are curious in the solution of conundrums.

We have gone into the details of this affair at greater length than we intended, or than may be necessary; but the truth is that the charge of partiality is one of a serious nature, and we have unwittingly said more in its refutation than we intended. One thing we admit. We were wrong in asserting that these two valuable and polite functionaries, Serjeant Atkins and Con- stable Swimmer, were formerly in the 18th Royal Irish. It appear that they had not that honor, and we make the amende honorable, by apologizing to them-to the regiment-or, in short, to any body we have offended in the matter.

Chief Magistrates Office, Victoria, Friday, 12th September, 1845. BEFORE THE ASSISTANT MAGISTRATE" Information on Oath of Police, Sergeant Atkins, last night about 11 o'clock, I-was on duty at the central station when a messenger arrived from the Lieutenant Govenor requiring a police sergeant at his residence, I went, and was taken to the Lieut. Governor's room. He asked me if I heard that noise (referring to some loud singing in the neigh. bourhood) and why I did not stop it, I replied I had no orders to that effect. He then requested me to give his compliments to Mr, Welch, the owner of the house and request him to stop the noise if he pleased, I went to Mr. Welch's house and was taken up stairs, where he was sitting with some other men. I told him the Lieutenant Governor's request. He said that will do, go down stairs. I went out of the house as desired, nud Mr. Welch called out of the window to me and said, policeman, | H. M. S. Isaac Swimmor, police constable sworn states, about & past 10 o'clock on the night of the 11th instant, I was told by Lord Cochrane's servant to go with Sergean Atkins to Mr. Welch's house, to stop some noise. Wo kucked at the door of Mr. by his servant, we

Welch's house, and were det ue or six gentlemen with Mr Welch, they were drinking ant singing, Sergeant Alkins gave the general's compliments to Mr. Welch, and asked him to make less noise, Mr. Welch then told him to go down stairs, or he woull be under the necessity of horse whipping hin down. He went down stairs without making any reply. When we got into the street, Mr. Welch looked out of his window, and told us to give his compliments to the general, and say that if he sent us with any more such messages, he would whip us down stairs, which Sergeant Alkins immediately reported to the general. ~ Questioned do you think the other gentlemen in the room heard, what took place.

Lord T.B. Cochrane sworn states, about past 10 o'clock the night of the 11th instant, I received a message from the Major General requesting me to ascertain where the noise proceeded from, if I had not retired to rest.

i had retired to rest, and I desired my servant to go and see where the noise proceeded from.

He reported to me, that there was singing in the "Victoria Tavern" and at Mr. Welch's house. I told him to go and get a policeman to stop the noise in the Tavern, and report to the Major Ge neral thro' my servant that the noise was in Mr. Welch's house. On the arrival of the Sergeant of police, I heard the Major General request the Ser. geant of police to give his compliments to Mr. Welch and request him to make less noise, or words to that effect. Being anxious for the return of my servant, I went to the window, I heard these words made use of, "if ever the Major General sends me such an impertinent message again" ; but I did not here the conclusion of the sentence, I must observe that after the message had been sent, the noise was increased instead of diminished,

Francis Marryall sworn states, I was at Mr. Welch's house of the night on the 11th instant. A little after 11 o'clock, two policemen came into the room and desired, or required, by the Major Ge neral's orders, that the noise should cease, I did not hear them present the general's compliments. His tone was authoritative. Afr. Welch said that is quite enough, and requested them to leave the room I did not hear what Mr. Welch said at the window or whom he addressed. Questioned by the Ma gistrate, states I did not hear all Mr. Welch said at The window, I think he said something about borse whipping. The noise was not increased after the policemen came with the message
