No. 2.] THE ORDINANCES OF HONGKONG : [A.D. 1868.

Brigade, and generally may take such measures as may appear expedient for the protection of life and property, and may, by himself or by his men, break into or through and take possession of, or blow up with gunpowder or pull down, any premises for the purpose of putting an end to a fire.

(2.) The Superintendent of the said Brigade or other officer in charge thereof may close any street in or near which a fire is burning and may remove any persons who interfere by their presence with the operations of the said Brigade.

(3.) Any officer or member of the said Brigade acting bonâ fide under this Ordinance and the powers hereby conferred shall not be liable to any action for damages for any act done under this section.

(4.) Any damage occasioned by the said Brigade in the execution of their duties shall be deemed to be damage by fire within the meaning of any policy of insurance against fire.

7. Every person who is required by the Superintendent or officer for the time being in charge of the Fire Brigade to co-operate with any Fire Brigade, whether consisting of volunteers or not, so that the same or in are approved by the Governor, or in the working of any fire engine, the suppression of fire shall be bound to obey such requisition, under a penalty, for every case of disobedience, not exceeding fifty dollars.

8. All offences under this Ordinance shall be triable before a Police Magistrate, who shall have power to enforce all penalties hereby imposed or which may be imposed by any order of the Governor-in-Council.

A.D. 1868. AN ORDINANCE to assimilate the Law of this Colony respecting Treasonable Offences to the Law of the United Kingdom.

Short title.

Repeal of provisions of

WHEREAS it is expedient to assimilate the law of this Colony respecting treasonable offences to the law of the United Kingdom:

Be it therefore enacted by the Governor of Hongkong, with the advice of the Legislative Council thereof, as follows:-

1. This Ordinance may be cited as the Treasonable Offences Ordinance, 1868.

2. From and after the commencement of this Ordinance, the provisions 36 Geo. 3 c. 7 of the Act 36 George 3 Chapter 7, entitled "An Act for the Safety and

Preservation of His Majesty's Person and Government against Treasonable and Seditious Practices and Attempts," and so much of the Act 57 George 3 Chapter 6, entitled "An Act for the Safety and Preservation of the Person of His Royal Highness The Prince Regent against Treasonable Practices and Attempts," as relates to the provisions of the same relating to compassing, imagining, inventing, devising, or intending the death or destruction, maim or disablement of the person of the King, or of the Queen consort of any King, or of the Queen, or to deposing the King, or to levying war against the King in his realm, to stir up foreigner or stranger to invade the realm, or to put the King in force or constraint, or to move or stir any foreigner or stranger with force to invade the realm, or the King in force or constraint, or to put any King, Queen, or Prince, being the heirs or successors of the Imperial Majesty, to death, or to depose, levy war against, or put in force or constraint, or any person or persons having in law right or next right to the Imperial or Royal Majesty, Crown, or Dignity Imperial or Royal, with force to destroy or hinder the person or persons having in law right or next right to the Imperial or Royal Majesty, Crown, or Dignity Imperial or Royal, from succeeding to the same, or to intimidate or overawe either House, or both Houses of the Legislature, or to incite or stir up any person or persons to attempt to intimidate or overawe either House, or both Houses of the Legislature, shall be, and the same are hereby repealed.

3. If any person whatsoever within this Colony compasses, imagines, invents, devises, or intends to deprive or depose the Queen from the style, honour, or royal name of the Imperial Crown of the United Kingdom, or of any other of Her Majesty's dominions or countries, or to levy war against Her Majesty within this Colony, or by any overt act within this Colony, or without this Colony, to conspire with any person or persons whatsoever within or without this Colony, to levy war against Her Majesty within this Colony, or to cause by any overt act within this Colony any person or persons whatsoever to levy war against Her Majesty within this Colony, or to move or stir any foreigner or stranger with force to invade this Colony, or any other of Her Majesty's dominions or countries under the obeisance of Her Majesty, or to put any force or constraint upon or to intimidate or overawe either House, or both Houses of the Legislative Council, or to incite or stir up any person or persons to attempt by any overt act to intimidate or overawe either House, or both Houses of the Legislative Council, and such compassings, imaginations, inventions, devices, or intentions, or such conspiracy, or such overt act, or such moving or stirring, or such inciting or stirring up be expressed by any overt act, or deed, within or without this Colony, every such person so offending shall be guilty of felony, and being convicted thereof, shall be liable, at the discretion of the Court, to be imprisoned for any term not less than two years, or for life, or to suffer death, or to be confined to hard labour for any term not less than two years, or for life.
