IX. Every Chinese not being the Holder of a Pass who shall Penalty for without reasonable Excuse, the Proof of which shall lie upon

X. Every Chinese who without reasonable Excuse, the Proof Penalty for not of which shall lie upon him, shall be found at large, between carrying a Sunset and Sunrise without a lighted Lantern, shall be liable on tween Sunset Summary Conviction thereof before a Magistrate, to a Fine not and Sunrise. exceeding Ten Dollars, or to Imprisonment not exceeding One Month.
XI. The Provisions of Section XXXII of Ordinance No. 6 of Forgery, &c., 1865, as to the Forgery or Alteration of Orders of any Justice of of Passes. the Peace, shall apply to the Forgery or Alteration of Passes issued by the Superintendent of Police under this Ordinance.
XII. Whosoever shall without reasonable Excuse, the Proof of Having Pos- which shall lie upon him, have in his Custody or Possession a Pass session of which shall have been forged or unlawfully altered, knowing the Forged Pass. same to have been so forged or altered, shall be guilty of a Mis- demeanour and on Conviction thereof, shall be liable at the Dis- cretion of the Court to be Imprisoned for any Term not exceeding Two Years with or without Hard Labor.
XIII. The Custody or Possession of a forged or altered Pass, What shall be under the last preceding Section, shall include such Custody and Custody or Possession as is defined by Section I of Ordinance No. 10 of 1865.
Possession.
XIV. Whosoever shall steal or, for any unlawful Purpose, take Stealing from its Place of Deposit for the Time being, or from any Person Passes. having the lawful Custody thereof, any Pass issued under this Ordinance, or shall, without reasonable Excuse, the Proof of which shall lie upon him, receive such Pass, knowing the same to have been feloniously stolen or taken for any unlawful Purpose as aforesaid, shall be guilty of Felony, and being convicted thereof, shall be liable to be imprisoned for any Term not exceeding Two Years with or without Hard Labor.
XV. Whenever any Person shall be found guilty of an Offence Whipping. against Sections VIII, IX, XI, XII and XIV of this Ordinance, the Court before which the Offender shall be tried may, in its Discretion, order the Offender, if a Male to be publicly or privately whipped, either in Addition to or in Substitution of any other Punishment to which he shall be liable for such Offence: Provided that no such Whipping shall be inflicted otherwise than under the Conditions prescribed by Section VI of Ordinance No. 6 of 1862, and that the Number of Strokes shall be specified by the Court in the Sentence.
XVI. Any Orders made by the Governor in Council under this Proof of Orders Ordinance shall be sufficiently proved in any Court of Law by the by Governor in Production of a Copy of the Gazette in which the same shall be Council. published.
