SETH AVIET SETH, Plaintiff,

and JORDAN ARATHOON JORDAN,

Defendant.

WHEREAS Action has been commenced

in this Court at the suit of the above named Seth Aviet Seth against the above named Jordan Arathoon Jordan to recover the sum of Four thousand and Ninety-two Dollars and Sixty- five Cents for that in consideration that the said Plaintiff would employ the said Defendant as his Agent to sell and dispose of certain Goods for the Plaintiff for reward to the Defendant he the said Defendant promised to sell and dispose of the said Goods for the said Plaintiff and on request to render to the Plaintiff a true and just account of the said Goods and of the sale thereof and of the moneys arising from such sale and the Plain- tiff employed the said Defendant and the Defen- dant received and had the said Goods for the purpose and on the terms aforesaid and all con- ditions were fulfilled and all things happened and all times elapsed necessary to entitle the Plaintiff to maintain this Action for the breach hereinafter mentioned yet the Defendant did not render to the Plaintiff a just or true or any other account of the said Goods nor of the sale thereof nor of the moneys arising from such sale. And it being alleged that the said Jordan Arathoon Jordan does not reside, within this Island or its depen- dencies, a Writ of Foreign Attachment has been issued returnable on the Sixteenth day of October next, wherein Arthur David Sassoon and Solomon David Sassoon the resident partners in Hongkong of the firm of David Sassoon Sons and Company are Garnishees.

Notice is hereby given thereof and that if at any time before final judgment in this Action the said Jordan Arathioon Jordan or any person on his behalf will give the security and notice and file the appearance or plea required by the Ordinance of this Island intituled "An Ordinance to provide for and regulate process in actions at Law against persons absent from the Colony," the said attachment may be dissolved.
