CONDITIONS OF SALE.
1.—The highest bidder shall be the Purchaser and if any dispute arise the Lot shall be put up again at a former bidding. 2.-No person shall at any bidding advance less than $50.
3.-Immediately after the fall of the hammer the Purchaser shall sign the Memorandum of Agreement hereinafter contained for completing the purchase according to these conditions, and shall within three days of the day of Sale pay into the Colonial Treasury the amount of Premium at which the Lot shall have been knocked down.
4.-The Purchaser of each Lot shall be entitled to and shall execute on demand a Lease from the Crown of the Piece or Parcel of Ground comprised in such Lot for 999 Years to be computed from the 25th day of December, 1865, at such Aunual Rental payable half yearly on the 25th day of December and the 24th day of June in every year as is specified in the Particulars of such Lot hereinbefore contained and such Crown Lease shall be subject to and contain all the exceptions, reservations, covenants, clauses and conditions usually inserted in the Crown Leases of Inland Lots in the Colony of Hongkong and contained in the Printed Form of Crown Lease in Schedule A annexed hereto and also such one or more of the special Covenants in Schedule B annexed hereto as have reference to the Lot in respect of which such Crown Lease shall be granted. 5.-The Purchaser of every Lot shall pay to the Surveyor General a Fee of $5 upon the execution of the Crown Lease thereof.
6. Should the Purchaser neglect or fail to comply with these conditions his Premium shall be thereupon forfeited to Her Majesty who shall be at full liberty either to enforce the sale or to re-sell the Property at such time and place and in such manner as to Her Majesty shall seem fit and in case of a re-sale the increase if any of the Premium or Purchase Money shall be retained by Her Majesty and the deficiency if any and all costs and expenses shall be made good by the Defaulter and be recoverable as liquidated damages.
7.-Possession of every Lot sold shall be given to the Purchaser and deemed to have been taken by him on the 25th day of December, 1865.
SCHEDULE A.
The Printed Form of Crown Lease referred to in the foregoing conditions of Sale can be inspected on application at the Surveyor General's Office previously to the Sale.
SCHEDULE B.
Special Covenants referred to in the foregoing conditions of Sale.
A.-The Crown Lease of sale Lot No. 2 shall contain a covenant that the Lessee his executors administrators or assigns shall not erect any building thereon of a greater height than 25 feet above the level of Staunton Street at its junction with Peel Street.
B.—The Crown Lease of sale Lot No. 5 shall contain a covenant that the portion of the Praya and Sea Wall in front of and the reclaiming of the said Lot shall be executed by the Surveyor General at the cost of the said Lessee his executors administrators or assigns who shall on demand from time to time as the work proceeds pay to the Surveyor General such sum or sums as the Surveyor General shall certify in writing to be due in respect of the contract price for the execution of the said work.
C-The Crown Lease of sale Lot No. 6 shall contain a covenant that the reclaiming of the said Lot shall be executed by the Surveyor General at the cost of the said Lessee his executors administrators or assigns who shall on demand from time to time as the work proceeds pay to the Surveyor General such sum or sums as the Surveyor General shall certify in writing to be due in respect of the contract price for the execution of the said work.
D.-The Crown Leases of sale Lots No. 7 and Nos. 19 to 28 both inclusive shall each contain a covenant that the Lessee his executors administrators or assigns shall not erect thereon respectively any Chinese houses or shops, but first class European houses or Godowns only.
MEMORANDUM OF AGREEMENT BY THE PURCHASER.
Memorandum that each of the persons whose names and signatures are hereunder written has been declared the highest bidder for the Lot described in the foregoing Particulars of sale and hereunder specified opposite to his said name and signature and does hereby agree to become the Lessee thereof under and subject to the foregoing conditions of sale and on his part to perform and abide by the said conditions.
