23.-(1) Every person who unlawfully and maliciously destroys, damages with intent to destroy, any cultivated plant or root used for the food of man or beast, or for medicine, or for distilling, or for dyeing, or for or in the course of any manufacture, and growing in any land, open or enclosed, not being a garden, orchard, or nursery ground, shall, on conviction thereof before a Magistrate, be liable to imprisonment for any term not exceeding one month, or to a fine, over and above the amount of the injury done, not exceeding 5 dollars, and in default of payment thereof, together with the costs, if ordered, shall be dealt with as the law relating to the jurisdiction of Magistrates provides.

(2) Every person who, having been convicted of any such offence, either against this or any former enactment, afterwards commits an offence under this section, and is convicted thereof in like manner, shall be liable to imprisonment for any term not exceeding 6 months.

24.-(1) Every person who unlawfully and maliciously cuts, breaks, throws down, or in anywise destroys any fence or paling of any description whatsoever, or any wall, stile, or gate, or any part thereof respectively, shall, on conviction thereof before a Magistrate, be liable for the first offence to a fine, over and above the amount of the injury done, not exceeding 25 dollars.

(2) Every person who, having been convicted of any such offence, either against this or any former enactment, afterwards commits any offence under this section, and is convicted thereof in like manner, shall be liable to imprisonment for any term not exceeding 6 months.
