An Ordinance for the Remission of Penalties.

Whereas Penalties which under Penal Statutes or Ordinances are made payable to Parties other than the Crown cannot be remitted by the Governor where no express provision has been made by the Imperial Statute or Colonial Ordinance for that pur- se, and it is expedient that the Law as to the Remission of such Penalties should be amended and made uniform: Be it, therefore, enacted and ordained by His Excellency The Governor of Hongkong, with the Advice of the Legislative Council thereof, as follows:-

I. It shall be lawful for the Governor to remit, in whole or in part, any Sum of Power to Governor Money which under any Act of the Imperial Legislature or any Ordinance now in force to remit penalties or hereafter to be passed in the Colony of Hongkong may be imposed as a Penalty or to Crown. Forfeiture on a Convicted Offender, although such Money may be in whole or in part payable to some party other than the Crown, and to order the discharge of any Person who may be imprisoned for Non-payment of any Sum of Money so imposed.

Be it enacted and ordained by His Excellency the Governor of Hongkong, with the Advice of the Legislative Council thereof, as follows:--
I. Section 1 of No. 4 of 1850, and Section 3 of No. 6 of 1852 are hereby re- pealed.

If any Seaman or Apprentice belonging to any Ship or Vessel whether British or Foreign shall desert therefrom or otherwise abscond or absent himself from his Duty or neglect or refuse to do his Duty while such Ship or Vessel is lying within any Harbour or Roadstead of Hongkong, it shall and may be lawful for any Constable or for the Master or Person in Charge of the Ship to arrest such Seaman or Apprentice Seamen, &c., desert- without Warrant and convey him before a Justice of the Peace, and in case such Sea- ing or neglecting duty man or Apprentice shall refuse or neglect to return and attend to or perform his Duty ment with or without n board such Ship or Vessel or shall not give a sufficient Reason for such refusal or not exceeding thres neglect, the Justice may order such Seaman or Apprentice to be put forcibly on board months, the Ship or Vessel to which he may belong or to be confined in any Gaol or Place of Security with or without Hard Labour within the said Colony for any period not ex- reeding Three Calendar Months or until he shall be demanded by the Master of the Ship or (in case of a Foreign Ship) by the Consul of the Country to which such Ship may belong.
