a magistrate specially directs the appropriation of a fine (including a penalty), the Ordinance or statute under which the appropriation is made shall be set forth in the register required to be kept in pursuance of the Magistrates Ordinance, 1890, (which is hereinafter in these Rules referred to as "the Ordinance") and authenticated by the signature of one of the magistrates.

2-(1) The return referred to in section 30 (4) of the Ordinance shall contain the particulars required to be entered in the register.

(2) The magistrate signing any such return shall cause it to be delivered to the magistrates' clerk, and he shall enter the return in the register.

3. The account to be rendered by the magistrates' clerk of fines, fees and other sums received by him under the Ordinance shall be rendered quarterly or at any less interval as may be directed by the Treasurer, and shall be in Form No. 1 in the Appendix to these rules.

4. (1) All fines imposed by a magistrate shall appear in the last-mentioned account in chronological order, and where payment is deferred or to be made by instalments, the fact shall be shown in the column headed "Remarks".
