RULES FOR FISHING IN THE WATERS OF THE COLONY.
Interpretation of terms
1. In these Rules the following terms shall have the meanings hereby assigned to them:
An "inshore stake-net" is a net which is attached to poles, and which is worked by a windlass stationed on shore or in less than 3 fathoms of water.
An "offshore stake-net" is a net which is attached to poles, and which is worked by a windlass stationed in more than 3 fathoms of water.
A line of stakes and nets is a net or nets attached to a line of stakes which are driven into the foreshore or sea bed.
Licence Fees.
Licences not transferable.
The expression "stake-net" includes an inshore stake-net, an offshore stake-net and a line of stakes and nets.
A seine net is a net not less than 100 feet in length by 3 feet in width, which is shot from a boat and hauled by both ends to the shore.
2. Owners of stake-nets and seine nets shall pay to the Harbour Master annual licence fees commencing from 1st June in each year in accordance with the table annexed.
3. Licences shall not be transferable, and shall specify the exact place in which they may be used.
No new stake-net to be erected without permission.
4. No new stake-net shall be erected without the permission in writing of the Harbour Master, which permission shall state the class of net and the place in which it is to be used.
Restriction as to new stake-net.
5. No new stake-net shall be erected within 200 yards of an existing stake-net without the consent of the owner thereof.
Exhibition of light.
6. Every stake-net shall exhibit between sunset and sunrise a bright white light visible in all directions seaward for at least one mile.
Licence number to be shewn on a board.
7. Every stake-net shall exhibit conspicuously a board shewing the licence number of the stake-net.
Removal of stakes.
8. The Harbour Master may order the removal of stakes when not in use.
Fishing with explosives prohibited.
9. No person shall within the waters of the Colony kill or take any fish by means of any explosive whatsoever.
