50. Every person who---

(1.) steals any goods or merchandise in any vessel, barge, or boat of any description whatsoever in any haven, or in any port of entry or discharge, or in the course of any voyage from any port or place in this Colony to any other port or place therein, or in any creek or basin belonging to or communicating with any such haven or port; or

(2.) steals any goods or merchandise from any dock, wharf, or quay adjacent to any such haven, port, creek, or basin,

shall be guilty of felony, and, being convicted thereof, shall be liable, at the discretion of the Court, to imprisonment with hard labour for any term not exceeding fourteen years and not less than three years or to imprisonment for any term not exceeding two years, with or without hard labour and with or without solitary confinement, and, if a male under the age of sixteen years, with or without whipping.
