Regulations.
INTITULED
An Ordinance to consolidate and amend the law with respect to persons carrying on business as money-lenders.
BE it enacted by the Governor of Hong Kong, with the advice and consent of the Legislative Council thereof, as follows :-
1. This Ordinance may be cited as the Money-ienders Ordinance, 1928.
2. In this Ordinance,
money-
(1) “Agreement" means an agreement of
lending by a money-lender, and includes every transaction which, whatever its form may be, is substantially oue of money-lending by a money-lender.
(2) "Money-lender" includes every person whose business is that of money-lending, but shall not include-
(a) any pawnbroker, in respect of busi- ness carried on by him in accordance with the provisions of any Ordinance relating to pawnbrokers; or
(b) any body corporate, empowered by an Ordinance or by special Act of Parliament to lend money in accor- dance with such Ordinance or Act;
or
(e) any person bona fide carrying on the business of banking or insurance, or bona fide carrying on any business not having for its primary object the lending of money, in the course of which and for the purposes whereof he lends money; or
(d) any person for the time being exempted from registration under this Ordinance by an order of the Governor in Council, which has not been revoked by a subsequent order of the Governor in Council.
(3) "Person" includes a body corporate and a
firm.
(4) "Registrar" means the Registrar of Money- lenders, and failing any other appointment under any regulation made under this Ordi- nance the Registrar of Companies shall be the Registrar of Money-lenders.
3.-(1) It shall be lawful for the Governor in Council to make regulations in respect of all or any of the following matters :-
(a) The appointment and duties of the Registrar.
